    Approve the construction agreement, in the amount of $3,189,000, with West Bay Builders, Inc. for the Elementary School Exterior Athletic projects.
    Background Information
    In November 2010, the voter passed Measure M Bond, which including exterior athletic improvements at all eight (8) elementary schools. The District conducted a formal sealed bid opening process, per State of California Public Contract Code requirements. On May 7, 2013, the Board approved the purchase and installation of the playstructures via a California Multiple Award Schedule (CMAS) contract. On May 21, 2013, the District received six (6) bids for the Measure M Elementary School Exterior Athletic Playgrounds, per Public Contract Code requirements. This bid includes the shade structures (outdoor classrooms), walking paths, playground asphalt repairs, playground markings/stripping, fall zone material, etc. The lowest responsive, responsible bidder was West Bay Builders, Inc. in the amount of $3,189,000. The estimated construction budget for the site work was $4,029,217, the lowest responsive, responsible bid is <$840,217> under estimated budget. The agreement has been reviewed by the District?s former legal counsel and the template has been used as the District standard through Measure M.
