San Leandro High School proudly shared their award winning community service learning activities and projects during the Season of Service, Period of Peace which runs from Dr. Martin Luther King, Jr. Day through Cesar Chavez Day March 30. San Leandro High School teachers Jill Synott, and Phil Hargrave, and San Leandro High School student Valencia Clark, President of the Student Peace Council for Season of Service, shared their inspiring and creative thinking as they launch this year's Season of Service, Period of Peace. Highlights included:
- Season of Service Period of Peace began in 2006 with twenty-four students from the San Leandro Academy for Multimedia (SLAM) participating in a "Fast for Non-Violence." This year, approximately 1500 students from such groups as SLAM, AVID Program, After School Program, Academies, sports teams, Special Education, and various school departments will be participating in this 10-week campaign to create campus climate that values non-violence
- Activities will be happening simultaneously at the FTK Campus and the San Leandro High School main campus
- At the conclusion, there will be two all-school assemblies celebrating the students and all the work they have done
- For the past two years San Leandro High School has won awards, specifically noting that last year, SLAM was honored with the "Promising Practices Award" from the Character Ed partnership
Mr. Hargrave provided a video of last year's presentation highlighting how the various service groups demonstrated peace, along with one of the student projects from SLAM on cyber-bullying.
Following the video, Ms. Synott said that this year's theme focuses on personal responsibility and what it means to be an ally to your peers, and helping to create a safe place for all kids on campus. Upcoming projects for this year include:
- The Black Student Union (BSU) will be holding an all-school poetry contest
- Club Rainbow will be conducting classroom visits to educate students about gender diversity, and gender bullying. They will also be hosting a screening of "Straightlaced" in the AEC on February 1
- DECA will be targeting cyber-bullying
- Boys Basketball is teaming up with the severely disabled Special Ed. students regarding being an ally to your peers
- The English classes will be working together to help bridge the gap between the SLHS and FTK campuses
- AVID is creating anonymous bullying tip-box on the FTK campus
- SLAM is participating in the SLAM Fast for Nonviolence
San Leandro High School student Valencia Clark shared her thoughts and experience, adding that she is very excited about this year and invited the Board to participate and attend the assemblies.
The Board thanked the high school staff for this very touching and informative presentation and for guiding the students. A copy of this year's schedule will be sent to the Board. |

- Joseph Stegner, Jr., a resident of San Leandro and a former student of Sandy Hook Elementary School, addressed the Board regarding a song that he wrote a couple of months before the tragedy in Newton, Connecticut. He is hoping to find an elementary school chorus to sing an excerpt of the song (which he distributed) to add to a collection of work by Sandy Hook School alumni, while inspiring the singers and their audiences for years to come. He hoped that the Board would find the lyrics moving and asked if he could be directed on how to proceed.

Terri Montgomery, Principal, from Vavrinek, Trine, Day and Co, LLP, District's independent auditor, presented the audit report related to the District financial statement for the year ending June 30, 2012 (2011-2012). The audit report includes the District financial statements, supplemental information, auditor's opinions on the financial statements, federal compliance, and state compliance.
Ms. Montgomery reported that that District received one significant deficiency with the finding related to the Associated Student Body (ASB). Responding to the ASB finding, Assistant Superintendent Song Chin-Bendib noted that the site office managers and ASB staff members were sent to workshop in November 2012, and the district will also continue to monitor the sites with periodic site visits to review student body activities and to tighten and strengthen the internal controls surrounding the student body funds. In addition, Ms. Montgomery will be giving a presentation on January 18, 2013, for Principals, Office Managers and other staff who are directly involved with Donations and ASB funds. Following up on a comment made by Trustee Katz-Lacabe that findings related to ASB funds are a frequent area of work needed, not only in our District, but other districts, Ms. Montgomery said that out of approximately 250 school district audits their firm does a year, about 80% have an ASB finding, adding that for the first year they audit a district, it is very rare that that is the only finding, commending the District for receiving only this one.
In addition, Vavrinek, Trine, Day and Co, LLP, shared with the Board the Performance Audit on the Measure B and Measure M Bond funds. A Performance Audit requires the independent auditors to randomly select the sample of expenditures using a statistical methodology that provides high accuracy and a wide range of transactions. The Performance Audit will be presented to the Citizens Bond Oversight Committee (CBOC) on February 13, 2013. It was noted that two corrections were made on the Measure M and Measure B financial audits, adding that they have been fixed and a revised copy will be distributed to the Board, District Office staff, and the Citizens Bond Oversight Committee (CBOC).
Ms. Montgomery concluded that the District continues to have consecutive excellent audit reviews, with the performance audit on Measure B and M showing funds were expended only on the voter-approved Measure B and M projects, for the fourth year in a row.
The Board thanked the audit firm for their service. |

In addition, Eden Area ROP functions as the District's career technical education advisory committee for each pathway to develop recommendations on the program. The Board of Education must annually approve Eden Area ROP as the provider of this function.
Dr. Irene Fujii, Superintendent of Eden Area ROP, reviewed the 2011-2012 data, program, student highlights and the work ahead. The Board received for information the Eden Area Regional Occupational Program Annual Report.
The Board was happy that the District is part of this program and thanked Dr. Fujii for the presentation and for what ROP offers our students. Trustee Rosato asked that copies of the written slides of the presentation be sent to the Board. |

Assistant Superintendent of Business and Operations, Song Chin-Bendib; John Dominguez, Interim Director of Bond Projects; Kurt Weidmann, Consultant with Harris and Associates; DLM Architecture, SIM Architects, and Van Pelt Construction Services provided a facilities and construction presentation to the Board on the Measure M Exterior Athletic Design and Construction Documents for Garfield, Jefferson, Madison, McKinley, Monroe, Roosevelt, Washington and Wilson Elementary Schools.
It was explained that the original scope, as approved by the Board, was to repair the playground equipment. However, with additional savings from bond projects, and discovering that the cost differential between repairing and replacement is minimal, staff requested the architects develop two options for bids:
Option A: Repairing playground equipment, and
Option B: Replacing playground equipment
It was noted that staff was recommending approval of Option B as the marginal cost increase between repairing and replacing equipment is due to the high cost of having to custom fabricate some equipment items which were impossible to replace. Additionally, replacement equipment will last 15 years vs. 5 years for repaired equipment, which is a much better investment.
The presentation was followed by a conference item to discuss and consider approval of staff's recommendation and the corresponding construction documents.

Goal #5: Ensure Safe and Well Maintained Facilities
Assistant Superintendent of Business and Operations, Song Chin-Bendib; John Dominguez, Interim Director of Bond Projects; Kurt Weidmann, Consultant with Harris and Associates; DLM Architecture, SIM Architects, and Van Pelt Construction Services will provide a facilities and construction presentation to the Board on the Measure M Exterior Athletic Design and Construction Documents for Garfield, Jefferson, Madison, McKinley, Monroe, Roosevelt, Washington and Wilson Elementary Schools.
The presentation will be followed by a conference item to discuss and consider approval of the construction documents. |
|
|
| These items are submitted for advance planning and to assist the Board in establishing future agenda items. The Board may, however, take action on the following: |
|
|
| Cost of replacement is estimated to be only $77,500 more than the cost of repair, and is funded through Measure M. |

| Facilities and Technology Committee: January 9, 2013 |
In November 2010, San Leandro voters passed Measure M, a $50.1 million school facilities bond to address modernization and new construction throughout the District, including the renovation of the Pacific Sports Complex and Burrell Field, renovation of the San Leandro High School Swim Center, a new track and field at John Muir Middle School and various other projects at all school sites throughout the District.
In order to design facilities that will best serve the needs of our students, schools and the community, the District used the same successful Conceptual Design Team process that was used for the Measure B Bond Program. Three Conceptual Design Teams were formed:
- Pacific Sports Complex and Burrell Field
- San Leandro High School Swim Center, Track and Field
- Elementary and Middle Schools Athletic Exteriors
The Conceptual Design Teams for the Elementary and Middle Schools Athletic Exteriors held their three meetings: October 25, November 9, and November 29, 2011. During the first meeting members were introduced to one another, meeting norms were established, and an overview of the architectural design process and the role of the Conceptual Design Team were provided. After a review of each site, stakeholders from each school identified all the current uses, expressed potential uses they would like to see at the site, asked questions, and voiced concerns and needs.
The architects incorporated the feedback and suggestions, and at least one schematic review design meeting was held at each site. The schematic designs were presented to the Board of Education and approved on July 17, 2012.
The architects have taken the approved schematic designs and further refined them based on additional meetings with the sites in order to develop the Construction Documents for submittal to the Division of the State Architect (DSA) for review and approval.
The original scope as approved by the Board is to repair the playground equipment. However, with additional savings from bond projects, and discovering that the cost differential between repairing and replacement is minimal, staff requested the architects to develop two options for bids: A) repairing playground equipment, and B) replacing playground equipment.
The marginal cost increase between repairing and replacing playground equipment is due to the high cost of having to custom fabricate some equipment items which were impossible to replace. Additionally, replacement equipment will last 15 years vs. 5 years for repaired equipment, which is a much better investment.
Staff is recommending approval of Option B, and approval of the corresponding Construction Documents for the Elementary Schools Athletic Exteriors. |

Superintendent Cathey acknowledged the Keep Music Rockin Foundation, and students in the San Leandro High School Jazz Band for submitting a video request to Carlos Santana inviting him to visit the high school and meet with them. Later the students were invited to join him for a jam session.
The Superintendent provided a brief summary of the School Services of California (SSC) workshop on the Governor's Proposed Budget which was attended by Assistant Superintendent Song Chin-Bendib, Trustee James, and her today, reporting that normally you come away with an understanding of the impact of the budget to the District; however, that was not the case as the "weighted formula", now called the Local Controlled Funding Formula (LCFF) is unknown at this time. SSC is working really hard to figure out what it means for districts. On the positive side, she said this is the first time in five years that funding is going up, noting that the process has just begun. Hopefully there will be some clarity when the May Revise comes out. The Superintendent added that Assistant Superintendent Chin-Bendib will be providing a detailed presentation on the budget at the January 29, 2013, Board meeting.
The Superintendent attended the City Council work session last night where they discussed fee structures for the use of the fields by the City, by residents and by non-residents. They also had a preliminary discussion about Burrell Field and the Pacific Sports Complex, noting that limited funds is an issue. Staff will come back to the Board with some options, and next steps.
The Superintendent reminded the new Board members of the New Board Orientation tomorrow with Educational Services from 5:30-7:00 p.m. at the District Office.
Following the Superintendent's report, Trustee Katz-Lacabe asked that information regarding the death of the San Leandro High School student be included in the next Confidentially Speaking. |

| Adopt Resolution No. 13-05 National No Name Calling Week, January 21-25, 2013 |
| Board Policy 5145.3 Non-Discrimination/Harassment
Board Policy Bullying/Cyberbullying |
All schools in the San Leandro Unified School District are working diligently to ensure that every school and every classroom are free of all forms of bullying. National research and mental health organizations tell us that every year, students of all ages in schools across the nation encounter various forms of bullying such as physical bullying (hitting and/or punching), verbal bullying (teasing or name calling), emotional bullying (intimidation through gestures or social exclusion) or cyber bullying (sending insulting messages by phone or computer e-mail). Victims of bullying can suffer long term negative effects. Each year all schools receive information and curriculum resources to address this issue from the www.nonamecallingweek.org website. To solidify the District?s continued commitment to creating safe, respectful, and inclusive schools and classrooms, staff is recommending the Board of Education adopt a resolution in support of and to ensure the District?s schools? participation in ?National No Name Calling Week? (January 21-25, 2013) and promote anti-bullying messages and practices through this national event.

| The proposed contract for James Foster?s services will be $50 per hour for a total of $9,600 out of the General Fund budget (it is part of the budget; no additional cost). This contract will cover up through March 31, 2013. |

| Approve extension of the contract for Network Administrator, James Foster, to assist the District in administering and managing its data network through March 31, 2013. |
| This contract is to extend James Foster?s (Jim) services in the Information Technology (IT) Department from January 2013 to end of March 2013. James Foster has assisted the IT Department of San Leandro Unified in maintaining our data network for the past 20 years. Under the terms of the current contract, Jim is assigned to work 8 hours a day, 2 days a week (totaling 16 hours per week). The details of contract stipulate Jim?s compensation at a rate of $50/hour, not to exceed $39,200 per year. In addition, either party has the option to terminate the contract with 30 day prior notice. These terms and rates have remained the same for the past 4 years.
Initially Jim was planning to retire in June of 2012, but the District requested that he postpone his retirement until the District had a plan for the position. Thus, Jim agreed to postpone his retirement until December of 2012, and the Board approved his contract extension on June 5, 2012.
On December 4, 2012, the Board approved a Network Technician position in lieu of contracting with Jim, and staff is in the process of filling the position. Filling the position takes longer than expected. Therefore, the District has requested Jim to further postpone his retirement until March 2013. This new contract extension moving forward will only be for the three additional months from January 2013 to end of March 2013. The total amount of the new extension will be $9,600 while maintaining the same hourly rate and hours per week. This will provide the District more time to fill his position and fulfill his responsibilities.
It will be difficult, if not impossible, to find someone with Jim?s experience and expertise at the current rate of compensation. James Foster is an asset to the District IT Department. His experience in technology and history in the District has proven to be invaluable to the successful operations of the IT Department, with his 13 year knowledge of our District network and servers. Jim is also employed by Pleasanton Unified on a part time basis and we have benefited on more than one occasion from the experiences he has brought over from Pleasanton.
Part of Jim?s responsibilities include, but are not limited to: maintaining the servers to ensure their proper operation, server rebuilds, updating staff accounts and access permissions, configuring/updating the VoIP system and any and all issues that cannot be resolved by the experience and knowledge of a level one computer technician. He is also a great backup person to have when the Information Technology Administrator is not available or to step in to assist the Technology Administrator wherever needed.
The District Information Technology Department has not increased staffing since its inception 14 years ago. With the addition of the 9th Grade campus, the new labs at the Business Academy and the Arts & Education Center and the influx of additional computers throughout the District, the Information Technology Department certainly cannot afford to lose the staff it currently has. |

| Approve the contact with Finishing Touches to repair the San Leandro High School Library tables |
| Library tables at San Leandro High School have been vandalized over time and many were in very poor condition. In an effort to repair the tables, the school contacted the Maintenance and Operations Department to determine the best way to repair the tables. The Maintenance Department Manager determined that the tables could not be repaired in-house, by district staff. A cost estimate was obtained by the Maintenance Department from an outside vendor. The cost estimate to properly repair the tables was beyond the affordability of the school.
In an effort to find the best deal to repair the tables, San Leandro High School staff sought other estimates. The high school contracted with Finishing Touches to complete the work during the Thanksgiving break. Upon completion of the work, the high school paid the vendor $5,300 from the school?s library donation account.
The District?s procedures for hiring an outside contractor and the District?s contract approval process were not followed in this instance. At this time, staff is bringing the contract forward to the Board for approval (post completed work).
The correct contract approval process has been reviewed with San Leandro High School staff and such an error should not reoccur.

| Approve Final Change Order #3 to the Construction Contract, in the amount of $44,687, with Trinet Construction, Inc. for the Lincoln High School renovations, upgrades, site athletic improvements, portable large classroom project and additional fire alarm work. |
| Facilities and Technology Committee: January 9, 2013 |
In 2006, renovations and upgrades to Lincoln High School were identified in the Measure B language and in 2007, the renovation project was created.
In 2010, Measure M created a project for exterior athletic improvements.
In 2011, the Board created a Measure B savings project for a multi-purpose large portable building to provide space for assemblies, inclement weather physical education activities, lunches, and other related indoor activities.
In 2011, Jeffery Wong Architects was retained to design and prepare all of the design and construction documents for the three scopes of work.
The design called for two contractors, one for the building fabrication and one for the site and other work. On February 28, 2012, the Board approved the piggyback purchase of a pre-approved 40? x 60? portable building from Enviroplex, Inc. On May 15, 2012, the District conducted a formal sealed bid opening process for the sitework project, per State of California Public Contract Code requirements. The site work project for Lincoln High School includes renovations, upgrades, site athletic improvements, and sitework for the 40? x 60? classroom. On June 5, 2012, the Board of Education approved the contract with the lowest responsive, responsible bidder, Trinet Construction, Inc.
On August 7, 2012, the Board of Education approved Change Order #1 to Trinet in the amount of $14,687; and on November 6, 2012 the Board of Education approved Change Order #2 to Trinet in the amount of $15,235.
Change Order #3, in the amount of $44,687 to Trinet and is required by Code. The existing fire alarm system was a stand-alone system, unmonitored by Sonitrol, but met code requirements and the needs of the District. The project was approved by DSA with the fire alarm as-is. During construction, DSA investigated further and determined that because the campus has expanded with added buildings, and fire alarm codes have changed, a campus wide, addressable, fully monitored fire alarm system is now code required.

| Facilities and Technology Committee: January 9, 2013 |
One of the major marquee projects identified in the Measure M language is the San Leandro High School Swim Center and Fields project. The District retained WLC Architects, Inc. to design and prepare all the design and construction documents. Plans and specifications were approved by the Division of the State Architect (DSA) on May 18, 2012, and the project was bid through the requirements of Public Contract Code.
On July 10, 2012, the District received bids through the formal sealed bid opening process, per State of California Public Contract Code requirements, for the San Leandro High School Swim Center and Fields project.
Seven (7) bids were received for the project. The lowest responsive, responsible bid was submitted by F&H Construction, Inc. in the amount of $10,186,000. On July 17, 2012, the Board of Education created the Measure B SLHS Grading & Drainage project and approved the construction contract with F&H Construction, Inc.
On November 6, 2012, the Board of Education approved Change Order #1 for the removal and disposal of asbestos containing pipes from various areas of the existing athletic fields at the high school to an approved landfill.
Change Order #2, in the amount of $20,249, addresses field conditions to improve safety, or item modifications to increase value, flexibility and/or functionality. It incorporates credits and additions from the value engineering exercise that occurred after the bid/award phase.

| Approve the Construction Services Agreement, in the amount of $224,075, with Maggiora Bros. Drilling, Inc. for Irrigation Well Construction at San Leandro High School. |
| Facilities and Technology Committee: January 9, 2013 |
On August 7, 2012, the Board of Education approved the creation and funding of the SLHS Irrigation Well Replacement scope from Measure B Savings.
On December 6, 2012, the District received two bids for the demolition of the existing well and construction of a new well at SLHS, per Public Contract Code requirements. The low responsive, responsible bidder was Maggiora Bros Drilling, Inc., in the amount of $224,075. This agreement in the amount of $224,075 covers construction of the replacement irrigation well at San Leandro High School.
The bids were over the engineer?s original anticipated cost for construction of $170,000. Bid climate, constrained occupied school site and well depth may have been contributing factors to the difference. The replacement irrigation well is required to avoid the continuing general fund costs of purchasing water from East Bay Municipal Utility District to irrigate fields, thus, there is long term savings to the General Fund. The capital cost short fall of $54,075 will be funded from available project contingency.
The agreement has been reviewed by the District?s former legal counsel and the template has been used as the District standard through Measure B.

| Approve the Agreement in the amount of $1,198,640 with American Modular Systems, Inc. for the Fabrication and Installation of a seven modular classrooms at Washington Elementary School. |
| Facilities and Technology Committee: January 9, 2013 |
| On July 10, 2012, the Board of Education reviewed and then on August 21, 2012, approved the Measure B Savings Projects, which included the Washington Elementary School Portable Classroom Replacement project in the budgeted amount of $2,300,000.
On December 11, 2012, the Board approved a $750,000 increase to the project budget to bring the total project budget to $3,050,000. The $750,000 budget increase is to install modular classrooms instead of portable classrooms.
Also on December 11, 2012 the Board granted authority to staff to negotiate and enter into a piggyback agreement up to $1,500,000 with AMS.
The District is utilizing a State approved and established procurement and delivery method, commonly referred to as a ?piggyback contract?. For the purchase and installation of modular classroom buildings, this delivery method allows relatively rapid procurement, fabrication, delivery and installation of replacement classrooms at Washington Elementary School over the 2013 summer break, at a competitive price.
The piggyback contracting method can be used to procure equipment and modular classroom buildings. An original awarding agency issues bid documents, advertises, and receives competitive bids. In those bid documents there is clause that allows follow-on awarding agencies across the state to, in effect, write a change order to the original contract and receive the same competitive pricing. In addition to knowing the pricing ahead of time, the other main advantage is that the original awarding agency has already satisfied all the bid advertising, notifications and other requirements of Public Contract Code. This saves time and allows factory fabrication to start earlier.
In this case, there is a current competitively bid contract between American Modular Systems Inc. and the Biggs Unified School District (BUSD) High Performance Facilities Contract approved by BUSD on 2/16/12, and this is now available for the San Leandro Unified School District to use for the purchase and installation of the modular buildings. On February 16, 2012, the Board of Trustees of the BUSD approved awarding the High Performance Facilities Contract for new modular classroom buildings and site work.
The agreement has been reviewed by the District?s legal counsel Orbach, Huff, & Suarez, LLP. |

| Facilities and Technology Committee: January 9, 2013 |
Two of the major marquee projects identified in the Measure M language are the SLUSD Pacific Sports Complex and Burrell Field, and the San Leandro High School Swim Center, Track and Field Project. Construction of these projects necessitates the displacement of the San Leandro High School (SLHS) sports teams. As directed by the Board of Education, staff researched transportation needs of students during the construction phase.
On June 7, 2012, the District conducted a formal sealed bid opening process, per State of California Public Contract Code requirements, for award of a contract for Furnishing Extracurricular Transportation for Groups of Students (Bid No. 13-15) for San Leandro Unified School District.
Three (3) bids were received for the furnishing of extracurricular transportation for groups of students displaced by the project.

| Adopt Resolution No. 13-04 Acknowledging the State of California?s Applications Received Beyond Bond Authority Language |
| Facilities & Technology Committee: January 9, 2013 |
| The Office of Administrative Law approved emergency regulations on November 1, 2012, that will impact how the Office of Public School Construction (OPSC) process applications received after existing State bond authority is no longer available for New Construction and Modernization applications. These regulations establish a State Allocation Board (SAB) acknowledged list for projects that are received by OPSC after State bond authority is exhausted. The new list is called the ?Applications Received Beyond Bond Authority List."
Applications placed on this list will only undergo an intake review to ensure all of the required documents have been submitted, but will not be fully processed by the OPSC nor presented to the SAB for approval.
All New Construction and Modernization applications received on or after November 1, 2012, will be subject to the new regulations and processing procedures, as approved by the SAB at the September 2012 meeting.
Resolution No. 13-04 acknowledges that the State of California is not expected or obligated to provide funding for future funding applications submitted under the school facility program and is required to be adopted by school boards in order to be eligible to submit applications. Essentially, adoption of the resolution will allow our District to submit applications and get in line should funding become available in the future. |

Assistant Superintendent Song Chin-Bendib explained that the Budget Development Timeline for Fiscal Year 2012-13 which includes 2013-2014, 2014-2015, and 2015-2016 is a working document and typically it ties to the unveiling of the Governor's proposed budget. The document is a work in progress and staff updates it whenever relevant and appropriate information is available, and brings it to the Board as an information item. She drew the Board's attention to the Finance Committee meetings, noting that in light of the lack of clarity and insufficient detail received from the School Services of California (SSC) budget conference today, she is asking that the Board approved the timeline tonight and that it be adjusted as more information becomes available.
With that, Trustee Rosato asked that when the meetings are scheduled, ample notice of cancellation be given to our stakeholders. Assistant Superintendent Chin-Bendib said that staff is very mindful of noting changes, informing stakeholders, and posting on the website.
Following the discussion, the Board approved the Budget Development Timeline for 2013-2014 Adopted Budget which includes fiscal years 2014-2015, 2015-2016. Trustee Carey was absent. |

| Discuss, review, and approve the Budget Development Timeline for 2013-2014 Adopted Budget which includes fiscal years 2014-2015 and 2015-2016. |
| California Education Code 42120-42129 |
| Fiscal turmoil started in 2008-09 at the State level and as a result school districts across the State have experienced severe and devastating budget cuts. Hopefully, with the passage of Proposition 30 in November 2012, there is some fiscal stability for school districts in the next few years.
Staff will be attending the School Services of California (SSC) budget conference on January 15, 2013, and will be presenting any and all relevant information to the Board on January 29, 2013.
Attached is a draft or working document of the Budget Development Timeline. Every fiscal year, the process commences at the beginning of the calendar year and typically it ties to the unveiling of the Governor?s proposed budget. The document is a work in progress and staff will update it whenever relevant and appropriate information is available.
As part of the budget development timeline, districts are required to submit an adopted budget to the Alameda County Office of Education (ACOE) before June 30, 2013. The adopted budget will include fiscal years 2013-2014, 2014-2015, and 2015-2016.
The budget development timeline shows the progression of meetings that are needed to finalize the adopted budget, which will occur throughout the 2012-2013 school year. The Board will discuss this timeline and opportunities for the community to stay informed and provide input. |

| Adopt Resolution No. 13-06 Submittal of Application(s) for all CalRecycle Grants for which San Leandro Unified School District is Eligible. |
| Facilities & Technology: January 9, 2013 |
| In November 2010, San Leandro voters passed Measure M, a $50.1 million school facilities bond to address modernization and new construction throughout the District, including the renovation of the Pacific Sports Complex and Burrell Field, renovation of the San Leandro High School Swim Center, a new track and field at John Muir Middle School and various other projects at all school sites throughout the District, including renovations and upgrades of all elementary school athletic exteriors (i.e. playgrounds).
In order to design facilities that will best serve the needs of our students, schools and the community, the District is aggressively pursuing grant funding opportunities to offset costs and/or enhance scope of work. The State of California Department of Resources Recycling and Recovery (CalRecycle) administers various grant programs, including the Tire-Derived Product Grants, which is a reimbursement grant. Deadline for the 2012 Tire Derived Product Grant was December 11, 2012, with a secondary deadline of January 17, 2013, for online posting of a Board Adopted Resolution authorizing submittal of application(s) to CalRecycle for all grants for which the district is eligible, and empowering the Superintendent or her designee to execute all grant documents necessary to secure grant funds and implement any approved grant project.
If awarded, the Tire Derived Product Grant could reimburse the District for up to $150,000 for use of resilient materials manufactured from recycled tires. (In 2007, the City of San Leandro and the District received a recycled tired grant from the California Waste Management Board in the amount of $22,568 for the synthetic track at Bancroft Middle School). Based on its analysis of the data collected for a Report to the Legislature of the State of California, the California Office of Environmental Health Hazard Assessment (OEHHA) concluded artificial turf fields do not pose a serious public health concern, with the possible exception of an increased skin abrasion rate on artificial turf relative to natural turf. Additionally, the materials used are high quality and for children?s playgrounds, pose a safer surface for children.
Staff is recommending the adoption of Resolution No. 13-06 Submittal of Application(s) for all CalRecycle Grants for which San Leandro Unified School District is Eligible. |

| Williams Uniform Complaint Procedures (including Valenzuela Settlement Requirement) Quarterly Report:October-December 2012 |
| California Education Code Section 35186 |
| The regulations of the Williams lawsuit settlement require school districts to complete ?Quarterly Complaint? reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and misassignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). This legislation requires that districts offer services for two consecutive years following grade twelve to students who did not pass the CAHSEE by the end of their 12th grade. Additionally, the legislation requires that students and families have the opportunity to file a complaint against the District for not fulfilling this requirement. Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required.
For the period October-December 2012, the District did not have any complaints.

Trustee Toro appreciated that the high school students are concerned about safety at the school sites. He asked and received consensus for the Board and District staff review of the District's emergency procedures, and that the information be vetted by the San Leandro Police Department.
Trustee Rosato met with Castro Valley Unified School Board President John Barbieri, who encouraged our Board members to attend the next Alameda Schools Board Association meeting this Thursday, 7 p.m. at the Alameda County Office of Education. Trustee Rosato also announced that there are still openings for judges for the Dr. Martin Luther King, Jr. Forensics Tournament being held at James Logan High in Union city. He will pass on the information to the Superintendent.
Trustee L?pez thanked and concurred with Trustee Toro that staff should review the District safety standards. She attended, on behalf of the Board, the San Leandro YMCA Youth & Government's Bill Hearing Night on January 3, where a number of students from San Leandro High School participated in a mock bill hearing, adding that many community leaders, school officials and former trustees were in attendance. Trustee L?pez also attended (along with Trustees Prola and Katz-Lacabe) the City Council meeting on Monday and is looking forward to continued conversations and information regarding Burrell Field and Pacific Sports Complex.
Trustee Katz-Lacabe commented that while the birth rate is declining in various areas of San Leandro by two to three percent, the population for that same 10-year period increased by seven percent, suggesting that the District look at what the impact, if any, has on some of the assumptions we are making with regards to enrollment at the schools. He would like to see the Finance Committee meet soon and make recommendations for restorations of some of cuts made by the Board, in light of the passage of Proposition 30 and Measure L. He also expressed how grateful he was to Assemblymember Rob Bonta for his first piece of legislation clarifying the language regarding parcel taxes.
Trustee James, responding to Trustee Katz-Lacabe's regarding the Finance Committee meeting soon to consider restoration of cuts, felt that when clarifying information is received from the state, (which is expected in about two weeks) that would be the time for the Finance Committee to schedule a meeting. He also shared that his wife accompanied the San Leandro High School Ski Team for a one-day trip to Kirkwood.
Trustee Prola announced the following the 2012-2013 Board Committee assignments:

Trustee Prola welcomed the new Board members. She attended the Annual Boys and Girls Club Crab Feed on January 12, 2013. She also acknowledged Assemblymember Rob Bonta for introducing AB 59, clarifying the language of uniformity and the effects on parcel taxes. Trustee Prola asked and received consensus to adjourn the meeting in memory of the children and adults who lost their lives at the Sandy Hood Elementary School tragedy, San Leandro High School student Tyronta Mickens, and Joe Collier, husband of former Board member Esther Holcomb, who was a dedicated and long-time supporter of San Leandro Schools and our sports programs. |
