5.1. 2012-2013 Second Interim Report
Minutes:

Song Chin-Bendib, Assistant Superintendent of Business & Operations, presented the 2012-2013 Second Interim Report which includes Fiscal Years 2013-2014 and 2014-2015. Included in the presentation was fiscal information that was presented to the Finance Committee on March 4, 2013, including such topics as: Local Control Funding Formula, Measure L, Sequestration, increasing Special Education costs, Affordable Care Act and any other relevant information since the meeting.

Assistant Superintendent Chin-Bendib reported that for the fiscal year 2012-2013 Second Interim Report, San Leandro USD is certifying a positive certification.  Business Services staff has prepared the Second Interim Report, along with assumptions from the School Services of California (SSC), Inc.  Dartboard, which provides school districts critical economic indicators for budget projections.  Multi-Year projections along with other analytical reports were provided under separate cover.

Below are the Second Interim Report projected ending Fund Balances after designations for 2012-2013 and two subsequent years.  The unrestricted ending fund balances include  Tier III Flexibility funds that have been swept/approved by the Board.  Any unswept or unapproved funds have been accounted for in a separate account and are not included in these balances.

The following major assumptions have been applied toward the 2012-2013 Second Interim Report:

  • Revenue Limit statutory COLA for 2012-2013 - 0%,
  • Reduction of COLA for 2013-2014 from 2.0% to 1.65%
  • Reduction of COLA for 2014-2015 from 2.3% to 2.2%
  • Revenue Limit deficit factor - 22.272%
  • Special Ed additional encroachment of $100,568 due to declining enrollment for 2012-2013 only
  • Superintendent search firm for $25,000 ? 2012-2013 only
  • Gas savings due to pool construction of $50,000 for 2012-2013 only
  • CSR/Lottery revised revenue increase of $94,371 for 2012-2013 only

  • Lottery = $124.00 unrestricted and $30.00 restricted for 2013-2014
  • Lottery = $123.75 unrestricted and $30.00 restricted for 2014-2015
  • 8,430.3 ADA projections for 2013-2014 and 2014-2015

The Assistant Superintendent further explained that:

  • The Second Interim does not reflect the Governor?s Budget Proposal for Local Control Funding Formula (LCFF). At this time, LCFF has not yet been approved by the Legislature, however it is clear that implementation of the LCFF is the Governor?s highest priority.  The District has started discussing LCFF but is uncertain how much the District will actually receive. It is important to note that most school districts will receive additional funding for the first time since 2007-2008.
  • The usual Revenue Limit calculation was used as assumptions for the Second Interim. This is the direction provided by the Alameda County Office of Education (ACOE).

It was noted that the State of California has shown positive reports for a fiscal recovery; on the other hand federal sequestration has started. The impact to the District is primarily in Title I and Special Education funding. It is therefore prudent for the District to continue to be fiscally responsible, conserve its resources, and keep its flexibility open.

After the  presentation, the Board of Education thanked Assistant Superintendent Chin-Bendib and her staff for their work, and posed clarifying questions which were addressed by staff.

Quick Summary/Staff Recommendation
Approve the AT&T Voice and Long Distance Contract to provide for phone and long distance service throughout the District.
Board Committee
Facilities and Technology Committee: March 6, 2013
Background Information
In 2007, the State of California signed a 7 year contract (5 years plus two one year extensions) with the two major Telecommunications Companies in California-AT&T and Verizon. This contract, called CALNET2, which covered Voice and Long Distance Services (CALNET2 superseded CALNET1 in 2007), is due to expire on 01/29/2014, right in the middle of the 2013-2014 fiscal and E-Rate year. The Federal E-Rate program requires that funded agencies have contracts in place for the complete fiscal/E-Rate year, or revert to month-to-month (tariff) pricing. The tariff pricing, which would increase San Leandro Unified School District?s (SLUSD) rates for AT&T services by up to 40% per month, was not a viable option, and so SLUSD had to seek a contract option to replace the CALNET2 expiring contract. Therefore, SLUSD sent out a Request For Proposal (RFP) this year to seek a contract that would cover the ?bridge? gap from 01/30/2014 to 06/30/2014, as well as provide a contract term of 3 to 5 additional years. E-Rate rules do not require a formal RFP, but do require that enough information be provided by the District to potential bidders so that the proposals received can be accurate and thorough enough to get valid bid/proposal responses. E-Rate rules say that Schools or Districts must comply with local or State requirements for RFPs, and as the total dollar value of these responses would exceed $83,400, State rules require that a formal RFP must be issued, and advertised. SLUSD complied with these requirements as a part of this RFP process. There was only one response to the RFP, by AT&T, although at least 5 other vendors asked for copies of the RFP documents. Very few vendors can compete against AT&T for the range of services and the contract pricing available under the State Master contracts in California as the State has clauses in place that specify that no other entity can be offered lower rates than what AT&T offers under the State Master contract (CALNET2). Staff is recommending that San Leandro USD award the bid to AT&T, and recommend a 5 year contract for all voice and long distance services. The advantage of a contract with AT&T is that it keeps the CALNET2 rates in effect for the duration of the contract; there are no minimum quantities required for any services that SLUSD acquires from AT&T under this contract, and it allows SLUSD to convert from this contract to the new State Master Contract (CALNET3), when that becomes available, if the District so chooses should that contract offer better pricing or newer services as they become available. The cost to the District on average will be about $7,053.99/month so the total value of the contract is approximately $458,509.35 over the 65 month period. However, after E-rate discounts of approximately 77% and an additional California Teleconnect Fund Discount of 50% of the remainder, the average cost will be about $811/month or approximately $52,729 for the term of the contract. The Long Distance charges vary from month to month so there is no way of predicting the exact amount of the contract. A concern was brought up during the Facilities and Technology meeting regarding the 5 year term of the contract. In summary, this contract is for voice (phone) and long distance service. Data services is covered under a different contract with AT&T. When an RFP was issued by San Leandro Unified for the voice and long distance services, AT&T was the only vendor that responded. The proposal made by AT&T agrees to extend the CALNET2 pricing for the next 5 years or when the District elects to convert over to CALNET3 when available. AT&T has agreed to extend the CALNET2 pricing with the District only if the new contract was for a 5 year term. One of the provisions of CALNET2 was that no other entity is allowed to offer rates lower than that of AT&T thus ensuring the District gets the best rates available.

11.2. InterSchola Services Agreement
Fiscal Impact
A positive impact to General Fund if vehicles can be sold as surplus
TO:
Cindy M. Cathey, Superintendent

Quick Summary/Staff Recommendation
Approve InterSchola Services Agreement to sell surplus goods and equipment.
Background Information

The San Leandro Unified School District (SLUSD) Board of Education approved the surplus of ten maintenance vehicles at the February 26, 2013, Board meeting.  Next steps are to begin the process of selling or donating the ten vehicles in such a manner as to be in compliance with the California Education Code (CEC).  InterSchola is a San Francisco based company that helps schools and public agencies sell their surplus goods and equipment on eBay while diverting millions of pounds of waste from landfills. Utilizing InterSchola?s services would satisfy CEC section 17545, 17546 and 17547 requirements as follows:

The district may sell surplus or obsolete district-owned personal property through any of the following methods:

  1. The Superintendent or designee may advertise for bids by posting a notice in at least three public places in the district for at least two weeks, or by publishing a notice at least once a week for at least two weeks in a newspaper having a general circulation in the district and, if possible, publishing within the district. The district shall sell the property to the highest responsible bidder or shall reject all bids. (Education Code 17545) Property for which no qualified bid has been received may be sold, without further advertising, by the Superintendent or designee. (Education Code 17546)
  2. The property may be sold by means of a public auction conducted by district employees, employees of other public agencies, or by contract with a private auction firm. Notice related to the auction shall be posted or published as described in item #1 above. (Education Code 17545)

Money received from the sale of surplus property shall be either deposited in the district reserve or general fund or credited to the fund from which the original purchase was made. (Education Code 17547)

By approving the InterSchola Services Agreement, San Leandro USD can utilize the agreement on an as needed, ongoing basis for disposal of surplus personal property. InterSchola has provided staff a list of other districts that have utilized their services.

A Disclaimer of Warranty & Release of Liability form will be required to be completed at the time of sale of the maintenance vehicles.

Quick Summary/Staff Recommendation

Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2012-2013.

Background Information

Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Assistant Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?.

Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012.

Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. Detailed contract information or cover pages will not be part of subsequent Board Packets, but will be available for questions or inspection upon request.

Board Committee
Facilities and Technology Committee: March 6, 2013
Background Information
In July 2006, the Board identified a list of bond projects in the amount of $109 million. That list of bond projects became the list of Board approved bond projects to be funded from Measure B, which was passed by voters in November 2006. With the exception of the Open Space Project, all bond projects listed on the original list have been completed. As of June 30, 2011, the Measure B bond program has realized savings from projects completed under budget, State Matching Funds, Qualified School Construction Bonds (QSCB), Redevelopment Agency (RDA) funds, and interest in the amount of approximately $27 million. The amount may go higher after all projects have been completed. However, even with $109+ million worth of projects funded through Measure B, the San Leandro Unified School District?s unfunded modernization needs equal approximately $220 million. Since the remaining unfunded needs far exceed funding available, the Facilities and Technology Committee provided direction to staff to generate priorities and recommendations for the Board to use in deciding which new projects and scopes could be addressed using the $27 million in savings. In order to identify new projects priorities, staff utilized the SLUSD Board Approved District Wide Master Plan (1997/2003) filtering criteria: Priority 1 ? Health, Safety and Legal Priority 2 ? Building Shell Integrity Priority 3 _ Infrastructure and Utilities Priority 4 ? Classroom /Interior Renovations Priority 5 ? Renovation/New Construction for Education Programs Priority 6 ? Support Spaces for Educational Programs Priority 7 ? Outdoor Spaces Priority 8 ? Athletic Programs Support Facilities Priority 9 ? Renovation/New Construction for Social Services Staff also considered projects/scopes that would reduce the District?s ongoing general fund and operational costs. Three additional factors to be considered at all times in evaluating and ranking the project list are: 1) Energy costs; 2) Maintenance costs; and 3) Operating costs. The timeline for this detailed process was February 2011 through July 2011, and included review by the Facilities and Technology Committee at several meetings. Additionally, a sampling of proposed projects was discussed. On July 19, 2011, the Board approved the first 13 items totaling $16,978,500 in the priority order listed. The Board then individually ranked the remaining 12 items and gave staff direction to tally the results. On August 2, 2011, the Board approved the prioritized list of proposed additional projects to be funded from Measure B savings. On August 21, 2012, the Board approved the updated Measure B Savings list which allocates $3,190,789 for District-wide priority natural grass and irrigation repairs. At McKinley School on the north end of the front lawn, facing East 14th Street there has been a fenced in garden area. Over the years the area has been maintained or neglected depending upon the availability of staff and volunteers to take care of the space. In spite of enormous efforts on the part of the site principal and other staff or community members to try to keep the area at least cleaned up, it has been impossible to maintain the site. In fact, at numerous points in time, weeds have grown so high that they were deemed a potential fire hazard. At the February 20, 2013, the Facilities and Technology Committee staff recommended that the fence and old garden area be removed as it is both an eyesore and a potential hazard. The committee directed staff to look into other options for this area, specifically, increasing parking. Staff did so and found that doing so is cost prohibitive. At the March 6, 2013, Facilities and Technology Committee meeting, given the cost of parking spaces, staff recommended approval of the Lemke landscape contract, in the amount of $18,194, for landscape installation at McKinley Elementary School (see attached contract). Discussion took place regarding the concept of community gardens and it was agreed that the Superintendent would contact the Recreation and Parks Commissioner and a community member who had previously talked about the community garden concept to make them aware of staff recommendation for this space and this agenda item. This contract includes removing the fence, old planter boxes, shed, debris, and installing sod.

Quick Summary/Staff Recommendation
Approve the installation of a marquee at McKinley Elementary School and the contract agreement with Sign-a-Rama.
Board Committee
Facilities and Technology Committee: March 6, 2013
Background Information
McKinley Elementary School is currently the only elementary school in the San Leandro Unified School District without a marquee at the front of the school. The majority of the learning community, over 50% is Spanish speaking and they are a Title I school with lower socio-economic status, affecting the community?s ability to access technology and updated communication on the school?s website: www.mckinleyschool.net. The need for global communication free of charge is imperative; without computer access at home and the ?green? movement to provide parent bulletins electronically, parents may be limited in their ability to access school information. Without a marquee at McKinley School, aside from bi-weekly parent bulletins and Wednesday morning announcements made weekly and in person by Principal Situm, a marquee will now provide on-going information about: school wide events, report cards, parent meetings, holidays and important school information that the entire learning community needs in order to stay informed at all times. The proposed marquee is to be mounted at the front of the school with two mount posts, heavy duty aluminum extrusion frames, self-contained locks, acrylic polyurethane paint finishes and highly visible large black plastic letters, to be mounted inside marquee. The placement of the marquee will be adjacent to East 14th Street so foot and auto traffic can easily view written school information. The McKinley School eagle mascot will also be pictured on the marquee to personalize the sign and signify McKinley school spirit. The marquee will be a 4? x 6? ?post n panel? changeable letter sign. The overall height of the sign will be 7?. McKinley school was offered a 15% discounted price for a Title I status by Sign-a-rama. The District?s Maintenance department will be installing the sign once approval is obtained from the Board of Education. The Maintenance Manager will oversee the marquee's accurate placement and installation to support McKinley School. The cost for the marquee is $3,760.93 which includes tax and the 15% discount. The ELAC Committee approved the marquee and proposed to the School Site Council (SSC) that for effective communication to the second language families, that it be installed. The marquee expenditure was approved by the SSC on October 24, 2012. The proposed marquee will provide an important communication tool to the entire McKinley School learning community.
