The meeting was called to order at 9:45 a.m.  It was noted that all Board members were present with the exception of Trustee Carey.

The Board approved the Construction Agreement with West Bay Builders, Inc. for the Elementary School Playground Projects.  Trustee Carey was absent.

The cost of construction services is included in the approved Measure M project list.

Quick Summary/Staff Recommendation
Approve the construction agreement, in the amount of $3,189,000, with West Bay Builders, Inc. for the Elementary School Exterior Athletic projects.
Background Information

In November 2010, the voter passed Measure M Bond, which including exterior athletic improvements at all eight (8) elementary schools.

The District conducted a formal sealed bid opening process, per State of California Public Contract Code requirements.

On May 7, 2013, the Board approved the purchase and installation of the playstructures via a California Multiple Award Schedule (CMAS) contract.

On May 21, 2013, the District received six (6) bids for the Measure M Elementary School Exterior Athletic Playgrounds, per Public Contract Code requirements.  This bid includes the shade structures (outdoor classrooms), walking paths, playground asphalt repairs, playground markings/stripping, fall zone material, etc.

The lowest responsive, responsible bidder was West Bay Builders, Inc. in the amount of $3,189,000. The estimated construction budget for the site work was $4,029,217, the lowest responsive, responsible bid is <$840,217> under estimated budget.

The agreement has been reviewed by the District?s former legal counsel and the template has been used as the District standard through Measure M.
