Conduct an Official Public Hearing on the acceptance of the SB X3-4 categorical Tier III funds and use of funds for 2013-2014.
PUBLIC NOTICE
SBX3-4 Categorical Tier III Flexibility Acceptance
and Use of Funds for 2013-14
The Budget trailer bill (SBX3 4) gives local school agencies the authority to use the funds received from the state for Tier III programs for ?any educational purpose, to the extent permitted by federal law?. These local education agencies are allowed to transfer funds from categorical programs to the Unrestricted General Fund for any educational purposes. The original language in SBX 3 4 allows Tier III categorical flexibility from 2008-09 through 2012-13. However, on March 11, 2011, the Governor signed into law Senate Bill (SB) 70 extending all existing flexibility options by two additional years, thus, Tier III categorical flexibility will be effective through 2014-15.
Assembly Bill (AB) 189 (Chapter 606/2011) was approved by Governor Brown on October 8, 2011, and became effective January 1, 2012. This law changed the public hearing requirement regarding the use of the Tier III funds by amending Education Code section 42605 as follows:
- As a condition of receiving funds for Tier III categorical programs, the governing board of a school district must hold a public hearing to discuss, approve or disapprove the proposed use of funding, and make explicit for each of the Tier III programs the purposes for which the funds will be used.
- The Tier III public hearing must be held at a regularly scheduled board meeting prior to and independent of the meeting at which the annual budget will be adopted.
- If the governing board intends to close any Tier III program, the governing board shall identify, in the notice of the agenda of the public hearing or at another public hearing, the program or programs proposed to be closed.
Since the funds under Tier III are unrestricted, program or funding requirements, as otherwise provided in statute, regulation, and budget act provisional language associated with the funding, are not in effect.
Attached is a listing of Tier III Funds for 2013-2014 showing the maximum flexibility allowed under Tier III. However, there is additional information on the spreadsheet. It delineates restrictions on certain or part of funds and these local restrictions are considered ?sweeps? on the funds.
Also included in the Board packet are projected Tier III Flexibility programs for 2014-15. For multi-year projection purposes, this chart is to be shown as the projected amounts included in 2014-15. When actual adoption budget happens in 2014-15, Tier III projections will need to be updated and included as part of the adoption at that time.
A public hearing on the SBX3-4 Categorical Tier III Flexibility Acceptance and Use of Funds for 2013-14, will be held on Tuesday, June 4, 2013, at 7:00 p.m. in the San Leandro City Council Chambers located at 835 E 14th Street, San Leandro, CA. |

Prior to the Board taking action on SBX3-4 Categorical Tier III Flexibility Acceptance and Use of Funds for 2013-2014, Assistant Superintendent of Business & Operations Song Chin-Bendib provided a brief update of the May Revise:
- If it is Revenue Limit Model:
- Estimated increases of revenue for SLUSD - $1.4M
- If it is LCFF:
- Estimated base grant and concentration grants - $2.5M
- Uncertainties
- Legislative Democrats and Governor Brown differ in a number of key areas
- Do NOT know whether Revenue Limit OR LCFF will be the State approved funding model
- School Services of California (SSC) advised school districts to apply Revenue Limit model for 2013-14; for budget adoption only and NOT for negotiations
- If it is LCFF, how much of the Base Grant money is flexible?
- SSC cannot confirm at this point if Base Grant is flexible (Maintenance of Efforts (MOE) Language) per Governor's proposed budget language
- Supplemental and concentration grant funds only on those students generating the funds
PUBLIC COMMENT
- Madison Elementary School Principal Garry Grotke addressed the Board regarding keeping the base amount balanced between the sites on other funds, noting that Madison has been the least funded per pupil school since he has been the Principal.

| Approve the Memorandum of Understanding Between San Leandro Unified School District and Playworks at Garfield Elementary School for the 2013-2014 School Year |
Garfield Elementary School is proposing to utilize the Playworks Program to continue to support their efforts to build and maintain a safe environment that supports optimal learning in school. The Playworks Program has been successfully implemented at Garfield for the past two years. The Playworks Program has four key components to promote healthy physical activity enrichment experiences:
- Organizing structured opportunities for play and physical activity during recess
- Coordinating class game time ? students and teachers learn the expectations, best practices and skills of games and physical activities
- Coordinating the 4th & 5th Grade Junior Coach Leadership Training Program ? establishes student leaders to maintain playground equipment and lead peers and younger students in recess games and activities
- Providing a before school physical activity program
- Providing opportunities for league games outside of the school day
As students learn to make better choices, this has proven to decrease disciplinary issues during lunch and recess time. Students spend less time in the office dealing with negative interactions and spend more time in the classroom learning. The coordinated and integrated activities designed by Playworks will lead to increased student motivation and satisfaction with schooling. This program complements, not replaces, the physical education program and promotes lifelong healthy habits.
Garfield would like to utilize the Playworks Program for before school, recess, and lunch recess. Playworks will also provide voluntary game league opportunities for grades 4-5 students outside of the school day. Playworks provides Garfield with one program coordinator. Playworks also provides funding for the program implementation. This MOU is the District's program portion. We are extremely grateful and fortunate to have SLED assist Garfield with a substantial portion of the funding required by the school.
Refer to the MOU for additional information.

| Approve the contracted services agreement with Bert Padua to fill in for the vacant Director of Fiscal Services position. |
| The Accounting Manager of the Business Services Department has been vacant since April 30, 2013. Since then a retiree, Bert Padua has been hired, to fill in while the department was looking for a replacement. Bert Padua is the former Director IV of Business Services of the Alameda County Office of Education (ACOE). Mr. Padua has extensive hands-on experience working in the fiscal department and has the skills necessary to provide the type of support that the Department needs.
The Department has found a replacement for the Accounting Manager position and if the person is approved by the Board, he will officially start on June 17, 2013. In the meantime, the Director of Fiscal Services has resigned effective June 3, 2013.
Staff recommends that Mr. Padua step in to the role of the fiscal director position while we seek for a permanent replacement. Mr. Padua?s rate is $50 per hour as the accounting manager but will be $10 more per hour at $60/hour filling in for the fiscal director position, at no more than 8 hours per day although Mr. Padua has put in more than eight hours a day.
This agreement will be on an as-needed basis up through September 30, 2013, to allow time for the Department to look for a qualified fiscal director.
Mr. Padua will oversee the daily operations of the business department including but not limited to payroll, accounts payable, general ledger and other necessary financial analyses. |

| Approve the Letter of Understanding between Alameda County Social Services Agency and San Leandro Unified School District for direct certification of students to receive free and reduced-price meals for fiscal year 2013-2014. |
| The purpose of this letter of understanding between Alameda County Social Services Agency (SSA) and San Leandro Unified School District (SLUSD) is to carry out the provisions of the U.S. Federal Child Nutrition and WIC Reauthorization Act of 1989, Section 202(b)(1). This act allows a school food authority to certify a student as eligible for free school lunch or breakfast without further application, by directly communicating with the appropriate local agency to obtain documentation of a student status as a member of a CalWORKs and/or Food Stamps.
This letter of understanding expresses the mutual intent between SSA and SLUSD and establishes the requirements for matching data from SLUSD records and SSA records for Direct Certification of students to receive free or reduced-price meals. The intent is to meet the program goals of the two agencies while maintaining record confidentiality.
SLUSD will not be charged for this service and there may be a possible increase in the number of Free and Reduced students and Federal and State reimbursements. |

| Approve the State of California Department of Resources Recycling and Recovery (CalRecycle) Tire-Derived Grant agreement for an amount not to exceed $150,000, in reimbursed costs for installing the resilient surfacing at all elementary schools, funded through Measure M. |
| Facilities & Technology: January 9, 2013 |
| In November 2010, San Leandro voters passed Measure M, a $50.1 million school facilities bond to address modernization and new construction throughout the District, including the renovation of the Pacific Sports Complex and Burrell Field, renovation of the San Leandro High School Swim Center, a new track and field at John Muir Middle School and various other projects at all school sites throughout the District, including renovations and upgrades of all elementary school athletic exteriors (i.e. playgrounds).
In order to design facilities that will best serve the needs of our students, schools and the community, the District is aggressively pursuing grant funding opportunities to offset costs and/or enhance scope of work. The State of California Department of Resources Recycling and Recovery (CalRecycle) administers various grant programs, including the Tire-Derived Product Grants, which is a reimbursement grant.
On January 15, 2013, the Board approved the resolution authorizing submittal of application(s) to CalRecycle for all grants for which the District is eligible, and empowering the Superintendent or her designee to execute all grant documents necessary to secure grant funds and implement any approved grant project.
On April 17, 2013, CalRecycle approved funding the project for a total amount not to exceed $150,000, in reimbursed costs for installing the resilient surfacing at all elementary schools, funded through Measure M. The next step is to complete the Grant Agreement which needs to be executed no later than June 17, 2013, in order to meet the requirements of the grant. The Grant Agreement is attached. Upon execution of the Grant Agreement by both parties, CalRecycle will email the Notice to Proceed with a copy of the executed Grant agreement. |

| Approve the agreement with Community Development Institute Head Start. |
| The District provides Head Start programs at three schools: Jefferson, Madison and Broadmoor Preschool. These programs have been offered for decades.
On May 17, 2013, the District was notified by the Community Development Institute Head Start (CDIHS) program, that they had been designated by the Office of Head Start as the interim manager for the Head Start/Early Head Start programs serving Southern Alameda County. The previous grantee Child, Family and Community Services (CFCS), Inc. has had their funding suspended and they are no longer considered the federal grantee. CFCS is working cooperatively with the Office of Head Start to reach a resolution of the issues that have been identified.
Both organizations are working together to ensure that the transition is as seamless as possible to the students and families served by the program. The CFCS teachers have been hired by CDIHS to ensure this seamless transition.
CDIHS is in the process of reviewing the lease agreement that the district had with the previous grantee (CFCS) and will be contacting the district to address the terms of an ongoing lease agreement. The previous agreement with CFCS was for $1.00 per year.
CDIHS has submitted the attached good faith letter as a commitment to continue to operate the local Head Start/Early Head Start program until a permanent local grantee is selected by the Office of Head Start.
Staff is recommending that the Board of Education approve this temporary agreement with CDIHS.

| Approve Amendment #7 for $351,960 to the design services contract with AEDIS Architects to add 2014 Measure B savings projects. |
| Facilities and Technology Committee: May 28, 2013 |
The Board of Education previously approved AEDIS Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond. The original Contract was entered into on September 6, 2007, between AEDIS Architects and San Leandro Unified School District to provide architectural design services for painting and lighting modernization at San Leandro High School (SLHS), McKinley, Roosevelt, and Washington Elementary Schools.
Subsequently, the Board approved:
- Amendment #1, in the amount of $470,654, on November 6, 2007, which added modernization at Bancroft Middle School to the scope of the contract.
- Amendment #2, in the amount of $121,532, on December 14, 2010, which added classroom painting and lighting upgrades at Garfield and Monroe Elementary Schools.
- Amendment #3, in the amount of $18,810, on January 24, 2012, which added classroom painting and lighting upgrades at Washington Elementary School to Include Buildings C & E.
- Amendment #4, in the amount of $389,562, on August 7, 2012, provides architectural design services for window, skylight, seismic and exterior door repair and or replacement at San Leandro High School as well as the replacement of portable classrooms in building C and E at Washington Elementary School.
- Amendment #5, in the amount of $29,000, on December 11, 2012, for professional design services to install modular classroom buildings at Washington Elementary School instead of portables, as originally designed.
- Amendment #6, in the amount of $4,400, provided architectural design services for engineering calculations for skylights at San Leandro High School in order to prepare and allow for production before the installation during the summer timeframe.
In August of 2012, the Board approved the creation of additional Measure B projects from funding generated through savings.
This proposed Amendment #7, in the amount of $351,960 is for additional Measure B savings modernization and voluntary seismic upgrade projects in 2014. The estimated construction costs at six school sites is $2,425,000, and the architectural fee represents approximately 14.5% compared to estimated construction costs. This is within the normal expected range of 12% to 17% for this scope of work.
The sites include Garfield ES (no seismic work), McKinley ES, Monroe ES, Roosevelt ES (no seismic work), Bancroft MS and Washington ES.

| Replace the existing CMAS agreement, with the revised final version in the amount of $921,846 with Landscape Structures, Inc. for the Elementary School Exterior Athletic project play structures. |
| Facilities and Technology Committees: April 24, 2013, and May 28, 2013. |
As part of the Elementary School Athletic Exteriors project, funded through Measure M, the school facilities bond passed in 2010, all elementary schools will receive new play structures for their playgrounds. The original project called for the repair of the old and deteriorating playground equipment, but staff determined that it was more cost effective to replace all play structures with new play structures. This will standardize play structures across the District, with new structures under warranty and having a longer useful life.
The equipment that the District, in consultation with the elementary schools? site administration, wishes to obtain is included in a current California Multiple Award Schedule (CMAS) which the District can access. The CMAS program obtains guaranteed pricing on services and products that government entities need to acquire on a regular basis. The program allows for government entities to purchase directly off of the award schedule without having to incur the time and expense of completing a formal bid process.
On May 7, 2013, the Board approved the CMAS contract for elementary school play structures to be purchased from Landscape Structures, Inc., in the amount of $894,995.75.
Subsequently, the contract form was provided to the vendor for review, and the vendor had issues with some of the Article 16 indemnification language and the inclusion of bonds. The negotiations continued between the District?s team (the program manager, legal counsel and the construction manager) and the vendor to get minor revisions to the indemnification language and 100% Payment and Performance bonds included at a revised total of $921,845.75, an increase of $26,850.
District legal counsel has reviewed and approved the changes.
The CMAS contract for the playground equipment the District intends to use is #4-10-78-0057A. A quote from the vendor for the playground equipment is attached. A purchase order in the amount of $921,894.75 will be issued directly to the vendor. This purchase will be funded through Measure M, the local school facilities bond.
The District received a 10% discount off CMAS pricing and an additional $6k discount for participating in a contest at Madison ES.
The procurement method and contract form have been reviewed by District legal counsel and meet all Public Contract Code requirements.

PUBLIC COMMENT
- Garry Grotke, Madison Elementary School Principal, addressed the Board regarding increases in title and compensation for two administrators being considered tonight, stating that he felt everyone has worked very hard during these very difficult times and is deserving of appropriate increases. These are still uncertain times, and as we enter into a era of new leadership, Mr. Grotke urged that Board to make these compensations later, and if we are not restoring programs and personnel on an even basis, it's seems inappropriate to make compensation at this level. There is time for pay raises and compensation as the budget becomes more in clear in September and beyond.
Trustee Prola clarified that upon approval of the changes to both employee agreements, the Assistant Superintendent of Business and Operations and the Senior Director II, Human Resources, will be donating back the net amount of the salary increase and the fiscal impact to the District is cost neutral for 2013-2014 except for employee paid statutory costs.
Following the clarification, the Board approved the Revised Salary Schedule (to include the Associate Superintendent salary range) and approved the changes to the Employment Agreement between the San Leandro Unified School District and the Assistant Superintendent, Business and Operations. |

Trustee Toro attended the Adult School Graduation, commenting that it was an impressive ceremony honoring these students who have worked very hard, noting that the keynote speaker also shared his amazing story.
Trustee Rosato attended the CTE California Education Conference in Los Angeles last Saturday as a state delegate. They discussed many of the details of the Governor's proposed budget, and positions, policies and legislation regarding teacher discipline as we prepare for the National Education Association representative assembly in Atlanta. He also said that he brought back "Celebrate Pride Month" stickers, inviting anyone interested to pick one up at the conclusion of the meeting.
Trustee Katz-Lacabe hoped the concert last week performed by the Jefferson and Roosevelt Elementary School choirs, the Notables and high school choir becomes a tradition and that more schools will participate. In addition, he noted that due to cuts made, there is not an instrumental program at the middle schools, preventing elementary students flowing into a middle school program; similarly, he thought that choir was not offered at the middle school level. Trustee Katz-Lacabe asked for and received consensus to have the Superintendent look into what would need to be done to provide those students, who are interested in instrumental music and choir, a continuous flow from elementary, to middle, and then high school. He also announced that Eat Out for Education is tomorrow night, and Drakes fundraiser will be this Friday night.
Trustee James attended the Adult School graduation, which he felt demonstrated how important and necessary the Adult School is to our community and "what bridges and future it provides and builds for people." Trustee James reminded everyone that he will be out of town for the June 18 Board meeting and the 1st meeting in July. Responding to concerns raised by the community and employee groups this evening, he reassured them that "You are being heard, you are listened to, and the Board understands."
Trustee Carey attended the Adult School Graduation, acknowledging the students for their perseverance. While he will not be able to attend the Pride Parade this year in San Francisco on June 30, he hoped that some the Board members would have an opportunity to do so, noting that when he participated two years ago, he found it to be a very rewarding experience.
Student Board member Feliciano thanked the Board for giving her the privilege to be part of the School Board. "It has been a great year, and maybe in the future, I will be sitting where you are."
Trustee Prola commented that the she was happy that the Superintendent Search has been completed, and thanked the Board for their approach to the process. She also attended the Adult School Graduation, commenting that it was the largest graduating class (128 students) commending them for their success. She also attended Jefferson Elementary School's first Opera! Students in five different classes have been working with the San Francisco Opera all year. The students wrote a libretto, composed music, rehearsed their own opera and made their own set designs, costumes, and props, noting that they did a dynamic job. Students were also given an opportunity to go to San Francisco and see an opera. In addition, the second grade class also entertained the audience with a song related to their study about fish and anti-bullying. |
