The presentation concluded with a discussion in response to the data by Mike Walbridge, Director of Curriculum and Instruction, addressing some of the ways the District would be responding to the disappointing test results and discussing the data in a statewide context.

Comments regarding the data raised by the Board included:

  • Concerned about the level of proficiency - less than half of our students are proficient or advanced
  • What do these results say about Tierred Intervention - if Tierred Intervention were succeeding, I would expect to see better results by now
  • How are we going to be ready for Common Core?
  • Give the teachers the professional help they need to bring them "up to speed"
  • We need to educate the parents regarding Common Core
  • Appreciated all the hard work compiling the data; however, it's time to look at what we've done and if it hasn't worked we need to get back to kind of school that kids want to be in and achieve

Superintendent McLaughlin noted that if we don't raise the bar, we won't expect the best and we will never achieve it, adding that "Common Core brings us new opportunities, not to do what we're doing, but to change and do something different."

Fiscal Impact
None; each contract will be funded based on its budget source requested.
TO:
Mike McLaughlin, Ed.D., Superintendent

Quick Summary/Staff Recommendation
Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2013-2014.
Background Information
Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Associate Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?.? Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012. Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. Detailed contract information or cover pages will not be part of subsequent Board Packets, but will be available for questions or inspection upon request.?

10.7. EPA Expenditure Summary
TO:
Mike McLaughlin, Ed.D., Superintendent

Quick Summary/Staff Recommendation
Approve actual expenditures from the Education Protection Account (EPA) for 2012-13 and proposed expenditures for 2013-14
Policy/Code
Proposition 30; Article XIII, Section 36 of the California Constitution
Background Information

The voters of California approved Proposition 30 on November 6, 2012 and pursuant to Article XIII, Section 36 of the California Constitution, effective November 7, 2012, it is required to create in the state General Fund an Education Protection Account (EPA) to receive and disburse the revenues derived from the incremental increases in taxes imposed by Article XIII, Section 36(f);

School districts are required to determine how the money received from the Education Protection Account (EPA) will be spent in the schools within its jurisdiction, provided that the governing board makes the spending determinations in an open session of a public meeting.  The language in the constitutional amendment requires that funds shall not be used for the salaries and benefits of administrators or any other administrative costs.

Attached is an excel spreadsheet that shows that the funds from the EPA has been used to pay for teacher salaries. By reporting the actual expenditures for 2012-13 and proposed expenditures for 2013-14, the District would have met the requirement of EPA.

The EPA funds are not new money but only cash deferred by the state of California.

Fiscal Impact
None. The project is funded by Savings from the Measure B Local Bond funds, contract not to exceed $2,540,400.
TO:
Mike McLaughlin, Ed.D., Superintendent

Quick Summary/Staff Recommendation
Approve Change Order #1, to the Construction Contract with BHM Construction, Inc., to change contract language to allow for night and weekend work, with no change to the original contract amount not to exceed $2,540,400, for the San Leandro High School Modernization project to replace windows and skylights.
Board Committee
Facilities and Technology Committee: August 7, 2013
Background Information

One of the Measure B Savings priority projects approved by the San Leandro Board of Education is windows and skylights replacements at San Leandro High School. In order to allow the contractor more time to order and fabricate the windows and skylights so that they could be installed at San Leandro High School during the 2013 summer, the Board of Education, at the April 16, 2013, Board meeting, approved a special one-time Delegation of Authority to award a construction contract after the bid review by the Facilities and Technology (F&T) Committee at its April 24, 2013, meeting.

As permitted by and in accordance with the California Public Contract Code and California Education Code, the special one-time Delegation of Authority gives the Superintendent, or his or her designee, a period of 60 days to evaluate, award and execute a Facilities Contract, described as a Contract for Construction, for an amount up to $3,000,000, for San Leandro Unified School District Bid #13-05 San Leandro High School Modernization project.

The lowest responsive, responsible bidder was BHM Construction, Inc., in the amount of $2,540,400, with the construction contract approved by the Board of Education on May 7, 2013.

This Change Order #1, does not change the amount of the original contract, but changes the contract specified non work period of 8/22/12 through 9/15/13, to allow for night and weekend work in order to complete the work this year, and not having to work during next summer (2014), which is a benefit to both owner and contractor.

Background Information

The Board of Education previously approved AEDIS Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond.  The original Contract was entered into on September 6, 2007, between AEDIS Architects and San Leandro Unified School District to provide architectural design services for painting and lighting modernization at San Leandro High School (SLHS), McKinley, Roosevelt, and Washington Elementary Schools.

Subsequently, the Board approved:

  • Amendment #1, in the amount of $470,654, on  November 6, 2007, which added modernization at Bancroft Middle School to the scope of the contract.
  • Amendment #2, in the amount of $121,532, on December 14, 2010, which added classroom painting and lighting upgrades at Garfield and Monroe Elementary Schools.
  • Amendment #3, in the amount of $18,810, on January 24, 2012, which added classroom painting and lighting upgrades at Washington Elementary School to Include Buildings C & E.
  • Amendment #4, in the amount of $389,562, on August 7, 2012, provides architectural design services for window, skylight, seismic and exterior door repair and or replacement at San Leandro High School as well as the replacement of portable classrooms in building C and E at Washington Elementary School.
  • Amendment #5, in the amount of $29,000, on December 11, 2012, for professional design services to install modular classroom buildings at Washington Elementary School instead of portables, as originally designed.
  • Amendment #6, in the amount of $4,400, provided architectural design services for engineering calculations for skylights at San Leandro High School in order to prepare and allow for production before the installation during the summer timeframe.
  • Amendment #7, in the amount of $351,960, was approved on June 4, 2013, and was for additional Measure B savings modernization and voluntary seismic upgrade projects in 2014.  In August of 2012, the Board approved the creation of additional Measure B projects from funding generated through savings. The sites include Garfield ES (no seismic work), McKinley ES, Monroe ES, Roosevelt ES (no seismic work), Bancroft MS and Washington ES.

This proposed Amendment #8 in the amount of $102,343 is for additional seismic upgrades at Garfield ES (Davis Street Bldg), Roosevelt ES (Broodmore Child Care Bldg and the Farrelly Pool Bldg), and additional scope at Roosevelt ES (Floor drains, roofing) and Bancroft MS (Chairlifts, stair noising, roofing, mechanical access).

10.24. Board Resolution for San Leandro Adult School to Apply for 2015 - 2016 Planning and Implementation Grant from the California Department of Education and the Chancellor of California Community Colleges
TO:
Mike McLaughlin, Ed. D., Superintendent

Quick Summary/Staff Recommendation
Approve the Board Resolution allowing San Leandro Adult School to begin the implementation and planning process required for the 2015-2016 grant funds.
Background Information

Pursuant to the provisions in AB86 that went into effect July 1, 2013, the California Department of Education and the Chancellor of California Community Colleges are assigned the responsibility of providing and monitoring $25,000,000 in planning and implementation grants for adult school/community college consortiums that will go into effect in 2015-2016.

School boards must grant permission for adult schools to begin the planning process and begin a dialogue with their local community college.  The adult school and local community college must apply jointly for the available funding.  Either party may be the fiscal agent, and it is to be determined during the planning process.  These funds are to be used for planning and implementing a consortium combined of at least one community college and one adult school.  The consortium will have two years to create a partnership between the community college and the adult school to become effective 2015-2016.  Each consortium is eligible to apply for part of the $25,000,000 planning and implementation grant.

Only the newly developed consortiums, as outlined above, will be eligible to apply for a portion of the $500,000,000 in funding available to adult schools in 2015-2016.

There could be funds from the planning and implementing grant.

12.1. Approve New Swimming Pool Fees for Fiscal Year 2013-14
TO:
Mike McLaughlin, Ed.D., Superintendent

Minutes:

PUBLIC COMMENT

Community members Susan Leiger, Andrea Sitchon, Daryl Frances, and Rich Fishbaugh addressed the Board regarding the proposed New Swimming Pool Fees for Fiscal Year 2013-14, including the fees to be paid by the San Leandro Swim Team, (a.k.a. "Drowning Darryls). Several of them commented about the longstanding relationship between the Darryls and the District, first in keeping the old pool in operating order, and then in supporting Measure M in order to see the new swim center built. They urged the Board to consider keeping the fees comparable to what they were in the past years.

The Board members spoke of the importance of revisiting the proposed fee schedule for all the reasons named, and more, and then voted to table the item, referring it back to staff to work in partnership with the Darryls on the schedule before taking it back to the Facilities & Technology Committee for further discussion.

Quick Summary/Staff Recommendation
Approve New Swimming Pool Fees for Fiscal Year 2013-14, including the fees to be paid by the San Leandro Swim Team (a.k.a. Drowning Darryls).
Background Information

One of the major marquee projects identified in the Measure M language is the San Leandro High School Swim Center and Fields project. The District retained WLC Architects, Inc. to design and prepare all the design and construction documents.

Construction for the San Leandro High School (SLHS) Swim Center started in the summer of 2012 and is scheduled to be completed in September 2013. Prior to the modernization of the swim center, the SLHS  pools (competition and wading pools) were primarily used by the SLHS swim teams and when the pools were not in use, by the San Leandro Swim Team, a.k.a. ?Drowning Darryls?. The District charged a fee to the San Leandro Swim Team (for the use of the High School pools. In 2010-12, the fee charged was $5,873.

Prior to the modernization of the pools, in order to pass the Alameda County Health inspection certification, the District has had to maintain the old swimming pools with restricted resources. For years as part of the maintenance and upkeep of the pools, the San Leandro Swim Team has contributed financially to the District to partially support the repair of the pools (and were very active in working on Bond Measure M).

In preparing for the scheduled opening of the new and modernized pools, staff has researched and gathered cost data to provide for the maintenance of the new pools. Obviously, due to the size of the pools and new code requirements, a severalfold increase is estimated to maintain the cost of the pools.

Staff has also researched and gathered data from surrounding school districts and agencies on what they charge for the use of their swimming pools.

Attached is a summary of the ?Swimming Pool Fees Comparison?. For information purposes, staff has also attached an estimated cost of running the new pools.

Instead of the traditional fee of $5,873 paid by the San Leandro Swim Team, the following is listed as a proposal and to be discussed:

  • Pay $45 per hour for the daily use of the pools
  • Pay $20 per hour for the attendant(s)
  • Daily use of 2 hours
  • Saturdays are for meets only
  • Fees for meets are to be discussed
  • Swim season is from April through end of July each year

These rates are comparable to the fees charged by the surrounding districts and agencies.

Board Committee
August 7, 2013, Facilities and Technology Committee
Background Information

The two most current bond measures approved by the San Leandro voters are Measure B (November 2006) and Measure M (November 2010). Once bond issuance proceeds are received the District is responsible for spending the funds on projects that comply with the bond measure ballot language.  Initial savings generated by the projects early in the program must be used to create and build projects that comply with the bond measure language and expended on the same timeline associated with the bond issuances.

To date, the bond program savings have been generated by a combination of factors, and they are 1) Additional funding from Federal, State and non-bond Local sources 2) Sustained flat and/or deflationary pricing in the construction market, and 3) Highly efficient management.

The Phase I savings is estimated to be $27M while Phase II at $6.2M. The District has about $220M of unfunded needs not addressed by either Measure B or M bonds.

When the District started the discussion regarding savings with the Board nearly two years ago, not all the potential savings projects were created then. It was a work in progress with the intention to continuously address the most critical needs in the District. Additionally, the District?s prioritization of needs evolve over-time and the Board would like to reserve flexibility to address those needs.

In order to identify new projects priorities, staff utilized the SLUSD Board Approved District Wide Master Plan (1997/2003) filtering criteria:

Priority 1 ? Health, Safety and Legal

Priority 2 ? Building Shell Integrity

Priority 3 _ Infrastructure and Utilities

Priority 4 ? Classroom /Interior Renovations

Priority 5 ? Renovation/New Construction for Education Programs

Priority 6 ? Support Spaces for Educational Programs

Priority 7 ? Outdoor Spaces

Priority 8 ? Athletic Programs Support Facilities

Priority 9 ? Renovation/New Construction for Social Services

Phase I Measure B savings: $27M

With flexibility to continuously address District?s unfunded facility needs in mind, the Board on July 19, 2011, approved $16,978,500 in projects to be funded through Measure B Phase I Savings.  Subsequently, on August 2, 2011, the Board approved a prioritized list of additional projects to be funded, bringing the Measure B Savings Phase I total to $25,197,900.  This final list was approved on August 21, 2012, by the Board.

Phase II Measure B savings: $6.2M

Phase II Measure B savings list was approved by the Board on May 21, 2013. The District has started processing contract amendments to the architects and project manager with the goal to have drawings to the Division of State Architect (DSA) by October 31, 2013, and project completion timeline in 2014. This phase is taking longer than expected because of summer project workload and logistical challenges.

The priorities included in the Phase II savings list are as follows:

  1. Seismic retrofits of district facilities
  2. Adult School Modular building (One and a half modular building units)
  3. Facility improvements that could improve safety and security
  4. High priority deferred maintenance needs
  5. Technology needs to get all schools up to a District standard.

The priorities were consistent with the priorities outlined in the 1997 District-wide Facilities Master Plan. Additionally, three factors were considered by the Board in evaluating and ranking the project list and they are 1) Energy costs; 2) Maintenance costs; and 3) Operating costs. The primary goal is to reduce the District?s ongoing general fund and operational costs.

The proposed list of projects was compiled based on input from the following sources:

  • District Wide Master Plan
  • District Maintenance Department
  • School Site and District Office Administrators
  • Bond Director
  • Program Manager

There were not a lot of updates from the May 21 report to the Board with the exception of:

  1. Science classroom sinks were installed at John Muir Middle School and the cost was approved to be paid out of Phase II Savings
  2. Chart # 4 Potential facility improvements with items # 2 to # 9 shown as work is needed but no funding yet.

He is also looking forward to welcoming Student Board member, Ellie Erickson, to her first Board meeting on September 4. Trustee Rosato shared a Child's Safety Kit that he was given at the "National Night Out" celebration on August 6, stating that the kit is free and parents can keep pertinent information about their child in case of an emergency.

Trustee L?pez attended the 35th Anniversary of the State Hispanic Chamber of Commerce Convention at the Oakland Marriott City Center where she had the pleasure of speaking with Sheila E who was one of the guest speakers.

Trustee Katz-Lacabe commented that school starts tomorrow, and he "looking forward to it."

Trustee James attended Common Core Writing last week, adding that he would like to suggest that instead of seeking outside consultants for training, the District "look within", such as Hayward Unified has been doing for a few years, noting that the San Leandro Unified has qualified professionals who could provide the training. Trustee James also suggested that in the future, the District try not to schedule ribbon cuttings at 3:00 p.m., which makes it difficult for those working outside the City to attend.

Trustee Carey commented that he will be attending the ribbon cutting ceremony for the Pacific Sports Complex and Burrell Field.  He welcomed the the new Assistant Superintendent, Dr. Rosanna Mucetti and is looking forward working with her.

Trustee Toro commented that he is also very excited about this school year, adding that we have a solid team with a lot of momentum to move forward.

Trustee Prola commented that there will be Scholarship Foundation Fundraiser at Drakes on August 30. The Building Futures with Women and Children is collecting new school supplies for homeless children.  She also announced that the San Leandro Sports Foundation is planning a City-wide family track meet in the spring 2014 at Burrell Field. Trustee Prola also reported that she learned that a $4M health and wellness 4-year grant may be available for the schools through Kaiser.  She also attended the Mulford Gardens Neighborhood picnic on Sunday where she responded to questions about the new playground equipment at the elementary schools, stating that the project was funded through Measure M.  Trustee Prola reported on the recent active shooter training at San Leandro High School, adding that she spoke to a member of the Brady handgun safety group and was told that the group is interested in distributing a flyer at the schools that focuses on handgun safety at home such as storing guns when children are around.  She will pass the flyer on to the Superintendent as soon as she receives a copy.
