7. PRESENTATIONS
7.1. Budget Update
Minutes:

Associate Superintendent of Business and Operations, Song Chin-Bendib, provided a brief presentation to the Board regarding highlights of the Governor?s budget revisions and the impact of those on the San Leandro Unified School District budget.

The Governor signed the 2014-15 State Budget on June 20, 2014. Subsequently, on June 24, 2014, the school Board of Education adopted the San Leandro Unified School  District 2014-15 budget. However the Governor?s June 20 State Budget came in with some last minute revisions that would impact a school district?s budget. Pursuant to Education Code 42127(i)94), the District has up to 45 days after the Governor signs the annual Budget Act to make available for public review any revisions in revenues and expenditures that it has made to its budget to reflect the funding made available by the Budget Act.

Some key points the Associate Superintendent made during her 45 Day Budget Update presentation included major Proposition 98 changes:

  • The Legislative Analyst Office (LAO)'s 2014-2015 General Fund revenue forecast is $2.2 billion higher than the Department of Finance (DOF)'s; but the Governor ultimately prevailed in negotiations with the Legislature, and the State Budget is based on the lower DOF forecast
    • K-14 education could receive an additional $880 million if the LAO's forecast proves correct
  • The level of the Proposition 98 guarantee in the enacted State Budget is the same as proposed in the Governor's May Revision
  • The Legislature increased 2014-15 spending above the May Revision by reducing funding of the buy back of apportionment deferrals
  • Major Proposition 98 spending changes from the May Revision include:
    • LCFF - $250 million above the May Revision, bringing total new funding to $4.75 billion
    • K-12 mandate reimbursements - $400.5 million to one-time fund to pay prior year mandate claims
    • Career Technical Education Pathways Program - $250 million in one-time funds to support a second cohort of competitive grants to K-12 and community college local educational agencies (LEA)

Associate Superintendent Chin-Bendib also went over the "Rainy Day Fund", or the agreement to place Proposition 44 before the voters to amend the existing Budget Stabilization Account (BSA) enacted by Proposition 58 under Governor Schwarzenegger which would reduce annual contributions to the Fund from 3% to 1.5% of General Fund revenues, limit the fund to 10% of General Fund revenue; require 50% of contributions to the Fund to be used to repay prior years' obligations, and require legislation to suspend contributions to the Fund. In addition to amending the state-level Rainy Day Reserve, Proposition 44 would establish a Proposition 98 Reserve (officially called the Public School System Stabilization Account) effective beginning 2015-16.

The Board thanked Associate Superintendent Chin-Bendib for her presentation and ask follow-up questions that were addressed by staff.

Quick Summary/Staff Recommendation

The Governor signed the 2014-15 State Budget on June 20, 2014. Subsequently, on June 24, 2014, the school Board of Education adopted the San Leandro Unified School District 2014-15 budget. However the Governor?s June 20 State Budget came in with some last minute revisions that would impact a school district?s budget.

Pursuant to Education Code 42127(i)94), not later than 45 days after the Governor signs the annual Budget Act, the school district shall make available for public review any revisions in revenues and expenditures that it has made to its budget to reflect the funding made available by the Budget Act.

Associate Superintendent of Business and Operations, Song Chin-Bendib, will provide a brief presentation to the Board regarding highlights of the Governor?s budget revisions and the impact of those on the San Leandro USD budget. The presentation will include any other relevant fiscal information.

Background Information
Over the past ten years, the hourly rates for adult school teachers only been increased once: 7% six years ago. As a result, the San Leandro Adult School teacher hourly rates have not remained competitive with most districts in Alameda County. We are losing teachers who have been with us for over ten years because other districts? adult school starting hourly rates have risen in some cases to over $40.00 an hour. The county hourly pay rate averages are $34.56 for the entry level rate and $40.63 for top of the hourly salary schedule rate. The San Leandro Adult School hourly rates are $31.04 and $32.93, respectively. Hayward and Fremont start their hourly teachers at over $41.00 an hour. Staff recommends that the board approve a 10% increase to the hourly rates for adult school teachers to become effective September 1, 2014. This would increase the beginning level adult school rate to $34.13 and the top end rate to $36.22. The San Leandro Adult School will fund the raise from its federal Workforce Investment Act, Title II (WIA) funds. For the past nine years, the WIA funds have gone up every year and are projected to continue to increase each future year. Last year, the WIA funds were $545,000; for the new year they are $633,000.

Background Information
Imagine Learning provides strategic first-language support in 15 languages and English Language Development to facilitate and enhance English Learner language acquisition as a means to increasing both language proficiency and academic achievement. As students become more proficient in English, this language support gradually fades, preparing students for English-only academic environments and overall improved success in school. This contract is for 245 licenses and includes training for up to 45 teachers over two sessions. Mckinley served as a pilot for Imagine Learning with their EL proficiency levels 1 and 2 during the 2013-2014 academic year. The district is now conducting its first phase of more district wide implementation of Imagine Learning at other sites with EL proficiency levels 1 and 2 in order to enhance the curriculum and tools used with our early English Learners within their instructional programs.

10. INFORMATION ITEMS
10.1. Williams Uniform Complaint Procedures (including Valenzuela Settlement Requirement) Quarterly Report: April-June 2014
TO:
Mike McLaughlin, Ed.D., Superintendent

Minutes:

The Board received for information the Williams Uniform Complaint Procedures (including Valenzuela Settlement Requirement) Quarterly Report: April-June 2014. Trustees Lopez and Prola absent.

Staff Recommendation
Receive for information the Williams Uniform Complaint Procedures (including Valenzuela Settlement Requirement) Quarterly Report: April-June 2014
Policy/Code
California Education Code Section 35186
Background Information

The regulations of the Williams lawsuit settlement require school districts to complete ?Quarterly Complaint? reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and misassignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). This legislation requires that districts offer services for two consecutive years following grade twelve to students who did not pass the CAHSEE by the end of their 12th grade. Additionally, the legislation requires that students and families have the opportunity to file a complaint against the District for not fulfilling this requirement. Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required. For the period April-June 2014, the District did not have any complaints.
