Board Policy 5145.3 Non-Discrimination/Harassment Board Policy Bullying/Cyberbullying
Background Information

All schools in the San Leandro Unified School District are working diligently to ensure that every school and every classroom are free of all forms of bullying. National research and mental health organizations tell us that every year, students of all ages in schools across the nation encounter various forms of bullying such as physical bullying (hitting and/or punching), verbal bullying (teasing or name calling), emotional bullying (intimidation through gestures or social exclusion) or cyber bullying (sending insulting messages by phone or computer e-mail). Victims of bullying can suffer long term negative effects. Each year all schools receive information and curriculum resources to address this issue from the www.nonamecallingweek.org website. To solidify the District?s continued commitment to creating safe, respectful, and inclusive schools and classrooms, staff is recommending the Board of Education adopt a resolution in support of and to ensure the District?s schools? participation in ?National No Name Calling Week? (January 19-23, 2015) and promote anti-bullying messages and practices through this national event.

Supplemental Educational Services are classes or tutoring that provide additional academic instruction to a child at a time other than during the regular school day. Families are given a list of state approved providers from which to choose. Each district must enter into an agreement with the selected providers. These providers have been selected by the families from Garfield, Jefferson, McKinley, Monroe, Washington, Wilson, John Muir and Bancroft Schools, to work with their students for the 2014-2015 school year. The attached contracts outline the role and responsibility of both the district and the providers. For the 2014-2015 school year, the amount paid to the service provider will not exceed $807.48 per student and will be based upon actual hours of student attendance. Location for the services is determined between the provider and the district. The district has worked with these providers in past years.

Background Information

On February 4, 2014, the Board of Education received a presentation from Philip J. Henderson, Attorney at Law, Orbach Huff Suarez & Henderson LLP, on the Lease-Leaseback (LLB) Construction Project Delivery Method Available per Education Code Section 17406, which the District will use to deliver some of the bond construction projects in 2014. The basic structure of the LLB is as follows:

  • District leases real property to a builder for $1 (site lease)
  • Builder constructs facility, then leases the facility back to the district?this is the ?leaseback? component (facility lease)
  • District makes payments for construction costs:
  • Tenant improvement payments during construction
  • Lease payments after construction
  • The construction terms and conditions are part of an exhibit to the facility lease
  • Title to the new facility vests in the District as lease payments are made
  • District makes lease payments for a period of time and then has the option to make a balloon payment to the builder to buy out the facilities lease

One of the benefits of using an LLB delivery method is this method allows more control for who is selected.  A district accepts the Best Value as opposed to the lowest bidder, and while the LLB is not designed as a cost saving tool, districts can level the cost impact by adding competition. Many districts have found that there are fewer performance issues using this method; and the owner is able to control cost by negotiating a Maximum Construction Cost contract based on approved plans and specification which will limit change orders to unforeseen field conditions and/or owner requested changes.

LLB contracts are still school district public work contracts and the builder must pay prevailing wages, a payment bond is required, as well as DSA approval and Field Act compliance.  The District?s Project Stabilization Agreement may also be incorporated into each Lease Agreement.

On March 18 and 25, 2014, staff issued four RFQ?s to the general contracting public through advertisements in the Daily Review; and sent the RFQs to thirteen (13) contractors who had previously worked successfully with the District and the design teams.  On April 2, nine (9) general contractors responded to the RFQs, with all nine respondents meeting the District?s prequalification criteria.  On April 8, staff issued three (3) RFPs to the six (6) most qualified contractors and led mandatory site walks for each project.  Three (3) contractors responded to the RFPs and submitted proposals on the due date of April 25.

On June 17, 2014, the Board approved the construction services contract with Strawn Construction, Inc., in the amount of $4,027,571.00 for the Modernization and Voluntary Seismic Upgrades for Project #14-01 at McKinley, Monroe, Roosevelt, and Washington Elementary Schools and Bancroft Middle School; and Project #14-04 for Modernization and Voluntary Seismic Upgrades at Jefferson Elementary School.

Attached is Amendment #1 to the construction services contract with Strawn Construction, Inc. in the credit amount of ($167,955.00), for Project #14-01 and Project #14-04. The Amendment consists of District approved change orders and incorporates the Contract Allowance amounts resulting in a credit, lowering the final contract amount to $3,859,616.
