On May 28, 2014, the Board of Education approved the Agreement for Preliminary Services (Preconstruction Services) with Jeff Luchetti Construction Inc. for Project #14-07 for the Wilson Elementary School Parking Lot, Irrigation and Fields Project; Project #14-08 for the Madison Elementary School/District Office Parking Lot; and Project #14-12 for the Muir Middle School Parking Lot and Courtyard Landscaping, projects funded through savings from Measure B, the general obligation bond approved by San Leandro voters in 2006.

On June 24, the Board of Education approved the construction services contract with Jeff Luchetti Construction, Inc., in the amount of $1.219,225.00 for Project #14-07 for the Wilson Elementary School Parking Lot, Irrigation and Fields Project; Project #14-08: the Madison Elementary School/District Office Parking Lot Project; and Project #14-12 for the Muir Middle School Parking Lot.

On December 5, 2014 a meeting was held on site with all relevant team members including the Civil Engineer, Geotech Consultant, the Testing Engineers, the General Contractor and their Civil Contractor to review the site conditions after the heavy and prolonged inclement weather (rain) received through November.

Several options were discussed on how to remediate the wet sub surface soil on site. It was decided that the best option was to lime treat, 12" deep with a 5% lime mix over the entire site. Once this was completed it would allow the project to progress without further delay.

Attached is the change order dated December 18, 2014 in the amount of $90,000, which extends the original lease-lease back contract sum from $767,138.00 to $857,138.00 for project #14-12 for the Muir Middle School Parking Lot.

Background Information

On February 4, 2014, the Board of Education received a presentation from Philip J. Henderson, Attorney at Law, Orbach Huff Suarez & Henderson LLP, on the Lease-Leaseback (LLB) Construction Project Delivery Method Available per Education Code Section 17406, which the District will use to deliver some of the bond construction projects in 2014.

At the 12/20/13 Board Meeting, the Board of Education approved the contract , in the amount of $5,965,516, with SunPower Corporation, for the Design and Construction, Operations & Maintenance Agreement and Performance Guarantee (Project #13-17) for Solar Projects at San Leandro High School and Bancroft Middle School.

During the design, two major issues resulted in necessary changes to the layout conceptual design outlined in the original agreement.  The original agreement included a solar array in the parking lot adjacent to San Leandro High School, which was formerly owned by PG&E.  When the District acquired the property, PG&E maintained the right to the easement around their electrical towers.  Based on safety issues and maintenance needs, PG&E denied the District permission to install permanent facilities on the easement. This necessitated relocating the panels on the high school roof while still maintaining the same level of energy generation.

At Bancroft Middle School, the City of San Leandro?s tree ordinance restrictions made it necessary to find a new location in order to generate the same amount of energy needed for the anticipated cost savings. It was determined that the same (or slightly higher) energy generation could be realized by installing the solar at the San Leandro Adult School parking lot, with power supplied to Muir Middle School. This amendment reflects the solar installation layout change and adjusts the generation accordingly, increasing the generation and extending the completion dates, due to the changes.

Change Order No. 1 was approved on November 18, 2014 for $30,039.73 to pay for addition pier depth required for the carport installations.

This Change Order No. 2 is to have Sunpower pave the area at the Adult School creating an additional parking lot and compensate Sunpower for the added design costs in due to location changes from Bancroft to Muir and from the high school parking lot to the roof top ($257,529).
