| PUBLIC COMMENTS
Richard Chennault asked the Board for clarification regarding the Legal Statement, specifically if the Board was in compliance with "State law prohibiting the Board from taking action or discussing items that are not on the posted agenda..."
Trustee James explained that the Board may briefly respond, adding that the public may request that a matter, within the jurisdiction of the Board, be placed on the agenda at the next meeting or on a future agenda, which then can be discussed in a timely manner. Trustee Rosato further explained that unlike a "Town Hall" meeting, where issues are discussed and debated, these are public business meetings of the Board of Education where the public is present and is given an opportunity to address the Board for three minutes on any item of interest on the agenda, or bring matters before the Board that are not listed on the agenda. However, the Board does not need to respond to items that are not on their agenda, adding that "We are not being disrespectful, it is just a matter of how business is conducted at Board of Education meetings." |
Members of the audience who wish to address the Board are asked to complete the yellow card available at the entrance and submit it to the Board's Administrative Assistant. Speakers who have completed the card will be called when the item is reached on the agenda or, for non-agenda items, during the Public Testimony. Cards are to be turned in before the item is reached on the agenda. Please note that the meeting is being recorded.
State law prohibits the Board of Education from taking any action on or discussing items that are not on the posted agenda except to A) briefly respond to statements made or questions posed by the public in attendance; B) ask questions for clarification; C) provide a reference to a staff member or other resource for factual information in response to the inquiry; or D) ask a staff member to report back on the matter at the next meeting and/or put it on a future agenda. (Government Code 54954.2(a)).

| Louise Shaw, District teacher and parent, addressed the Board regarding Goal 3 of the Strategic Plan, "Community and Public Relations." Her comments and concerns focused on parent facilitators, report cards and parent/teacher conferences. Ms. Shaw felt that the District needs to be more effective in communicating with parents, suggesting that the "Schools Smart Engagement Program," and "Ed100.org" are two great resources. Superintendent McLaughlin responded by saying that the District has already contracted with "Schools Smart" to work with every school in the District.
The Board heard from three San Leandro High School seniors who shared their experiences as students in the AVID Program: (1) Francisco Cortes said that he has been in AVID since 7th grade, and shared that two particular activities "Talking to the Text" and Tutorials, have really helped him take notes, study for tests, understand what he is reading, and prepare for college; (2) Daniela Gutierrez said that she was in AVID for four years and that AVID has been a great support system for her. With AVID's help she applied to ten collages and was accepted at four. She will be attending California State University East Bay; and (3) Leo Torres has been in AVID since his freshman year of high school, saying that his senior year has been the most successful, and under the direction of AVID, he set goals and is planning on attending Berkeley Community College then transferring to Fresno State University.
Catherine Eagan addressed the Board regarding the LCAP and appreciated all of the wonderful things that she saw in the draft. She posed questions on specific areas where she felt there wasn't enough specifics and encouraged staff to expand upon them. The Board thanked Dr. Mucetti for the clarity of the presentation.
Superintendent McLaughlin thanked Dr. Mucetti, her team, the committees, parents, students, teachers, and community for all of their work. He explained that the most difficult piece of this process for the public is to understand that we are still learning this process, the state keeps changing the process, and the rubric to actually score the LCAP will not be available until October 2015. "I know it is frustrating," the Superintendent said, however, "if we hang in there, smooth out those rough edges, and ride this out, this could be a really fantastic process, much better than what we used to do, because now we are getting the input." |
| The staff will recommend that the board of education adopt the final draft of the Local Control Accountability Plan (LCAP) at the upcoming scheduled board meeting on Tuesday, June 23, 2015. |

| School districts are required to hold a public hearing on both the Adopted Budget and the Local Control Accountability Plan (LCAP) before the official adoption of both the LCAP and the adopted budget by the Board of Education, which will be officially adopted by the Board on June 23, 2015, and submitted to the County Office of Education for review and approval by July 1. Assistant Superintendent Mark Martinelli presented a draft of the 2015-16 Adopted Budget which includes fiscal years 2016-17 and 2017-18. Highlights included:
SLUSD Budget Development Assumptions:
1. Projected Total Student enrollment: 8,617 (Regular School: 8,351; Special Education: 266)
2. ADA based on 95.0% attendance
3. Prior Year 2014-15 P-2 ADA = 8,187.18 and is used for Lottery, Mandated Cost Reimbursement & LCFF Calculations
4. Unduplicated Count-District (English Learner students, low income students and foster youth) Three-Year Average for SLUSD is 67.32% and is used for LCFF Calculation
State Budget Development Assumptions
1. May Revise COLA/LCFF Gap Funding Percentage:
a. 2015-16 - 1.02% COLA with a 53.08% LCFF Gap Funding Percentage
b. 2016-17 - 1.60% COLA with a 37.40% LCFF Gap Funding Percentage
c. 2017-18 - 2.48% COLA with a 36.70% LCFF Gap Funding Percentage
2. Salary Expenditures
a. 2014-15 Bargaining Uni Salary Settlements Budgeted
b. Step & Column Increases Included each year
c. STRS rates go up to 10.73%, 12.58%, 14.43% for budget year and next two fiscal years
3. 3% District State required reserve balance is met
4. Contributions continue for Special Education & Transportation, & RRMA (Routine Restricted Maintenance)
2015-16 May Revise Changes Bright Spots:
1. LCFF Funding Gap Increase
a. From 32.19% up to 53.08% in 2015-16
-$7.76 million increase over 2014-15
-$2.82 million increase over 2015-16
-$2.43 million increase over 2016-17
-$1.86 million increase over 2017-18
-Less incremental funding per year as total gap closes
2. Funding gap may be completed before 2020-21
3. One-Time Discretionary State Funding
a. $4,900,000 increase for SLUSD ($601) per ADA
Budget Development Cautions include:
1. District proposed budged is based on May Revise estimates as of May 14, 2015; these will be updated when the State budget is signed by the Governor after June 15, 2015
2. Fully funded 2007-08 rates do not equal 2015-16 expenditure rates
3. LCFF Gap funding increases are only for four to five more years. Afterward, LCFF increases are only by COLA funding plus District enrollment/ADA growth, which is 90% now - back to 40% before 2020-21
4. One-Time 2015-16 Discretionary Funds go away in 2016-17
5. STRS Employee percentage rates will continue to increase by 1.85% until 2019-20; 25% of planned LCFF growth consumed by STRS increases at full implementation
6. Proposition 30 - Temporary Taxes Expiring: Sale taxes in year 2016; higher personal income taxes in year 2018; and $7 to $9 billion inflow into State Revenues per year
7. Uncertain about when the next recession will occur
Next Steps:
1. June 23, 2015: 2015-16 LCAP & Adopted Budget to the Board for approval
2. June 30, 2015: 2015-16 LCAP & Adopted Budget to the County Office of Education
3. June 15, 2015: State Proposed Budget to the Governor
4. Sept. 8, 2015: 2014-15 Unaudited Actuals to the Board |

Once the district files its adopted budget with the County Office of Education (COE), the COE is required to verify that the budget complies with the criteria and standards adopted by the State Board of Education, per E.C. 33127, to determine whether the district will be able to meet its financial obligations in the current and two subsequent fiscal years and notify the district by August 15 whether the COE has approved, conditionally approved, or disapproved the budget.
The staff has developed the budget using the state-adopted Criteria and Standards. It includes the expenditures necessary to implement the Local Control Accountability Plan (LCAP) or annual updates to LCAP that will be effective for the budget year. Business Services staff has prepared the Adoption Budget based on assumptions from the Alameda County Office of Education (ACOE), California Department of Finance (DOF/FCMAT), and the School Services of California (SSC), Inc. dartboard which provides the school districts critical economic indicators for budget projections.
