J.1.f. Approve Dunbar Armored, Inc. Contract for Food and Nutrition Services 2017-18 school year
Rationale:

An annual requisition for Dunbar Armored, INC is generated by Food and Nutrition Services Department.

The Food and Nutrition Services Department has floor safes in the kitchens at each school site. Deposits from the parents are collected and recorded in the Point of Service computers.  The money is then counted, recorded and placed in the safe at the end of the day. Nutrition Services Department contracts with Dunbar Armored Trucks to come to the sites weekly to pick up the money bags and take them to the bank.  When the bags are picked up by Dunbar staff, our Nutrition Services Assistants sign a log sheet confirming number of bags pick up and amount of money listed in each bag.

Our objective is to ensure the safe transfer of cash and checks from our school sites to the bank.

Recommended Motion:

Recommend to approve the contract with Dunbar Armored, Inc. to transfer monies from the cafeteria sites to the bank.

Financial Impact:

The estimated total cost is not to exceed $17,000 for the 2017-18 school year and will be paid from Food and Nutrition Services Fund.

J.2. Business & Operations
J.2.a. Adopt Resolution No. 17-32 for Temporary Borrowing Between District Funds
Rationale:

Education Code Section 42603 permits the Governing Board of any school district to direct that monies held in any fund or account may be temporarily transferred to another fund or account of the district for payment of obligations.  The transfer shall be accounted for as temporary borrowing between funds and shall not be available for appropriation or be considered income to the borrowing fund.

The State of California changed the way public schools are funded with the implementation of the Local Control Funding Formula (LCFF), effective July 1, 2013.  As with the prior Revenue Limit Funding Model, districts receive monthly apportionment distributions that vary in amounts which may cause temporary cash flow shortages.

As a precautionary step, and in order to meet all financial obligations on a timely basis, the Business Services Department recommends that the Board adopt a resolution allowing temporary inter-fund cash borrowings up to $5,000,000 for the 2017-18 Fiscal Year, in case temporary cash shortfall occurs.

The General Fund will repay the current interest as designated by the County Treasurer.  Staff will continue to assess and monitor the District's cash flow.

Recommended Motion:

Adopt Resolution No. 17-32 for Temporary Borrowing Between Funds.

Financial Impact:

Interest incurred during the period of inter-fund borrowing.

Attachments:
Resolution No. 17-32 InterFund Borrowing
J.2.b. Adopt Resolution No. 17-33 for Temporary Borrowing from the Alameda County Treasurery
Rationale:

Article XVI, Section 6, of the California Constitution and Education Code Section 42620 allows for borrowing from the County Treasury, when there is not sufficient cash available to pay its obligations for current operating requirements lawfully incurred in the 2017-18 fiscal year.

The following restrictions apply to this authorization:

1. Maximum amount of authorized borrowing: $10,000,000

2. For Fiscal Year: 2017-2018

3. Shall not exceed 85 percent of the anticipated revenues accruing to the district.

4. Shall not be made prior to the first day of the fiscal year nor after the last Monday in April of the current fiscal year.

5. Shall be replaced from revenues accruing to the district before any other obligation of the district is met from such revenue.

Recommended Motion:

Adopt Resolution No. 17-33 for Temporary Borrowing from the Alameda County Treasurer.

Financial Impact:

Funds borrowed from the county treasury would incur the county's standard interest rate.  The most recent published rate was 0.64% as of May 2017.  Any borrowed funds in the district account would accrue interest at the same rate until spent, bringing the net cost of borrowing for any unused funds to near zero.

J.2.c. Approve SFSPac PortionPac Chemical Corp. Agreement 2017-18 school year

The Professional Standards as part of the Healthy, Hunger Free Kids Act of 2010 was implemented. The final rule established minimum professional standards for school nutrition personnel who manage and operate the National School Lunch and School Breakfast Programs. The final rule requires all personnel in the school nutrition programs to complete annual continuing education/training. These regulations are expected to result in consistent, national professional standards that strengthen the ability of school nutrition professionals and staff to perform their duties effectively  and efficiently.

K. ACTION/DISCUSSION ITEMS
K.1. Business & Operations
K.1.a. Resolution 17-31 - The Education Protection Account for Fiscal Year 2017-18 (EPA)
Rationale:

The voters of California approved Proposition 30 on November 6, 2012 and pursuant to Article XIII, Section 36 of the California Constitution, effective November 7, 2012, it is required to create in the State General Fund, an Education Protection Account (EPA) to receive and disburse the revenues derived from the incremental increases in taxes imposed by Article XIII, Section 36(f);

School districts are required to determine how to use funds received from the EPA, provided that the governing board makes the spending determinations in an open session of a public meeting.

The language in the constitutional amendment requires that funds shall not be used for the salaries and benefits of administrators or any other administrative costs.

Each school district shall, annually, publish on its Internet website an accounting of district's EPA funding and how these funds will be spent.

Attached are the Resolution regarding the Fiscal Year 2017-18 EPA for SLUSD and Exhibit A showing how these funds will be spent.

Resolution No. 17-31 Education Protection Act 2017-18
K.1.b. Approve High School Lunch Price Increase of $0.25 for 2017-18 School Year
Rationale:

On December 13, 2010, The Healthy, Hunger-Free Kids Act of 2010 (the Act) was signed into law by President Obama. The Act reauthorized legislation that governs all Child Nutrition Programs (CNP) with new regulatory requirements and other important improvements to the CNPs that serve all school districts including San Leandro Unified students. One major regulatory requirement of the Act is Section 205, Equity in School Lunch Pricing.

Section 205 of the Healthy, Hunger-Free Kids Act of 2010 requires School Food Authorities (SFAs) participating in the National School Lunch Program to provide the same level of support for lunches served to students who are not eligible for free or reduced price lunches (i.e., paid lunches) as they are for lunches served to students eligible for free lunches.

School Food Authorities in the continental U.S. must charge for paid meals using weighted average.

San Leandro’s weighted average price for paid lunch price is currently $2.69 (based on weighted average of the total paid lunches served in October 2016, using the various prices: Elementary $2.50, Middle $2.75, High $3.25).

Note: SY 2016-17 Weighted Average Price equal to or above $2.86 are compliant for SY 2017-18. $2.86 is the difference between the Free and Paid reimbursement rates for SY 2016-17.

Because San Leandro Unified School District’s average paid lunch price is lower than $2.86, paid lunch prices are mandated by the Act to be increased.  We have chosen to propose increasing the high school meal price by $0.25 because of the value (quantity of food) that students are currently receiving with the meal cost at only $3.25.  With this proposed increase, we do not have to adjust elementary or middle school paid lunch prices this year.

San Lorenzo Unified School District is planning the same increases outlined above for the 2017-18 School Year.

Recommended Motion:

Approve increasing the price of paid lunches to $3.50 effective August 16, 2017.

San Leandro Unified School District received a $25,000 grant by the Orange County Department of Education (OCDE) that is tied to a statewide MTSS (Multi-Tiered System of Support) initiative to implement a framework designed to support all student's academic, behavioral and social needs.

San Leandro Unified School District is part of an initial cohort of 105 schools, districts and county offices of education that will receive sub-grants totaling $3.225 million to participate in the California Scale Up MTSS Statewide (SUMS) initiative, which is funded by the California Department of Education and led by OCDE in partnership with the Butte County Office of Education and the SWIFT Center at the University of Kansas.

MTSS is a comprehensive framework of evidence-based strategies to suport the academic, gehavioral and social-emotional needs of all students.  Reliant on staff collaboration and data-driven decision-making, MTSS guides educators through the process of initiating action plans, tracing progress and making improvements in a number of critical areas.  As such, it has been used to increase attendance, prevent dropouts, lower discipline rates, enhance school climates and improve academic performance.

L. INFORMATION ITEMS
L.1. Educational Services
L.1.a. Williams Uniform Complaint Procedures (Including Valenzuela Settlement Requirements) Quarterly Report for April - June, 2017
Rationale:

The regulations of the Williams lawsuit settlement require school districts to complete “Quarterly Complaint” reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and misassignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required. For the period of April - June, 2017 the District did not have any complaints.

Recommended Motion:

Review the Quarterly Report on Williams Uniform Complaints for April - June, 2017.
