Education Code Section 42603 permits the Governing Board of any school district to direct that monies held in any fund or account may be temporarily transferred to another fund or account of the district for payment of obligations. The transfer shall be accounted for as temporary borrowing between funds and shall not be available for appropriation or be considered income to the borrowing fund. The State of California changed the way public schools are funded with the implementation of the Local Control Funding Formula (LCFF), effective July 1, 2013. As with the prior Revenue Limit Funding Model, districts receive monthly apportionment distributions that vary in amounts which may cause temporary cash flow shortages. As a precautionary step, and in order to meet all financial obligations on a timely basis, the Business Services Department recommends that the Board adopt a resolution allowing temporary inter-fund cash borrowings up to $5,000,000 for the 2019-20 Fiscal Year, in case temporary cash shortfall occurs. The General Fund will repay the current interest as designated by the County Treasurer. Staff will continue to assess and monitor the District's cash flow.
| |
Adopt Resolution No. 19-36 for Temporary Borrowing Between Funds. |
Interest incurred during the period of interfund borrowing.
Resolution No. 19-36 for Interfund Borrowing
Article XVI, Section 6, of the California Constitution and Education Code Section 42620 allows for borrowing from the County Treasury, when there is not sufficient cash available to pay its obligations for current operating requirements lawfully incurred in the 2019-20 fiscal year. The following restrictions apply to this authorization: 1. Maximum amount of authorized borrowing: $8,000,000 2. For Fiscal Year: 2019-2020 3. Shall not exceed 85 percent of the anticipated revenues accruing to the district. 4. Shall not be made prior to the first day of the fiscal year nor after the last Monday in April of the current fiscal year. 5. Shall be replaced from revenues accruing to the district before any other obligation of the district is met from such revenue.
| |
Adopt Resolution No. 19-37 for Temporary Borrowing from the Alameda County Treasurer. |
Funds borrowed from the county treasury would incur the county's standard interest rate. The most recent published rate was 1.82% as of March 2019. Any borrowed funds in the district account would accrue interest at the same rate until spent.

Child, Family, and Community Services (CFCS) is a nonprofit organization that runs three Head Start preschool programs in our district. The programs are located at Garfield, Madison, and on the Adult Education campus. CFCS and the district have signed long term lease agreements through 2036. The lease presented for approval here would replace all existing leases. The lease is being updated at this time to both clarify and simplify the invoicing process, and to consolidate the three separate leases. The term of the updated lease is for 20 years at Garfield and Madison. CFCS originally paid for the construction and continues to maintain the buildings they use at both elementary sites, including utilities. The at the Adult Education term would end on July 30, 2020 due to our Adult School needing additional space for their own programs. CFCS was amenable to the short term lease at Adult Ed because we are giving ample notice (in excess of one year). Staff has communicated with CFCS that we will assist in looking for other space options within the district where CFCS could possibly construct a building so their valuable programs could continue to be offered to preschool aged children in our community. |

Currently, the district contracts with an outside consultant to provide support for district-wide security, emergency, and safety services. There is a continued need for this support to help the district with the following: site and district emergency and security response planning; training; security and safety systems implementation; facilities assessments and reviews; and for the alignment of district procedures with best practices and legal mandates. Rather than continue to contract out this work, staff is recommending that the district hire a person to perform these services. Approval of this item will approve the job description for the Director of Safety and Emergency Services position, set the salary range for this position as Director - Range 10 on the classified management salary schedule, and authorize staff to advertise for and fill this position.

The Single Plan for Student Achievement (SPSA) is a document that represents a school’s cycle of continuous improvement of student achievement. The annual process of developing, reviewing, and updating the SPSA includes a comprehensive review of data and the development of actions necessary to achieve school goals. All of the SLUSD school sites have created their school expenditure plan aligned to the district's strategic goals for the 2019-2020 school year. The plans inform the board of education of the site level strategic initiatives designed by principals and School Site Councils for their particular school. School site principals have conducted work with their School Site Councils in order to create expenditure plans for the upcoming 2019-2020 aligned to the goals, initiatives, and tactics in the district's 2017-2020 strategic action plan. Each year, the School Site Council and the local governing board approve the SPSA.

The Youth Reinvestment Grant (YRG) program was established in the 2018 Budget Act (Senate Bill 840, Chapter 29, Statutes of 2018) and the related trailer bill (Assembly Bill 1812, Chapter 36, Statutes of 2018). The Youth Reinvestment Grant program is aimed at diverting low-level offenders from initial contact with the juvenile justice system using approaches that are evidence-based, culturally relevant, trauma-informed, and developmentally appropriate. Grant funds will be used to target underserved communities with high rates of juvenile arrests and high rates of racial/ethnic disproportionality within those juvenile arrests. Applicants are local governments and will be required to pass through ten percent of awarded funds to a designated “lead public agency” responsible for coordinating with local law enforcement agencies, social service agencies, and nonprofit organizations to implement the local grant program. Applicant local governments will be required to pass through the remaining 90 percent of awarded funds to community-based organizations. NGOs that receive these funds must deliver services in underserved communities with high rates of juvenile arrests. The services include diversion programs and alternatives to arrest, incarceration, and formal involvement with the juvenile justice system, educational services, including academic and vocational services, mentoring services, behavioral health services and mental health services. City of San Leandro, applicant, San Leandro Unified School District, lead agency, has been awarded the Youth Reinvestment Grant.
