“Prop 13 Split Roll” scheduled for November 2020 ballot - would raise $11 billion, with $4 billion going to education. This measure is undergoing revision and a new round of signature gathering. It is currently polling at 46% support.
Legislative Updates AB 218 Extends the statute of limitations for filing claims of childhood assault to 40 years of age, or up to five years after discovery, whichever is later.
If the victim of childhood assault proves that the assault was the result of a cover-up, the victim may recover treble damages: triple the amount of the actual/compensatory damages
Opens up a three-year window for victims of any age to sue on previously expired claims
Some districts may receive claims that pre-date membership in a property and liability Joint Powers Authority (JPA) --Districts would have to try to figure out who their insurance company was at the time, and if that company is still in business --Districts may find that they are completely responsible for attorney costs and potential award
SLUSD joined our JPA, Northern California Regional Liability Excess Fund, in 1988
AB 48 Placed a $15 billion K-16 education facilities bond on March 2020 ballot (Prop 13)
Also looked to incentivize developers to create affordable housing by reducing or eliminating costs
School developer fees (Fund 25) for multifamily housing developments would be reduced by 20%
Developer fees for multifamily housing within one-half mile from a major transit stop would also be eliminated completely --Major transit stop defined as rail station (BART), ferry terminal, or intersection of two or more major bus routes with service interval of 15 minutes or less during commute periods
Reduced developer fees sunset in 2026
Statutory COLA State had projected a COLA of 3% for 2020-21 and 2.8% in 2021-22
In late November, Legislative Analyst Office (LAO) reduced forecast to 1.79% for 2020-21
Additional LAO forecasting shows 2021-22 COLA of 1.2%
School Services estimates that maintaining local school operations requires close to a 4% COLA
It is possible that Legislature uses additional state resources to give larger COLA than required – will know more in January
Next Steps: The Governor will release his 2020-21 Budget in January which will be followed by the School Services of California conference in Sacramento.
Second Interim will be presented in March.
2020-21 Budget and LCAP will be presented for review and adoption in June.

| |
Dr. Kevin Collins, Assistant Superintendent of Business Services, presented the results of the 2018-19 district audit as follows:
Overview: -Review 2018-19 District Audit - All Funds -Review 2018-19 Measure J1 Bond Audit-Financial and Performance
2018-19 Audit ? Our auditor, Vavrinek, Trine, Day & Company (VTD), merged with a new company named Eide Bailly. ? SLUSD under contract with Eide Bailly through 2019-20 fiscal year audit ? Partner in charge of district audit is Terri Montgomery ? For fiscal year 2018-19, auditors visited ? Garfield and Madison ? John Muir ? SLHS, Lincoln, and Lighthouse
2018-19 Audit - Net Position ? Since 2014-15, district audits are required to include “share” of state-wide unfunded pension liabilities. ? SLUSD net pension liability for PERS and STRS: $111 million ? Net pension liability for PERS and STRS was$108.2 million for the prior year ? SLUSD has negative “net position” of ($47.3 million) ? Net position was ($48.1 million) last year
2018-19 Audit Findings ? Invoices from bond program were dated prior to 7/1/2019 but received in August – for ongoing work. Payment should have been made from 2018-19. ? Bond staff had called all vendors prior to end of year to check on status of outstanding invoices. ? This finding is a repeat of similar one from 2017-18 ? Business and Bond departments will review procedures for 2019-20 ? Two elementary Contract Independent Study forms were signed by principals after end of contract period. Requirement is to sign before the absence begins. ? We will review this requirement with principals and attendance staff ? We will review copies of all contracts prior to audit visit for 2019-20 to ensure compliance
2018-19 Bond Audit ? A requirement of a Prop 39 (55%) bond measure is to carry out an annual financial and performance audit. ? Bond audit was performed at the same time as the district audit. ? Bond and district audit included same finding regarding late invoices.
2018-19 Audit Eide Bailly issued an unmodified opinion for the financial statements (this means it was a clean opinion – fairly stated).
Governing Board Recommendation Accept the following 2018-19 Audits: ? District Financial Audit ? Measure J1 Financial and Performance Audits

The city agreed to loan $1,250,000 to the district in 2013 towards purchase and construction of what is now the Barbara Lee Center. We currently owe $686,610.77 of the original loan amount, plus interest. The district has been using its Developer Fees (Fund 25) since 2014 to repay the loan because the facility was needed to provide health and wellness services to additional students due to growth within the district. The interest rate for the loan began at 1.5%, rose to 3% in 2017, and will raise to 5% in 2024. Staff is proposing to use Developer Fees (Fund 25) and Redevelopment Agency funds to payoff the loan. Early payoff is allowed under the terms of the original loan. An early payoff would save approximately $60,000 in cumulative interest payments. This calculation includes the loss of potential interest income from keeping district funds in the county treasury. The total cost of a January payoff would be $695,193.41. The district's Fund 25 currently has a balance of $470,336.51, and has adequate balance in Redevelopment Agency funds for the remaining $224,856.90.

The regulations of the Williams lawsuit settlement require school districts to complete “Quarterly Complaint” reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and mis-assignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required. For the period of July-September, 2019, the school district did not have any complaints.

Dr. McLaughlin explained that it's their report and typically when they don't attend they have nothing to report. Dr. McLaughlin will reach out to them to see if they want to provide something in writing when unable to attend.
