(Government Code 54954.2(a)).

F. PUBLIC TESTIMONY ON NON-AGENDA ITEMS
Minutes:
Two emails were read that were sent via the public comments email address:

Steven Mills: A former student and student board member, requested that the Board create a task force to consider the impact and implementation of changing the names of schools throughout the City of San Leandro. The email further commented that symbols of anti-racism rise while symbols of racism and segregation are toppled and that the names of our schools should not be an exception. He stated several examples of former presidents that the district schools are named after and the racist behavior manifested. He also stated that it is time we give a hard look as a community to remedy our previous naming mistakes.

Nelsy Batista: commented that in the event a vaccine is not ready for all she encourages sanitation and waste management in making sure that our schools are taking proper health measures to contain the virus on school grounds. Aside from this, the email inquired about using virtual classes from home for families who do not want to send their students to school. She posed the question will the curriculum be equipped to handle online class adequately and will there be additional assistance in the classrooms for teachers who teach both in class and online?

Several members of the audience participated in public testimony on non-agenda items:

Liz Toledo: A former student board member and USB high school president in 2017-18 and now a community member. Although she enjoyed her time in SLUSD there are shortcomings that need to be addressed. One particular event that has left her struck to the core is and still left looking for change. She referred to snapchats posted by Zachary Fletcher regarding the Black Lives Matter protest. Administration held solidarity circles the next day. Even though it was a healing process to stand with others who were likeminded in our demonstration, she still cannot fathom how people who don't think like her or need the critical conversation were not present. She stated she feels like it's time to implement some type of restorative justice technique. She also stated the need to implement Ethnic Studies throughout all K-12 curriculum. Lastly, she encouraged implementation of some type of student board committee because the board member voice is not enough.

Rigo - He agreed with Liz Toledo's comments and commended board members and stated they are doing an amazing job in encouraging more enrollment in Ethnic Studies courses and statements that have been made, but it is important to address these issues further. However, one single statement is not enough and saw that with the Myrnah and Mariah policy. It was passed with flying colors but there was no implementation thereafter. He found that to be disrespectful as a San Leandro community member. It is necessary to address these issues via implementation.

Although Rigo was momentarily cut off from the virtual meeting, he came back to finish his comments by stating the importance of implementing statements that are made and encouraged board members to speak to the students who are the subjects of all of the policies. He also noted that the college/career course taken by students in their freshman year has not been affective according to students since they're just coming into high school and learning how to navigate. He feels we need Ethnic Studies since students need to learn where they come from, who they are and what they are about. He also thought the district should end the school referrals on campus. He believes it is a way, especially for white teachers, to use their biases against students of color and students have witnessed this. The referral system is a way to criminalize students and feels we need to end that system and bring in restorative justice.

Karla Cardenas: A recent SLHS graduate; she stated that we pride ourselves in the diversity of our town. But she stated there is something that goes on at San Leandro High school that is overlooked. There are assemblies or random meetings at the high school and the principals often showcase a message of colorblindness. She found these comments disrespectful since color to some is their identify. She also mentioned victim shaming that takes place at the high school and felt it is irresponsible; the counselors should do a better job of looking into these situations.

Brian Stewart: He is a new parent to San Leandro; his son will transition from TK to kindergarten next school year. Mr. Stewart has enjoyed what he has seen at the school his son is attending and attributes that to the fine work the school board is doing. There is a lot going on at this point in time between the virus and demonstrations. He wanted to comment on the letter read earlier regarding changing the names of the schools and places his support in the contents of that letter. What we decide to name our schools shows what the community is supportive of. If we're naming our schools after people who persecuted another group, it shows where we put our values. The groups that are persecuted feel like they don't belong to the community. His son, for example, attends Roosevelt elementary, and we know that Theodore Roosevelt was very malicious against the Native American people. What are we saying as a society when we say this is what we hold as valuable and what we admire? He also supported what Rigo said about the referrals. He felt there was a lot of bias in school when he was a student. He reiterated that he appreciated the forum to comment; he is enjoying what his son has experienced at the elementary school and looks forward to taking him through the school system.

J. PRESENTATIONS
J.1. 2020-2021 School Reopening Update
Speaker:
Dr. Sonal Patel, Assistant Superintdent, Educational Services
Rationale:
Dr. Sonal Patel, Assistant Superintendent of Educational Services, will provide an update pertaining the school reopening for the 2020-2021 school year.

Minutes:
Dr. Patel, Assistant Superintendent of Educational Services, Dr. Zarina Zanipatin,
Assistant Superintendent of Administrative Services and Dr. Kevin Collins, Assistant Superintendent of Business Services, provided an update on the plan to reopen schools for the 2020-2021 school year. A timeline will be shared in terms of their next work steps along with key considerations on how to open for elementary schools, middle schools, high schools, which includes Lincoln Alternative Education Center, and the adult school. Their main goal is to try to bring back students as safely as possible so that we can all learn together in the next school year.

A timeline that was sent to the community and is currently on the website was displayed. The timeline provides an outline of what the staff has done since the COVID-19 closure begin in March. The timeline reflects that some of their steps currently being taken, which includes staff/community surveys, reopening schools taskforce meetings, reopening schools work groups and this update. This process included surveys from families and staff, task force data and retrieving information from Alameda County including the Superintendent’s Council, ACOE Lead Learners Network and ACOE PIO (Public Information Officers) Network, in order to make sure the school district was keeping in line with what was happening within the county.

Future dates include:

July 6 & 8 - Labor Bargaining (those dates were changed to July 10 and 14 after this presentation and board meeting took place)

July 14 - School Board presentation

August 12 - 2020-2021 school year begins

After hearing the task force, planning began and two work groups were created: a Reopening Work Group and an Administrator Work Group.

The Reopening work group was comprised of principals, district administrators and bargaining units. This group worked on schedules, pick-up, drop-off, lunch/passing periods, hygiene and safety.

The Administrator Work Group included principals, along with district support; they worked on refining plans with specific details.

Cabinet members were following the guidance from three different areas:

• California Department of Education (this information came out June 8)
• Alameda County Public Health Department - provides ongoing local health orders in response to COVID-19
• California Governor's Orders - Ongoing direction from Governor Newsom and California Department of Public Health

This guidance has helped the school district comprise a COVID-19 safety plan draft.

The work groups focused on four major areas for all elementary, middle, high school and Lincoln

• Screening drop off/pick up/isolation area: this would include temperature checks, screening questions, physical distancing at ingress/egress; hygiene protocols and checks
• Lunch, passing breaks (bathroom) -physical distancing and hygiene protocols outside of classroom time
• Schedule - for physical distancing - 50% student population; students on A schedule or B schedule o Some students attend all week
o Some students remain on distance learning all week
• Student group assignment - Placing students in group A or B; Considerations for siblings; considerations for special programs.

Dr. Zanipatin discussed the elementary work group ideas for reopening schools. These ideas are subject to negotiations with our bargaining units and then will go to the board for approval.
• Screening drop off/pick up/isolation area: arrival/dismissal; orientation parent video for new protocols; sites will need to consider having multiple entrances with those checkpoints in order to reduce the traffic flow in order to comply with social distancing requirements
• Lunch/passing/breaks (bathroom) - physical distancing and hygiene protocols outside of classroom time; lunch, breakfast service (for half day and full day scenario); also discussed how staff can provide lunch service for students not physically on campus; one suggestion was to provide lunch for those not physically attending school at a designated location
• Schedule: students on A schedule or B schedule; 2 days a week in person instruction; Wednesday -teacher planning day --no students on campus; consider special populations on campus
• Assignment - placings student in group A or B (discussion centered around who would be in which group); considerations for siblings across grade level bands; orientation period by grade band, i.e., families who have students in elementary, middle and high schools and how to coordinate placing them on the same schedule
to provide consistency for families; the group also looked at providing an orientation period for the different grade bands to get families accustomed to the new protocols

Dr. Kevin Collins provided information on middle school, high school, Lincoln Alternative, and adult school education

Middle School Work group:
• Master schedule review for how to groups students on A and B schedules (to maintain social distance and reduce class sizes)
• 3 lunch schedules to reduce size and increase safety/flow of students, only 150 students out versus 1000 right now
• Facility space review to rethink classroom spaces to ensure distancing protocols and hygiene
• Onboarding plan (grade by grade) to teach students and families about drop off procedures, screening protocols, and new school routine

Lincoln Alternative Education Center:
• Move parking to Burrell to open up outdoor spaces for lunch and screenings
• Using multipurpose room for classroom space (with dividers)
• Offering 100% virtual option for students who thrived during Spring 2020 Emergency Distance Learning
• Ensuring access to teletherapy
• Connecting to work based learning in a safe format

High School:

A draft of the high school schedule was displayed. The schedule reflected 3 courses per quarter by groups A and B for quarters 1 and 3.
• Group A students would attend Monday and Thursday
• Group B students would attend Tuesday and Friday
• Wednesday would be a designated as a teacher work day, an opportunity for deep cleaning and distance learning opportunities for students
• The benefit of this schedule is to reduce the amount of students on campus. A draft of this schedule is pending Labor and SLUSD Board approval

Positive Aspects of 3x3 Block
• Block reduces back and forth including FTK
• SDC and EL students receive services all year
• Keeps structure of current master schedule
• Same schedule could be used in 100% in-person and 100% virtual format
• Increased social distancing with block (75% reduction to exposure)
• Students can better manage 3 classes versus 6
• Moderate/Severe SDC could meet all 4 days

Less than Optimal
• 3 hours in-person per week for one quarter
• Teacher prep one quarter, none the next
• Only allows for afternoon ROP schedule

Note: the 3x3 quarter block should be compared to spring Emergency Distance Learning rather than all in-person learning.

Adult Education:
• Reduce class sizes - under 14 students per room
• Staggered start times for classes
• Will not use classrooms at Muir (new portables may not be ready by August)
• Additional custodial support to clean rooms in between classes including Saturdays
• Reviewing procedures for adults to take their own temperature and answer questions
• Old Adult programs offered at San Leandro Senior Center have been put on hold – The City of San Leandro is currently not allowing programming at that site
• Working with Adult Ed Preschool and Broadmoor to develop additional procedures

Dr. Zanipatin explained there are scheduled meetings with our bargaining units: SLTA,
CSEA and teamster trades. Labor bargaining dates with SLTA will take place July 6 and July 8, 2020 (dates recently changed to July 10 and 14, 2020). We'll also be in the process of developing MOUs to aid in supporting the delivery of services and duties all while keeping staff and students healthy and safe. We'll have a school board presentation on July 14 and following board approval they will share this plan with the rest of the community as they begin to prepare for the new school year.

A display was viewed which provided a reminder of communication utilization for:
• For the reopening timeline, currently on the district website
• Free meals on the district and school websites and ParentSquare

K.1. Conduct an Official and Public Hearing on 2020-2021 District Budget
Speaker:
Dr. Kevin Collins
Rationale:

Education Code Sections 33129, 42127, 52060, 52061, and 52062 require a Local Educational Agency to file and adopt a budget subsequent to a public hearing by the governing board of the school district. Once the district files its adopted budget with the County Office of Education (COE), the COE is required to verify that the budget complies with the criteria and standards adopted by the State Board of Education, per E.C. 33127, to determine whether the district will be able to meet its financial obligations in the current and two subsequent fiscal years and notify the district by August 15 whether the COE has approved, conditionally approved, or disapproved the budget.  The staff has developed the budget using the state-adopted Criteria and Standards. It includes the expenditures necessary to implement the Local Control Accountability Plan (LCAP) or annual updates to LCAP that will be effective for the budget year.  Business Services staff has prepared the Budget based on assumptions from the Alameda County Office of Education (ACOE), California Department of Finance (DOF), and the School Services of California (SSC), Inc. dartboard which provides the school districts critical economic indicators for budget projections.

Included is the 2020-21 District budget for public hearing and review, a copy of the public hearing notice, and the SB 858 Reserve Level Disclosure document.

Key fiscal items are listed below

  • Budget includes an LCFF COLA of 2.31%
  • Budget includes PERS and STRS relief of approximately $1.5 million
  • Budget includes federal ESSER funding of $1.2 million to address COVID-19 related needs
  • Budget does not contain federal Learning Loss Mitigation funding
  • Budget maintains 3% minimum reserve for 2020-21, 2021-22, 2022-23
  • Multi-Year Projection does not include cuts, but assumes $2 Million transfer from Fund 40 in 2022-23 to maintain reserves
  • The district's "SB 858 Reserve Level Disclosure" is included with this agenda item
  • Following state budget deal on June 18, revenues will be updated in August to reflect 0% COLA

N.2.a. Resolution 20-35 Education Protection Account
Rationale:

School districts receive Education Protection Account (EPA) funding as part of their Local Control Funding Formula revenue each year.  The EPA was approved by California voters in 2012 (Proposition 30) and extended in 2016 (Proposition 55).  Districts are required to adopt an annual resolution regarding how EPA funds are used and post an accounting of that usage on the district website.

The attached resolution and accounting are presented to the Board for approval.

In previous years, accounting for EPA funding has been straight forward.  However, this year the state is not able to fully fund EPA at the level that has been allocated.  The state also has not notified districts of what actual 2019-20 funding will be. Lacking that information, ACOE has suggested that districts indicate 50% funding using the attached template.  Because of that estimate, a future EPA update may be necessary.

Because EPA is part of the district's overall LCFF revenue, the reduction of EPA funding will result in the increase of State Aid, but that true-up of LCFF will likely not happen until the next fiscal year.

Recommended Motion:
Approve Resolution 20-35 regarding the district's Education Protection account funding for 2019-20 (estimated actuals) and 2020-21 (budget).
Financial Impact:
There is no direct impact from Resolution 20-35.

O.5.c. Citizens' Bond Oversight Committee Annual Report
Rationale:

The bylaws of the district's Citizens' Bond Oversight Committee require an annual report to be prepared that is summarized to the Board in public session.  The attached report was presented to the May 7 CBOC meeting and approved by its membership.

Because the CBOC Chair is unavailable during the June 23 meeting, and because the meeting is being held virtually, the report is being presented to the Board for acceptance.

The report summarizes the Measure J1 work that has been completed and is in process, and finds that the district is in compliance with applicable laws and regulations pertaining to funds being used for the purposes specified in the original Measure J1 ballot language.

Pending acceptance by the Board, the report will be posted on the district website.
