District staff is presenting the Second Interim Report for 2020-21 for Trustee consideration. The district is self reporting a positive certification based on ability to meet financial obligations this year and the next two years. District staff used the higher Department of Finance assumptions for the 2022-23 Cost of Living Adjustment (2.98%) rather than the lower School Services of California assumptions (1.28%) in developing the Multi-Year Projection (MYP). Even with the higher COLA, the MYP estimates an annual decrease of the unrestricted ending fund balance prior to inclusion of any negotiated salary agreements.

Measure J1 was approved by District voters in 2016 authorizing a total of $104M in bonds for school equipment and facility improvements, and $3,250,000 remains unissued as of this date. At this time the District desires to issue a final series of Measure J1 Bonds for additional voter-approved projects. The Resolution authorizes the issuance of up to $3,250,000 pursuant to the Government Code, as tax-exempt bonds, in the form of current interest bonds only (no capital appreciation bonds), all in accordance with requirements of law and Measure J1. The District also has the opportunity to refinance its outstanding Election of 2010, Series A General Obligation Bonds, by capturing lower interest rates that are available in the bond markets. The second Resolution listed above authorizes the issuance of up to $30 million in refunding bonds pursuant to the Government Code, provided that savings can be achieved and that the final term of the prior bonds is not extended. The Bonds will be issued as tax-exempt bonds, in the form of current interest bonds only (no capital appreciation bonds).
Both Resolutions authorize the bonds to be underwritten through a negotiated underwriting with the investment banking firm of Piper Sandler & Co., which will purchase all of the bonds and have the responsibility for placing them with investors. The Bonds will be marketed to potential purchasers through a disclosure document called the Preliminary Official Statement. Back-up documentation which will continue to be refined by the financing team working with District staff to ensure they comply will all requirements including securities law standards are attached. The San Leandro Unified School District is generating a total of approximately 1,600,000 kilowatt hours (kWh) of electricity annually at its solar arrays at SLHS and John Muir Middle School/Adult Education. Our solar energy provides approximately two-thirds of our district's total electrical needs. We have been benefiting from the reduced cost of electricity that we need to purchase annually. In the last few years a market has been developing around the sale of Renewable Energy Certificates (REC's) which can be purchased by companies looking to offset their own carbon dioxide emissions. The market value of the district's REC's is not large (approximately $10,000 per year for a five year contract). But the funds could be used to help offset the cost of the Sun Power maintenance agreement. An energy broker named Karbone approached the district to offer the sale of our REC's to various companies. A company called BTR Energy offered the highest price ($7.00 per REC or megawatt hour). The proposed contract is five years. BTR Energy will do most of the work around registration of the REC's and entering data. BTR Energy would pay Karbone's brokerage fee directly. There is very little work or risk for the district. The total value of the contract is approximately $50,000 over 5 years. |

A Declaration of Need must be approved at a public meeting of the Board of Education certifying that there is an insufficient number of certificated persons who meet the district's specified employment criteria for the positions listed on the attached form. The Declaration of Need allows the District to hire fully credentialed teachers with limited assignment or emergency permits in the shortage areas such as Mathematics, Science, Special Education and CLAD. The District is declaring that it has implemented a process for conducting a diligent search that includes distributing job announcements, attending job fairs, and contacting college and university placement centers. The District is also certifying that it made a reasonable effort to recruit fully credentialed teachers. Upon board approval of the recommendation, documents will be forwarded to the Commission on Teacher Credentialing.
