| Approve the Title III Year 4 English Learner Plan |
| In accordance with the Elementary and Secondary Education Act (ESEA) Act of 2001, school districts that have not met Title III Annual Measurable Achievement Objectives (AMAOs) for four consecutive years are subject to sanctions pursuant to ESEA Title III requirements. The English Learner population in SLUSD has not met the English Language Arts CST (California Standards Test) target for the last 4 years, and consequently is subject to these sanctions. In addition, in 2010-11, SLUSD did not meet the identified targets for AMAO 1, AMAO 2 (5 years or more cohort) and AMAO Mathematics CST.
As a Title 3 Year 4 district, SLUSD is required to develop a Title III Plan that begins with a comprehensive needs assessment, establishes goals and specifies a set of research-based strategies, activities and tasks to address the needs of our English Learners. Our plan delineates high leverage strategies, action steps and tasks designed to increase English Learner student achievement.
The plan must be approved by the Board and then submitted to the California Department of Education by January 23, 2012. |

The San Leandro Unified School District has hired Van Iwaarden Associates to perform an actuarial valuation of the District's Other Post Employment Benefits (OPEB). A report has been completed. Mr. Jim Van Iwaarden presented the Board the results of the study. Highlights of the presentation included:
- OPED refer to benefits other than pension benefits.
- The required implementation period is based on annual revenues from $10 million to $100 million. San Leandro Unified implemented this in 2008-09.
- As part of the process to meet the requirement of GASB 45 is to have actuarial valuation to establish the required Annual Required Contribution (ARC). The ARC is the sum of the normal cost of the year (the present value of future benefits being earned by current employees) plus amortization of the unfunded actuarial accrued liability (benefits already earned by current and former employees but not yet provided for).
- It is recommended that districts do an actuarial study every two years to ensure that the ARC is in line with the financial projections. This would apply more appropriately to district that pay health benefits for their actuarial and retired employees.
- Since San Leandro USD does not pay health benefits to active employees and has restricted health benefit contributions to retirees based on certain criteria per contract language with the various bargain groups, the District's liability projects have not been impacted much by the actuarial study.
- San Leandro Unified participants valued as of July 1 has reduced from 279 (active with coverage and retirees) in 2007-2008 to 233; thus the actuarial accrued liability has also reduced from $7,533,000 million to $6,585,557.
|

The San Leandro Unified School District has hired Van Iwaarden Associates to perform an actuarial valuation of the District's Other Postemployment Benefits (OPEB). A report has been completed. A representative from Van Iwaarden Associates will be presenting to the Board the results of the study.

| Approve the final 2011-12 Actuarial Study for Governmental Accounting Standards Board (GASB) Statement No. 45. |
| Not Applicable |
| State of California Constitution Article XIII-B |
| Governmental Accounting Standards Board (GASB) Statement No. 45 requires state and local governments including school districts to account for and report Other Post Employment Benefits (OPEB). OPEB refer to benefits other than pension benefits. The required implementation period is based on annual revenues from $10 million to $100 million. San Leandro Unified School District implemented this in 2008-09.
As part of the process to meet the requirement of GASB 45 is to have an actuarial valuation to establish the required annual required contribution (ARC). The ARC is the sum of the normal cost for the year (the present value of future benefits being earned by current employees) plus amortization of the unfunded actuarial accrued liability (benefits already earned by current and former employees but not yet provided for). The board approved Van Iwaarden Associates to prepare the actuarial valuation report for 2011-12 on September 7, 2011. The cost of the contract is $9,650 to be paid out of Fund 67, Self Insurance Fund.
It is recommended that districts do an actuarial study every two years to ensure that the ARC is in line with the financial projections. This would apply more appropriately to districts that pay health benefits for their active and retired employees. Since San Leandro USD?s does not pay health benefits to active employees and has restricted health benefit contributions to retirees based on certain criteria per contract language with the various bargaining groups, the District?s liability projections have not been impacted much by the actuarial study.
It is recommended that the Board approve this actuarial study report.

| Adopt Resolution No. 12-05 National No Name Calling Week, January 23-27, 2012 |
| Board Policy 5145.3 Non-Discrimination/Harassment |
| All schools in the San Leandro Unified School District are working diligently to ensure that every school and every classroom is free of all forms of bullying. National research and mental health organizations tell us that every year, students of all ages in schools across the nation encounter various forms of bullying such as physical bullying (hitting and/or punching), verbal bullying (teasing or name calling), emotional bullying (intimidation through gestures or social exclusion) or cyber bullying (sending insulting messages by phone or computer e-mail). Victims of bullying can suffer long term negative effects. Each year all schools receive information and curriculum resources to address this issue from the www.nonamecallingweek.org website. To solidify the District?s continued commitment to creating safe, respectful, and inclusive schools and classrooms, staff is recommending the Board of Education adopt a resolution in support and to ensure the District?s schools? participation in ?National No Name Calling Week? (January 23-27, 2012) and promote anti-bullying messages and practices through this national event. |

| Approve Proposed Changes to Board Policy 1312.3 Uniform Complaint Procedures and Exhibit E(3)1312.3 (c-d) Uniform Complaint Procedures Complaint Form |
| Board Policy Committee on December 13, 2011 |
| Education Code 200 and 220 and Government Code 11135 |
| Periodically, districts review Board Policies to ensure that they are clear and concise and that they adhere to Education Code and state and federal requirements. The State of California has mandated that "genetic information" be added to the protected groups listed in this policy. To that end, Board Policy 1312.3 and Exhibit E(3)1312.3(c-d) have been updated to ensure clarity and compliance.
Genetic information includes information about an individual?s genetic tests and the genetic tests of an individual?s family members, as well as information about the manifestation of a disease or disorder in an individual?s family members (i.e. family medical history). Family medical history is included in the definition of genetic information because it is often used to determine whether someone has an increased risk of getting a disease, disorder, or condition in the future. Genetic information also includes an individual's request for, or receipt of, genetic services, or the participation in clinical research that includes genetic services by the individual or a family member of the individual, and the genetic information of a fetus carried by an individual or by a pregnant woman who is a family member of the individual and the genetic information of any embryo legally held by the individual or family member using an assisted reproductive technology.
The Uniform Complaint Procedures are followed when addressing complaints alleging unlawful discrimination against any protected group as identified under Education Code 200 and 220 and Government Code 11135. The Uniform Complaint procedures are also followed when addressing complaints alleging failure to comply with state or federal law in programs as identified in the policy. |

| Approve Proposed Changes to Board Policy 5145.31, Administrative Regulation 5145.31 Hate Motivated Behavior, and Exhibit E 5145.31 Suspected Hate Motivated Behavior Incident Report |
| Board Policy Committee, December 13, 2011 |
| Education Code 200 and 220 and Government Code 11135 |
| Periodically, districts review Board Policies and Administrative Regulations to ensure that they are clear and concise and that they adhere to Education Code and state and federal requirements. The State of California has mandated that "genetic information" be added to the protected groups as identified under Education Code 200 and 220 and Government Code 11135. To that end, Board Policy 5145.31 and Administrative Regulation 5145.31, Hate Motivated Behavior; and Exhibit #5145.31 Suspected Hate Motivated Behavior Incident Report, have been updated to ensure clarity and compliance.

| Approve the Agreement between the American National Red Cross and the San Leandro Unified School District |
| Not applicable |
| Not applicable |
The American National Red Cross is a not-for-profit corporation chartered by the United States Congress which provides services to individuals, families and communities when disaster strikes. The disaster relief activities of the Red Cross are made possible by the American public, as the organization is supported by private donations and facility owners who permit their buildings to be used as a temporary refuge for disaster victims. This agreement is between the Red Cross and the San Leandro Unified School District and although it is separate from the City and Red Cross agreement, it reflects the strong partnership between the City and the District.
In the event of a disaster, the City will of course use city property first. However, as required by state law schools must be made available for shelter use, if called upon. Under this agreement, all schools in the San Leandro Unified School District could be called upon for use as a shelter depending upon the magnitude and/or location of a disaster.
This agreement addresses such content as use of facilities, shelter management, food services, custodial services, security, etc. The agreement is attached. The agreement has been reviewed by City legal counsel. |

Amendment #6, in the amount of $7,000, is being recommended for approval at the January 10, 2012 Board Meeting.
This amendment #7, in the amount of $7,000, provides for additional services that were needed to complete the work in phase one of the CTE project. During the course of executing the project the general contractor had challenges in coordinating all the various tasks involved extending the amount of time expected for the abatement. Additionally, some hidden and therefore unforeseen conditions were discovered during the demolition portion of the project. To accomplish the work in the short summer time period it became necessary to involve more than one hazardous material abatement contractor. The fee reflects additional review of the second contractor?s certifications as well as more oversight and monitoring visits required due to an extended abatement schedule.

| Staff recommends that the Board of Education approve the revised San Leandro Unified School District Community Service Facility Use Fees Schedule, effective January 1, 2012. |
| Facilities & Technology Committee Meeting - December 21, 2011 |
| BP1330(a)
Education Code 38130-38139
|
In keeping with Board Policy BP1330 (a) and Education Code 40040-40047 Civic Center Use Act: use of school property for public purposes, San Leandro Unified School District makes available to the public use of its fields and facilities.
The District offers two user classifications:
Class 2 organizations are local, non-profit groups not directly affiliated with the District which are sponsoring activities for the benefit of their membership and/or soliciting fees/ funds; e.g. City of San Leandro and other public agencies, sport groups, homeowners associations, etc.
Class 3 includes individuals or private groups engaged in fund raising or profit-making activities, the profits of which will not be expended for the welfare of the District's students.
The current fee schedule, with the exception of ?YOUTH/BASEBALL/SOCCER? was approved by the Board of Education at a regular Board meeting held on October 18, 2005, and went into effect on January 1, 2006.
The ?YOUTH/BASEBALL/SOCCER? fee was revised in February 2010. Even with the revised fee, our District has some of the lowest fees in Alameda County. We currently charge $1.00 per 1 ? hours (90 minutes) of use for youth soccer (as a comparison, San Lorenzo Unified School District charges $11.98 - $25.08 per hour for soccer field rentals).
The City of San Leandro recently raised their softball and baseball facilities fees to $5 for 1 ? hours (90 minutes) of use. The District would like to align the soccer field fees with the City of San Leandro. |

| Approve the Revised San Leandro Arts Education Center Facility Checklist & Rental Fees Schedule. |
| Facilities & Technology Committee December 21, 2011 |
| BP1330(a)
Education Code 38130-38139
|
In November 2006, San Leandro voters passed Measure B, a $109 million school facilities bond that is providing new construction to address overcrowding at San Leandro High School and modernization projects at all school sites throughout the San Leandro Unified School District. One of the major new construction projects is the creation of a beautiful new state-of-the-art Arts Education Center (AEC) at San Leandro High School. In addition to classrooms, the AEC has a 552-seat theater for school and community use.
On April 5, 2011, the Board of Education approved a Facility Checklist & Rental Fees Schedule that provided three user categories:
No Cost; Direct Cost (Non-Profits and Public Agencies) and Commercial (Fair Market Rental). Although the No Cost did not charge a rental fee, direct costs (coordinator, technician, contractor, custodial services and supplies, etc.) associated with the use were charged at a deeply discounted price.
The ?No Cost? wording has caused some confusion among users, who often do not take into account the staffing and supplies needed for their events. In order to avoid any misunderstandings in the future, staff has revised the fee schedule.
In addition, the District benefits from the existence of foundations whose sole purpose is to support our students and schools. Staff identified the need for an additional category that would offer these foundations additional discounts.
In order to create a self-sustaining theater and minimize the financial impact of the theater on the District?s General Fund, and keep costs low for SLUSD users, non-profits and public agencies, and in keeping with Board Policy BP1330 (a) and Education Code 40040-40047 Civic Center Use Act: use of school property for public purposes, the revised Rental Fee Schedule offers four user classifications:
1. Direct Cost ? Group A
- SLUSD Schools
- PTA/PTSA or other school-associated parent/teacher/student associations
- Student Body Clubs
- School employees in the performance of their duties
2. Direct Cost ? Group B
- Foundations directly benefiting SLUSD schools and students
3. Direct Cost ? Group B
- Non-Profits
- Community Based Organizations
- Public Agencies
4. Commercial (Fair Rental Value)
The fee schedule strives to balance the need to have the theater not encroach on the General Fund with the needs of the various groups who might use the theater. |

| Approve funding up to $10,000 of the Theater Facility Supervisor's salary to free up SLED funds to hire an individual to market the theater. |
| Finance Committee meeting December
Facility & Technology Committee meeting December 21, 2011 |
| The Arts Education Center officially opened in April, 2011. Through the generous funds from the San Leandro Education Foundation (SLED) & Friends of the Theater (FOTT), the District was able to hire a part time Facility Theater Supervisor. It was the intention that the supervisor would handle all duties related to operating the theater including, but not limited to, technical advice and support for all performances taking place in the AEC, meeting with current and potential users to ensure their productions are successful, maintaining the AEC website, providing training to volunteers, staff and students, providing tours, providing technical support (sound, lighting, production) for clients, ordering supplies, and generally ensuring that the facility is managed effectively and efficiently. It was also the original intention that the Facility Supervisor would also market the use of the theater to internal and external stakeholders and community businesses and organizations.
The demand for the theater requires a full time position, but with limited funds, this is not a possibility at this time. What is clear is that the Supervisor cannot fulfill all of the responsibilities of his position and perform the marketing that is needed to promote and rent the theater to generate funds needed to maintain it year-round.
The District has been in conversations with SLED/FOTT to explore the possibility of hiring an individual to market the theater on a limited term basis. SLED is interested in supporting all efforts to help the theater be self-sustaining. However, SLED is not in a position currently to commit additional funds to cover the cost of marketing. It is recommended that the District commit no more than $10,000 toward the salary of the Theater Facility Supervisor and thus free up $10,000 from SLED's financial commitment so that SLED can fund the cost of hiring someone to market the theater.
From a financial perspective, SLED's total contribution remains the same, and rather than pay 100% of the supervisor's part time salary they will pay $10,000 less which will be picked up by the District. The time period for this arrangement will be through June 30, 2012 at which time both SLED and the District will need to reevaluate the financial situation. The goal of this proposal is to invest an amount not to exceed $10,000 that will generate enough rentals of the theater to minimally maintain the half time position, or to potentially cover the cost of a full time supervisor, and help ensure that the theater is self-sustaining.

She will forward the email to the new alternate Trustee James. She referred to an email regarding a group dental plan that she received and will forward it on to the Superintendent.
Trustee Prola commented that the Governor's budget makes the transitional Kindergarten optional but it doesn't fund it.
Trustee James commented on several articles he read regarding education though Internet needs/uses, reporting that in normal education environments, 57% of the students become proficient, while in Internet classrooms or at home, etc, 27%. He is looking forward to a good year and a possible parcel tax.

The production of Christmas Carol at the Arts Education Center was spectacular.
Trustee Katz-Lacabe drew the Board's attention to an upcoming observation event of the year, on June 6, 2012, when we have a second opportunity (the first occurrence was in June 2004) this century to view the transit of Venus across the face of the sun. He is currently working with the Roosevelt Elementary Dads Club, but would like to see the District consider joining the City to make this a community event. He has also been in contact with NASA and the East Bay Astronomical Society regarding curriculum and representatives coming to school sites to talk to the students. Special glasses with a solar filter can be purchased so that students can view directly into the sun.
Trustee Carey encouraged the Board to continue to "Eat Out for Education" supporting the San Leandro Education Foundation.
