Assistant Superintendent Song Chin-Bendib presented the audit report related to the District financial statement for the year ending June 30, 2011 (2010-20122) as prepared by Crowe Horwath LLP, the new name of the District's independent auditor (Perry-Smith LLP merged with Crowe Horwath in November 2011) who originally was scheduled to make the presentation; however, illness and a heavy schedule prevented the availability of a substitute.
The audit report includes the District financial statements, supplemental information, auditor's opinions on the financial statements, federal compliance, and state compliance. Also included in the presentation was the Performance Audit on the Measure B Bond funds, which was shared with the Citizens Bond Oversight Committee (CBOC) on January 19, 2012. This is the second year that the auditors have conducted a "Performance Audit". Effective January 1, 2011, the new Government Auditing Standards provided a correction of language in Proposition 39 upon which the Measure B bond was passed. The new language defined the audit process from the Agreed Upon Procedures to a "Performance Audit". A Performance audit requires the independent auditor to randomly select the sample of expenditures using a statistical methodology that provides high accuracy and and a wide range of transactions. The independent auditor selected a sample size of 56 expenditures totaling $11,623,379 to review, showing that for the fourth year all expenses were appropriate and the District, once again, continues to have consecutive excellent audit reviews. |
Goal #2: Ensure the Financial Stability and Efficiency of the District

Assistant Superintendent Business & Operations, Song Chin-Bendib, gave a PowerPoint presentation on Governor Brown's proposal for 2012-2013 State Budget and K-12 Education. The presentation included the impact of the Governor's proposed budget on the San Leandro Unified School District. This presentation showed the impact on the District's Revenue Limit and other relevant fiscal information from the proposal and included the Budget Development Timeline. Key points included:
California's education funding remains at risk for the 5th straight year:
- State funding for education in California has been cut by 16 percent since 2008
- Education has contributed about $7 billion per year to help resolve the state's budget crisis - a total of $35 billion
- Lost to SLUSD over this five year span is approximately $12 million
Governor Brown's proposed budget for 2012-2013 state budget assumes voters approve a $6.9 billion tax measure. The proposal is a mix of cuts and revenue enhancements, with temporary tax increases from 2012 through 2016 tax year:
- All new revenue goes in the Education Protection Account (EPA) for K-12 schools (89%) and community colleges (11%); EPA allocations may not be used for salary or benefits of administrators or any other administrative costs
- It provides no additional spending for education, but maintains revenue at about 2011-12 pre-trigger cut levels
- Income tax would increase 1% for income above $250,000; and 2% for income above $500,000 for single filers; and 1% for income above $500,000 and up to 2% for income over $1 million for joint filers. for head of household, there would be an increase of 2% for income above $680,000. Sales and use tax increase of 0.5%, effective January 1, 2013, to expire January 1, 2018.
- This would result in flat funding for schools (but only if new temporary tax increases are passed in November)
- Home-to-school and special education transportation funding is totally eliminated on an ongoing basis whether the initiative passes or not
- No 2012-2013 COLA ($1.4 million loss for SLUSD)
If Governor Brown's tax increases are not approved
- Governor Brown proposes to cut K-14 education by $4.8 billion. This would result in midyear cuts (effective January 1, 2013 ) of $2.4 billion for K-14 education, or about $370/ADA (average daily attendance) on going.
- The hit to SLUSD is approximately $3.1 million - equal to the loss of about three weeks of instruction
During the discussion, the Board expressed their concerns regarding the declining revenue for schools. President Mack-Rose noted that the Board needs to go forward as if the tax measures will pass, but the finance committee must come up with contingency budgets in case it fails, adding that the Board Finance Committee will meet on January 31, 2012, to develop recommendations. |
Goal #2: Ensure the Financial Stability and Efficiency of the District
The Assistant Superintendent Business & Operations, Song Chin-Bendib, will give a power point presentation on Governor Brown's proposal for 2012-2013 State Budget and K-12 Education. The presentation will include the impact of the Governor's proposed budget on the San Leandro Unified School District. This presentation will show the impact on the District's Revenue Limit and other relevant fiscal information from the proposal and will include the Budget Development Timeline. |

| Adopt Resolution No. 12-06 Proclaiming February 2012 as African American History Month |
| Not Applicable |
Each year, the month of February is proclaimed African American History Month to raise awareness and honor the contributions and accomplishments that African Americans have made to our history and culture. This year's theme, "African Americans and the Civil Wars," honors the efforts of people of African descent to eliminate slavery and inaugurate universal freedom in the United States. The theme, chosen by the Association for the Study of African American Life and History, urges all Americans to study and reflect on the value of African American contributions to the nation.
We have encouraged all school sites to prepare and present activities describing the countless ways African Americans have contributed to our nation and our society. Teacher-developed materials, activities, and professionally prepared materials are used with our K-12 students throughout the year with special emphasis during African American History Month. |

| Approve School Accountability Report Card (SARC) Addendum to the Current Contract for 2011-2012 School Year with Axiom, Inc. |
| Not Applicable |
| Education Code Section 35256
|
| Education Code (EC) Section 35256 mandates school districts in California annually prepare for each school within the district a School Accountability Report Card (SARC) that contains the items described in EC Section 33126, to publicize the SARCs, and to notify parents or legal guardians of students that a copy of the SARC will be provided on request. Districts frequently seek the expertise of an outside consultant to produce the SARCs as one way to ensure full compliance with complex state and federal mandates (SB 556, 1632, 1665, AB 568, 572, and PL 107-110, including Williams Case). The district will seek reimbursement of funds under the state?s Mandated Costs Programs, if the funds become available.
Educational Services recommends the Addendum to the current SARC contract with Axiom, Inc. which was approved on May 9, 2009, for completion of the 2010-2011 SARCs in our current school year of 2011-12. All past contract services for the SARCs were satisfactorily performed by Axiom. Since the current contract remains in effect unless canceled, only an Addendum must be approved for the 2011-2012 school year. Axiom will produce a fully compliant SARC in both English and Spanish for all school sites and at the same cost as last year. SARCs are produced for the prior year. The deadline for completion of the 2010-2011 SARCs is February 1st.

| Approve the independent audit contract with Vavrinek, Trine, Day & Co., LLP (VTD) as the audit firm for the 2011-2012, 2012-2013 and 2013-2014. |
| None Applicable |
| Education Code Section 42000 |
| The State of California requires that school districts have an annual independent audit conducted in accordance with auditing standards generally accepted in the United States of America. The standards are financial and compliance audits contained in the ?Government Auditing Standards? issued by the Comptroller General of the United States, OMB Circular A-133, Audits of States, Local Governments, Non-Profit Organizations, and ?Standards and Procedures for Audits of California K-12 Local Educational Agencies?, as prescribed by the State of California.
Every three years, a school district is strongly recommended to switch audit firms or minimally audit partners. If the District does not switch to a new audit firm, the District should request for a change of partner to lead the audit project.
The San Leandro USD?s audit contract with Perry-Smith LLP expired on June 30, 2011. The District went out for a Request For Proposal (RFP) for audit contracts in October, 2011. The deadline was October 25, 2011. Four firms responded with one declined to submit a proposal due to their full schedule. Of the four complete proposals, Vavrinek, Trine, Day & Co, Inc., has the lowest cost with the cost breakdown as follows:
2011-2012 $39,700 (General $33,600; Measure B & M $6,100)
2012-2013 $40,550 (General $34,250; Measure B & M $6,300)
2013-2014 $41,500 (General $35,000; Measure B & M $6,500)
The cost of the performance audit work for Measures B and M has been differentiated as above.
Staff is recommending the audit firm of Vavrinek, Trine, Day & Co., LLP (VTD) to plan and perform the independent external audit. VTD is well known in the industry and is a reputable firm.
The scope of the audit is to obtain reasonable assurance about whether the financial statements are free of material misstatement, material errors, fraudulent financial reporting, or misappropriation. The audit will be conducted under the guidelines of the audit standards listed in the first paragraph above.

| Approve Amendment #3 for $18,810 to the AEDIS Architects Design Services Contract for Painting and Lighting Scope at Washington Elementary School to Include Buildings C & E. |
| Facilities and Technology Committee: November 22, 2011. |
The Board of Education previously approved AEDIS Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond. The original Contract was entered into on September 6, 2007, between AEDIS Architects and San Leandro Unified School District to provide architectural design services for painting and lighting modernization at San Leandro High School (SLHS), McKinley, Roosevelt, and Washington Elementary Schools.
Subsequently The Board approved:
- Amendment #1, in the amount of $470,654, on November 6, 2007, which added modernization at Bancroft Middle School to the scope of the contract.
- Amendment #2, in the amount of $121,532, on December 14, 2010, which added classroom painting and lighting upgrades at Garfield and Monroe Elementary Schools.
This amendment #3, in the amount of $18,810, provides architectural design services for classroom painting and lighting upgrades at Washington Elementary School to include buildings C & E. During the initial scoping process for Measure B, portable classroom buildings were considered by staff and the Board for upgrades, but due to their interim nature it was deemed prudent to invest in permanent buildings only. During the design phase for classroom painting and lighting at Washington Elementary School, District and AEDIS staff has reconsidered their classification of modular classroom buildings C and E. Although they are portable classrooms they are modular buildings and more ?built in? than standard portables. They have elevated ?boardwalk? entries with overhead canopies and are supported by conventional concrete foundations. The Measure B team has reconsidered their initial opinion on how interim these buildings are and now recommend the painting and lighting upgrades.
To assure that the priority ranking of improvements followed the same methodology used during the Measure B scoping process staff reviewed the integrity of other building C and E systems as well. The Maintenance Department has confirmed that systems such as heating are performing as well as should be expected and therefore supporting the recommendation for painting and lighting investments.

| Approve Amendment #8 for $208,540 to the Career Technical Education (CTE) Project Design Services Contract with AEDIS Architecture & Planning to provide construction documents and construction administration for Phase 2 of the Project. |
| Facilities and Technology Committee: January 11, 2012. |
The Board of Education previously approved AEDIS Architecture & Planning, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond, The $109 million school facilities bond which was passed by San Leandro voters in 2006.
The original Contract between San Leandro Unified School District and AEDIS Architecture & Planning and to provide architectural design services for the Career Technical Education/Industrial Arts Renovation Projects was entered into on September 6, 2007.
In April 2008, the District was notified that it would be receiving three Career Technical Education (CTE) State matching grants in the amount of $4.5 million (total), for the wood, metal, and auto shops building renovation project, thereby increasing and enhancing the original scope of work. In order to fully benefit and expend all of the CTE State matching funds, an additional year and $2 million in construction work has been added. What began as a modest remodel project is now developing into a state-of-the art Career Technical Education Center.

| Approve Amendment #1, in the amount of $71,464, to the Architectural Services Agreement with AEDIS Architects for the San Leandro Unified School District Sports Complex and Burrell Field. |
| Facilities and Technology Committee: January 11, 2012 |
On March 1, 2011, the Board of Education approved AEDIS Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure M Bond.
On March 15, 2011, the Board approved the AEDIS agreement in the amount of $1,075,125 to provide design services for the San Leandro Unified School District Pacific Sports Complex and Burrell Field.
On March 22, 2011, the first of several Conceptual Design Team meetings was held to gather design ideas from District staff, user groups, and community members. During the subsequent four meetings input was received that a designated children?s play area should be incorporated into the design. Additionally, after investigation into the abandoned irrigation water well staff developed a recommendation that the well be renovated. Resurfacing the well will provide water resources for the grass fields and this save on operational costs.
The play area and well were not initially included in the project scope or budget. Staff is recommending that the potential work be designed into the project and offered as additive alternates in the public bid process with the hope that the bid climate will be favorable so the scope will fit within the budget.
The typical process of review is to present the draft amendment to the Facilities and Technology (F&T) Committee to obtain a recommendation for full Board approval. However, due to scheduling conflicts only one committee member was available for the scheduled meeting. Due to time constraints the Amendment is being brought directly to the Board for approval without full committee review.
This amendment #1, in the amount of $71,464, provides for the design of both the children?s play area and renovations to the irrigation water well.

| Approve the Memorandum of Understanding between the City of San Leandro and the San Leandro Unified School District for Measure M Improvements on City of San Leandro Property at the Pacific Sports Complex and Burrell Field. |
| Facilities and Technology Committee: December 21, 2011. |
On March 15, 2011, the Board approved the Design Services Contract with AEDIS Architects for the "Pacific Sports Complex and Burrell Field."* A Conceptual Design Team (CDT) was convened on March 22, 2011, to provide input to AEDIS Architecture & Planning. After the initial meeting, the CDT met four more times. Based on the input of the CDT, AEDIS developed the conceptual plan which was approved by the Board on May 17, 2011.
The conceptual plan indicated a new primary entry drive between the south end of Burrell Field and the existing City of San Leandro Ball Park. The driveway would provide access to a parking area, the Burrell Field entry plaza, and the San Leandro Ball Park. The driveway and parking would also service the City of San Leandro baseball diamond. In order to create the most efficient entry design, inclusion of a relatively small triangular piece of the City of San Leandro Ball Park property was considered. Inclusion of this small piece of land would maximize the use of the area between the City of San Leandro Ball park and the new project.
A series of collaborative discussions between the City of San Leandro and the San Leandro Unified School District, and at the City of San Leandro/San Leandro Unified District Liaison Committee meetings produced agreement on the concept. Additionally, staff was provided direction to create a draft Memorandum of Understanding to allow the necessary improvements.
Attached is the proposed Memorandum of Understanding, which was presented by City staff at the Tuesday, January 17, 2012, City Council Meeting, and approved.
Based on the verbal agreement regarding land use, and in order to comply with the District?s construction timeline, construction documents submitted to the Division of the State Architect (DSA) have already incorporated these improvements. This is to formalize the agreement between the City of San Leandro and the San Leandro Unified School District regarding the District?s development through Measure M of this piece of City-owned property.
* It should be noted that the attached document represents the agreement between the City and the District regarding land use and does not represent a formal Title agreement regarding the name of the complex. The agreement approved by the City Council uses the term ?San Leandro Sports Complex? collectively for the three areas of land (San Leandro Ball Park, Burrell Field, and Pacific Recreation Complex). The Board will officially determine the complex title at a future meeting. |

| Receive for information the Williams Uniform Complaint Procedures (including Valenzuela Settlement Requirement) Quarterly Report for October-December, 2011 |
| Not Applicable |
| California Education Code Section 35186 |
| The regulations of the Williams lawsuit settlement require school districts to complete ?Quarterly Complaint? reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and misassignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). This legislation requires that districts offer services for two consecutive years following grade twelve to students who did not pass the CAHSEE by the end of their 12th grade. Additionally, the legislation requires that students and families have the opportunity to file a complaint against the District for not fulfilling this requirement. Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required.
For the period October-December, 2011, the District did not have any complaints. |

Prior to Board comments, Trustee Mack-Rose Trustee Mack-Rose noted the following changes to the meeting calendar:
-
- The February 14, 2012, Board Workshop has been cancelled
- There will be a Special Board meeting on February 28, 2012
Trustee Katz-Lacabe announced that Monroe Elementary School would be hosting a crab feed on Saturday, January 28.

On a personal note, he announced that his daughter was accepted to Colorado University.
Trustee Prola attended the 2012 Community Schools Forum along with Trustee Mack-Rose on January 19, explaining that using public schools as a hub, community schools bring together special services such as health, mental health, career counseling, etc. for students and families and coordinate grants from different community organizations who want to support public schools. She hopes to hear more about this concept and that San Leandro may participate.
Trustee Sullivan commented on the huge cuts at the elementary and secondary level, reminding the Board to keep in mind that these "financial hits" also impact colleges and universities.
Trustee Almonte commented that since he previously reported that he would be unable to attend any of the regular or special Board meetings from February 1 through February 24, 2012, his plans have changed and he will be able to attend any meetings from February 1-14. He also asked for, however did not receive, consensus for the Board to present San Leandro Police Officer Josh Brum for his heroism in saving the life of a woman that was in a near-death collision with an Amtrak train. The Board felt that noting in the minutes that they recognized Officer Brum for saving a life would be more appropriate. He also invited everyone to come to the San Leandro Main Library on February 4, 2012, from 11-3 p.m. for the Lunar Year Events. The Asian Community Cultural Association which he is currently serving as one of the Board of Directors, will host a free Asian arts and crafts session for children.
Trustee Carey reminded the Board that on February 3, the San Leandro High School United Parents will be hosting a fundraiser at Drakes Brewery.
Trustee Mack-Rose attended the School Services of California Governor's Proposed Budget Workshop in Sacramento with the Superintendent and Assistant Superintendent Song Chin-Bendib, the 2012 Community Schools Forum with Trustee Prola and the San Leandro Chamber Installation dinner. She commended the Superintendent on her presentation for the Chamber and congratulated her on being the recipient of the "Leader in Education". She commented that "every cut that the state is taking is impacting schools; however, good things are happening in our schools and classrooms and she doesn't want us to lose sight of that," reminding the Communication Committee Chair Katz-Lacabe of the need to schedule a meeting. |
