The Conflict Managers shared how they foster a positive school climate through their conflict mangement program, whose motto is "Increase the Peace," by demonstrating a role play where one student asks to play with another, who refuses, leading the student whose offer to play was rejected to ask, "Could we talk with a Conflict Manager," and the other agreeing. The chorus calls out, "Conflict Managers!" and a meeting on the playground takes place between the two students in conflict and two Conflict Managers, who ask each students a few questions to help them express how they feel and come to a solution. All of the Board members commended the students for their work as Conflict Managers, listing many of the important qualities and skills they are learning through the program, such as leadership, negotiation, problem solving, empathy, and relationship building. Trustee Rosato thanked SLED for all of their great work; however, he asked that the Board postpone approval of this item and refer the matter to the Policy Committee for review so that it would allow the incoming Superintendent deference to make the MOU with his/or her own Cabinet; would enable the consistency and equity publicly among all of our foundations; and would comply with his second request regarding putting the District policies in the current audited compliance. There was a brief discussion regarding Trustee Rosato's request with Trustee L?pez asking for clarification on the MOU process. Superintendent Cathey explained that it is not our normal practice to take MOUs to the Policy Committee, however, noting in the case of the MOU for the San Leandro Sports Foundation which is very different than the SLED MOU because it is about advertising as it relates to Burrell Field only, a draft MOU for the San Leandro Sports Foundation (SLSF) was provided to the Facilities/Technology Committee and as soon as the details can be worked out, that MOU will be coming to the full Board for approval. A motion was made by Trustee Rosato and seconded by Trustee L?pez to refer the SLED MOU to Committee; however, the motion did not pass by a 2-5 vote. Trustees Rosato and L?pez voting yes to the motion and Trustees Carey, James, Katz-Lacabe, Prola, Toro voting against it. Board of Trustees
    Quick Summary / Staff Recommendation
Adopt Resolution No. 13-28 Support for the Governor's Proposed Reform to the K-12 Financing System Referred to as Local Control Funding Formula.
    Background Information
The Governor of the State of California has taken a bold step by proposing to restructure the current K-12 financing system, referred to as Local Control Funding Formula (LCFF). The funding formula is based upon the principles of subsidiarity, equity, and transparency. The goal of the funding model is to modernize and simplify California's overly complex and historically outdated financing system. The funding model includes a Base Grant, Supplemental Grant, and Concentration Grants. There are many positives in the funding model, including additional funding to districts to address the needs of English learners, students in poverty, and students in foster care. There are also a number of other issues remaining unaddressed in the proposal including formula adjustments to reflect geographic cost differences, ensuring the provision of quality adult learning opportunities, allowing LEAs to continue to regionalize effective program and service deliveries for career education, transportation services, professional development, among other things. Additionally, districts have undergone severe budget reductions since 2008, and the new funding formula does not ensure that all districts will receive funding levels restored to their pre-recession levels, which at the time was deemed inadequate by nearly almost any measure. Resolution No. 13-28 supports the basic premise of the proposed funding formula, urges the Governor and the legislature to develop the LCFF to provide all districts to their 2007-2008 levels and set the base grant funding at least at the national average, and calls for continued work to develop a robust accountability system to ensure that all students are making gains in academic achievement. Resolution No. 13-28 is attached.

    To
    Cindy M. Cathey, Superintendent
    Quick Summary / Staff Recommendation
Approve the contracted services agreement with Bert Padua to work in the Business Services Department for an amount not to exceed $23,000.
    Background Information
The Accounting Manager of the Business Services Department has accepted a position in another district as of April 30, 2013. The position was advertised immediately and will close on May 13, 2013. The process to fill the position may take several weeks assuming we find the appropriate candidate. In the meantime, there are critical deadlines in the Business Services Department that cannot be missed under any circumstances. These include day to day processing and management of payroll and vendor payments, development of the Adoption budget, preparation of the close of the 2012-13 books, close out of the last Measure A projects, etc. The Business Services Department has found retiree, Bert Padua, who is available on a short term basis. Bert Padua is the former Director IV of Business Services of the Alameda County Office of Education (ACOE). Mr. Padua has extensive hands-on experience working in the fiscal department and the skills necessary to provide the type of support that the District needs. The tasks performed by this consultant would include overseeing and coordinating payroll, accounts payable, general ledger and position control. Furthermore, he would be producing budget and year-end closing documents, which include school bond related accounting. Bond accounting is about 40% of the closing work. Prior to proposing this contract, the Department has searched for other alternatives and other potential candidates but after much searching and limited options, staff is recommending that we enter into a contract with Bert Padua. Mr. Padua?s hourly rate is $50.00. The term of the contract will be May 7 through end of July 2013 and will be utilized only if we are not able to hire a permanent Accounting Manager.

    Quick Summary / Staff Recommendation
Approve the Contracted Services Agreement between the San Leandro Unified School District and Production Logic for the Sound System for the 2013 Graduation Ceremony.
    Background Information
San Leandro High School Class of 2013 will have the honor of being the first class to hold their graduation ceremony on the new, fully renovated, prestigious Burrell Field. Since the stadium will have just been turned over to the district from the contractor, there is a very high probability that the stadium sound system will not be fully operational in time for the ceremony. Additionally staff will not have been trained on how to use the system. It has been deemed too risky to expect the sound system to be functioning. Effective sound with adequate speaker locations and adjustments is crucial to the success of a graduation ceremony. The high school is seeking to contract with Production Logic, a company that we frequently work with, whose systems have been used for previous graduations at Cal State East Bay. They are reliable, knowledgeable, and highly responsive to our needs. They have knowledgeable staff available to test and adjust the sound system as needed. The contract for Production Logic is attached.

Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2012-2013.
    Background Information
Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Assistant Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?. Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012. Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. Change Order #1, a deductive change order, in the amount of <$646,387>, was approved by the Board of Education on July 17, 2012. (Prior to awarding the contract, the Board authorized the transfer of $1,627,000 from the Measure M financial reserve to fund additional scope and escalation costs. Board Committee
Facilities and Technology Committee: April 24, 2013
    Background Information
As part of the Elementary School Athletic Exteriors project, funded through Measure M, the school facilities bond passed in 2010, all elementary schools will receive new play structures for their playgrounds. The original project called for the repair of the old and deteriorating playground equipment, but staff determined that it was more cost effective to replace all play structures with new play structures. This will standardize play structures across the District, with new structures under warranty and having a longer useful life. The equipment that the District, in consultation with the elementary schools? site administration, wishes to obtain is included in a current California Multiple Award Schedule (CMAS) which the District can access. The CMAS program obtains guaranteed pricing on services and products that government entities need to acquire on a regular basis. The program allows for government entities to purchase directly off of the award schedule without having to incur the time and expense of completing a formal bid process. Staff recommends approval of the CMAS contract for elementary school play structures to be purchased from Landscape Structures, Inc., in the amount of $894,995.75. The CMAS contract for the playground equipment the District intends to use is #4-10-78-0057A. A quote from the vendor for the playground equipment is attached. A purchase order in the amount of $894,995.75 will be issued directly to the vendor. This purchase will be funded through Measure M, the local school facilities bond. The District received a 10% discount off CMAS pricing and an additional $6k discount for participating in a contest at Madison ES. The procurement method and contract form have been reviewed by District legal counsel and meet all Public Contract Code requirements.

Facilities and Technology Committee: April 24, 2013
    Policy / Code
    BP1330 (a) Education Code 38130-38139
    Background Information
In keeping with Board Policy BP1330 (a) and Education Code 40040-40047 Civic Center Use Act: use of school property for public purposes, San Leandro Unified School District makes available to the public use of its fields and facilities. In November 2010, voters approved Measure M to improve and upgrade the District?s sports facilities including Burrell Field. With the new sports facilities, the current fee/rent structure has to be updated in order to help keep up with the maintenance of these facilities. Currently, the District has two user classifications and there are no proposed changes to these classifications which are: Class 1 organizations are local, non-profit groups not directly affiliated with the District which are sponsoring activities for the benefit of their membership and/or soliciting fees/ funds; e.g. City of San Leandro and other public agencies, sport groups, homeowners associations, etc. Class 2 includes individuals or private groups engaged in fund raising or profit-making activities, the profits of which will not be expended for the welfare of the District's students. However, staff is proposing changes in the following user fee categories to be effective July 1, 2013: Classrooms Multipurpose rooms Gymnasiums Burrell Field (new category) Attached is Exhibit A which shows the current and proposed fee schedule. It is expected there will be a slight increase in rental income but also a corresponding increase in maintenance expenditures. In addition to changes to the above fee categories, staff is proposing a post-event cleaning fee as follows: $200 for Class 1 and $299 for Class 2 for 4 hours or less $300 for Class 1 and $399 for class 2 for 4 hours or more The assessed post-event cleaning fees will be deposited into a ?sinking fund? restricted for the repair and maintenance of the synthetic field. The proposed schedule was presented to the Facilities & Technology on April 24, 2013.

    Finance Committee: May 2, 2013
    Background Information
In an effort to be inclusive and seek staff and community input regarding budget priorities, the Board held a budget community forum on March 19, 2013. The purpose of the forum was to provide the public with information about the district?s current fiscal situation, including the pending status of Measure L, the Parcel tax passed by the voters on November 6, 2012, and to seek input from the community regarding budget and program priorities. Attendees were given the opportunity to complete a budget priority survey to identify their highest priorities. This survey was then put on the District's website in English, Spanish, and Chinese. Staff and members of the community were encouraged to complete the survey either on line or in hard copy. The results of the survey were tallied. At the Finance Committee meeting on May 2, 2013, the committee reviewed the survey results and discussed the impact of the priorities on the district and the district?s budget. Attached are the results of the survey that was discussed at the Finance Committee meeting. This information will be factored in to any decision that is made by the Board of Trustees regarding program priorities now and in the future should much needed funds become available. The survey results are presented here for information.

    Quick Summary / Staff Recommendation
Receive for information the Purchase Order Report for repairs and maintenance.
    Board Committee
Finance Committee Meeting: May 2, 2013
    Background Information
Currently, staff has been providing the Board of Education contract services under $5,000 in a prescribed template (summary spreadsheet) with pertinent information related to the contract. The template includes: contract period of services, purchase order, contractor/consultant, description of program/materials/location, contract amount and equivalent hourly rate when possible, requester, and funding source. Staff would like to enhance our reporting of purchase orders to not just consultant/contract services but also to include repair services (broken window repair, carpet repair, roto rooter, roofing, instrument repairs, copier repairs not covered by warranty) which are time sensitive or require an expertise outside the scope of what is expected of district employees. Critical information as listed above on the template for consultant/contract services will be replicated on the summary spreadsheet for Repair/Maintenance services as well. Attached is a sample of summary spreadsheet for Repairs and Maintenance. The recommended effective date is July 1, 2013. This will allow Maintenance & Operations Department to start reporting their blanket purchase orders for the year. It is noted that the Board has been receiving information about vendor payments. This additional reporting of purchase orders will give the Board a high level review of repairs & maintenance for each fiscal year. Blanket amounts are an ?up-to? amount and the department may not necessarily spend the full amount. Actual spending will depend on the needs of the department. Unexpended funds will revert back to the general fund balance at the end of each fiscal year.
