- Quick Summary / Staff Recommendation
- Conduct an Official and Public Hearing the 2012-2013 Adoption Budget which includes fiscal years 2013-2014 and 2014-2015: PUBLIC NOTICE June 26, 2012 2012-13 Adoption Budget Which Includes Fiscal Years 2013-14 and 2014-15 Education Code Section 42127 requires that a school district adopt its budget for the next fiscal year and two subsequent fiscal years by July 1 st . Once the district files its adopted budget with the County of Education (COE), the COE is required to verify that the budget complies with the criteria and standards adopted by the State Board of Education, per E.C. 33127, determine whether the district will be able to meet its financial obligations in the current and two subsequent fiscal years and notify the district by August 15 whether the COE has approved, conditionally approved, or disapproved the budget. Assembly Bills (AB) 1200 and 2756 state that a district of the size of the San Leandro USD must maintain a minimum of 3% Reserve requirement. The District continues to maintain the 3% minimum reserve requirement in Fund 17, Special Reserve Fund for Other Than Capital Outlay Projects. A public hearing for the 2012-2013 Adoption Budget which includes fiscal years 2013-14 and 2014-15, will be held on Tuesday, June 26, 2012 at 7:00 p.m. in the San Leandro City Council Chambers located at 835 East 14 th Street, San Leandro, CA.
- Policy / Code
- California Education Code 42120-42129.
- Background Information
- Education Code Section 42127 requires that a school district adopt its budget for the next fiscal year and two subsequent fiscal years by July 1 st . Staff has prepared various supplemental forms in addition to the Standardized Account code Structure (SACS) forms as required by the State of California. The 2012-2013 Adoption Budget reflects a positive gross fund balance of $3,649,593 (includes Tier III and budget designations to be applied to subsequent fiscal years) in the Unrestricted General Fund which includes all Tier III Flexibility and appropriate sweeps of Tier III funds. Due to the timeline for settling an agreement with the District?s largest bargaining group, San Leandro Teachers? Association (SLTA), this 2012-13 Adoption Budget contains many place holder budget items which will be reconciled in July. It is impossible to have line item salary and benefit items of the negotiated agreement detailed in position control when the District settled on June 12 and SLTA ratified on June 15. By that time, the Business Department would have finalized the SACS and all other necessary supplemental forms in order to meet the Board approval statutory June 30th deadline. In order to project a positive fund balance for 2012-13 and two subsequent fiscal years, below are some major assumptions included in the 2012-2013 Adoption Budget: Governor?s tax initiative passing in November 2012; However, the Governor?s proposed budget for 2012-13 which was ratified by Congress on June 15, 2012, included provisions that would link mid-year cuts to his tax initiative, which will be determined by voters in November 2012. If the tax measure does not pass, San Leandro Unified School District is projected to incur an on-going cut of $441 per ADA, which is equivalent to approximately $3.7 million per year (ongoing). Flat funding, meaning the funded base revenue limit for 2012-13 is the same as 2011-12 $855/FTE ongoing increase for SLTA members in the Medical Benefits section on the 2011-12 salary schedule effective February 1, 2013 P-2 ADA of 8,478 from 2011-12 as districts are protected by the higher ADA of either prior or current fiscal years All Board approved cuts on March 13, 2012, will be on-going All items included in the Memorandum of Understanding (MOU) between the San Leandro USD and SLTA (MOU approval is on this Board agenda but as a separate Board Item) Contribution by Adult Education of $400,000 on going Use of approximately 90% of one time funds in 2013-14 and 2014-15 Sweep of $800k of instructional material and School Library Improvement Program (SLIP) funds in 2013-14 The Adoption Budget captures financial information at a point in time and the data will be updated throughout the fiscal year to reflect current information. Official reporting of any budget revisions in the Adoption Budget will be at the filings of the 2012-2013 First Interim (December) and Second Interim (March) reports. This public hearing is to satisfy Education Code 42120-42129. The hearing provides the community the opportunity to address the Board regarding the 2012-2013 Adoption Budget.

15.1 Amendment to Contracted Services Agreement between San Leandro Unified School District and First 5 Alameda County for Summer Pre-Kindergarten Programs for the 2011-2013 School Years 📎 1
- Fiscal Impact
- None to the General Fund; District will seek reimbursement with First 5 Alameda County not to exceed $57,000.
- To
- Cindy Cathey, Superintendent
- Quick Summary / Staff Recommendation
- Approve the Amendment to Contracted Services Agreement between San Leandro Unified School District and First 5 Alameda County for Summer Pre-Kindergarten Programs for the 2011-2013 School Years
- Background Information
- First 5 Alameda County has approved a Strategic Plan for a comprehensive system of early intervention services for children and families in Alameda County. One key component of the First 5 plan is to support the school readiness of children, their future success in school and family functioning. Last year the District entered into a 2-year agreement with First 5 Alameda County to offer 1 summer pre-kindergarten program at our designated summer school site beginning last summer at Jefferson Elementary School. This program includes a 5-week summer program for 18 incoming Kindergarten students who have not attended preschool. There is also a parent education component once a week focused on providing information related to a successful transition into Kindergarten in the fall. Due to our tremendous efforts in accomplishing a successful program last year, First 5 Alameda County has approved us for 3 additional pre-kindergarten classes, making this a total of 4 classrooms serving 72 incoming Kindergarten students and providing them a wonderful opportunity for Kindergarten readiness. The enclosed amendment to the contract is to address the additional 3 new classes. First 5 Alameda County will provide funding not to exceed $57,000 to host a total of 4 pre-kindergarten classes this summer. This funding will provide salaries for the teachers and para-educators, instructional materials, and parent education. For additional information, please see Exhibit A1 for program description and performance requirements.

15.2 School Accountability Report Card (SARC) Licensing Agreement with Document Tracking Services (DTS) 📎 1
- Fiscal Impact
- $4,335 from General Fund Curriculum Development and Instructional Administration
- To
- Cindy M. Cathey, Superintendent
- Quick Summary / Staff Recommendation
- Approve School Accountability Report Card Licensing Agreement with Document Tracking Services for the 2011-2012 school year.
- Policy / Code
- Education Code Section 35256
- Background Information
- Education Code (EC) Section 35256 mandates all elementary and secondary school districts in California annually to prepare for each school within the district a School Accountability Report Card (SARC) that contains the items described in EC Section 33126, to publicize the SARCs, and to notify parents or legal guardians of students that a copy of the SARC will be provided on request. Districts frequently seek the expertise of an outside consultant to help produce the SARCs as one way to ensure full compliance with complex state and federal mandates (SB 556, 1632, 1665, AB 568, 572, and PL 107-110, including Williams Case). The district will seek reimbursement of funds under the state?s Mandated Costs Programs, if the funds become available. Educational Services recommends a licensing agreement with Document Tracking Services (DTS) as the provider of software that will help us complete our 2011-2012 SARCs. DTS will provide software and support to help us produce a fully compliant SARC in English, and a translated document in Spanish, for all school sites and at a savings of $8,265 below last year?s cost with Axiom. SARCs are produced for the prior year. The deadline for completion of the 2011-12 SARCs is February 1st.

- Cindy Cathey Superintendent
- Minutes
- Dr. John Thompson, Senior Director II, Human Resources, distributed a copy of Resolution #12-49, Resolution of Final Release/Reassignment and Notice to Certificate Administrative Employees. He explained that adoption of this Resolution would rescind the action that was taken by the Board prior to March 15, 2012, to notify certificated administrative employees holding administrative positions with the District during the 2011-12 school year that they would be released/reassigned for the 2012-13 school thereby reducing the administrators' work years to generate a cost savings for the District. Due to the agreement that was approved with the San Leandro Management Association (SLMA) on June 5, 2012, which authorizes employees to take up to five furlough days depending on the severity of potential mid-year budget reductions, the agreement will generate a cost savings for the District should mid-year budget reductions be imposed by the State during the 2012-13 school year. In accordance with Education Code section 44951, the passage of Resolution #12-49 Resolution of Final Release/Reassignment and Notice to Certificated Administrative Employees, the Board authorizes the District Superintendent or the Superintendent's designee to notify the employees of the Board of Trustees' final decision to reemploy them for the 2012-2013 school year in the administrative positions they held in 2011-12, as recommended by the administration and subject to the terms and conditions in Attachment "B," and to notify the administrative employee identified in Attachment "A" that she will be re-employed in the assignment specified.

Association (TA) agreed to a Tentative Agreement and Memorandum of Understanding (MOU) for the 2012-13 school year. On June 15, 2012, the District staff, in accordance with AB 1200, submitted a ?Public Disclosure of Collective Bargaining Agreement? to the Alameda County Office of Education (ACOE) for review. The fiscal components of the TA and MOU with SLTA fall primarily into two categories: 1. Medical Benefits Increase/Furlough Days: An annual increase of $855 per FTE in the Medical Benefits section on the 2011-12 salary schedule if the funded Base Revenue Limit (BRL) is maintained at the District?s second interim budget at $5,177.45. Conversely, if the BRL is reduced, SLTA will take up to two (2) furlough days. 2. Program Restorations: Independent of #1 above, the District will restore a variety of programs staffed by certificated employees for 2012-13 only including: *Maintain K-3 class sizes at 28:1 *Restore Counselor program: 5 at high school, 0.5 the alternative high school, 3 shared between middle schools. *Maintain elementary school preps, and specialists (excluding 5th grade instrumental music FTE). Instrumental music will be integrated into the non-pullout 5th grade music program *Restore secondary school librarians (2.6 FTE) *Maintain secondary class size flexibility as detailed on the MOU The District agrees that funds are available to fund this medical benefits increase on an ongoing basis, based on the parameters set by the School Services California, Inc.?s (SSC) dart board as reflected by the Governor?s May Revise. However, in order to fund the restorations and the annual increase for medical benefits if funding remains flat or the same from the State of California, the District will be spending almost of all of its one-time funds including sweeping instructional material and School Library Program (SLIP) funds for 2013-14. One time funds to be used are estimated to be: $2.3M in year 2013-14 plus an additional sweep of $1.1M. The cost of the restorations and contingent increase in the Medical Benefits sections is as follows: ? $2,374,647 for 2012-13 including $389,025 based on criterion #1 stated above; the $389,025 is ongoing if criterion #1 is met ? $1,470,985 estimated for 2013-14 ? $1,440,419 estimated for 2014-15 It is requested that the Board review and approve the Public Disclosure of Collective Bargaining Agreement for San Leandro Teachers Association (SLTA)

18.3 Measure M and Measure B Savings Projects Support Action recorded
- Fiscal Impact
- A net positive impact of $2,300 to the General Fund.
- To
- Cindy M. Cathey, Superintendent
- Minutes
- Assistant Superintendent Song Chin-Bendib explained that the construction work related to Measure M is beginning and is expected to continue for two years. Since this work is being completed on our school sites, it encroaches on and directly impacts the routine maintenance work done at these sites. This requires the District maintenance manager, Greg Dyer, to spend a considerable amount of his time addressing Measure M construction related issues. A time study was conducted and the encroachment was confirmed that Mr. Dyer spent 19.11% of his time on construction-related tasks. The time study was performed over a two-week period and will be continued for another two weeks and periodically throughout the year. The encroachment on Mr. Dyer's time impacts his ability to perform the regular duties of his position, thus increasing his reliance on the maintenance supervisor. In order to ensure that the District can reasonably maintain the services required of the maintenance department supervisor, Assistant Superintendent Chin-Bendib said that staff was recommending the following: Transfer 19% of the maintenance manager's salary to Measure M bond funds to accurately reflect how his time is spent Restore the maintenance supervisor's position from .8 FTE to 1.0 FTE and fund this increase from the general fund offset described in #1 The Assistant Superintendent further explained that the partial shift of the maintenance manager's salary to Measure M bond funds meets the bond requirements because "had it not been for the bond projects, Mr. Dyer would be able to spend the time on his regular maintenance & operation duties." Additionally, the restoration of the maintenance supervisor's position to 100% would provide a net positive impact of $2,300 to the General Fund because 19% of the maintenance manager's salary ($22,900) would be shifted to Measure M while $20,600 of the maintenance supervisor would be added to the General Fund.

- Background Information
- Construction work related to Measure M is beginning and expected to continue for at least two years. Since this work is being completed on our school sites, it encroaches on and directly impacts the routine maintenance work done at these sites. This requires our maintenance manager, Greg Dyer, to spend a considerable amount of his time addressing Measure M construction related issues. Additionally, the Board has approved a list of projects to be funded from Measure B savings. Planning, reviewing existing floor plan mechanics & conduits, and meetings with architects/engineers/construction managers have begun. A combination of the aforementioned projects require Mr. Dyer to spend a portion of each day on construction related tasks. This encroachment was confirmed in a time study conducted by Mr. Dyer which shows Mr. Dyer spent 19.11% of his time on construction related tasks. The time study was performed over a two-week period and will be continued for another two weeks and peridoically throughout the year. We strongly believe 19% is a good indicator because certain days Mr. Dyer will spend more hours while some days less hours. The encroachment on Mr. Dyer?s time impacts his ability to perform the regular duties of his position. This, in turn, increases his reliance on the maintenance supervisor, Philippe Gielen. In order to ensure that the District can reasonably maintain the services required of the maintenance department supervisor, staff recommends the following: Transfer 19% of the maintenance manager?s salary to Measure M bond funds to accurately reflect how his time is spent. Restore the maintenance supervisor?s position from a .8FTE to 1.0 FTE and fund this increase from the general fund offset described in #1. This partial shift of the maintenance manager's salary to Measure M bond funds meets the bond requirements because ?had it not been for the bond projects?, Mr. Dyer would be able to spend the time on his regular maintenance & operation duties. The shift of 19% of Mr. Dyer?s total compensation is approximately $22,900. The restoration of the maintenance supervisor's position from 80% to 100% is approximately $20,600. There would be a relief of $2,300 to the General Fund because 19% of the Maintenance Manager at $22,900 would be shifted to Measure M from the General Fund while $20,600 of the Maintenance Supervisor would be added to the General Fund.

19 ADDITIONAL SUGGESTIONS AND COMMENTS FROM BOARD MEMBERS-8:20 pm
- Minutes
- Trustee Carey commented on the appearance of Burrell Field now that the fields have been demolished. He is looking forward to the District moving forward with the new Sports complex and the high school project. He also noted that Drakes will be next Friday. He also announced that $1.2M in scholarships were awarded to 185 high school seniors. Trustee Prola commented that she was happy to read that the District is working with the Indigenous Nations Child and Family Agency on a grant to serve our Native American students. She noted that in 2009 the Board adopted a resolution declaring the last Friday of September as Native American Day. She would like to see the schools do some type of formal recognition in the same manner that is done for African American and Latino celebrations. Trustee Sullivan hoped that "before pictures" were taken of Burrell Field before the demolition. Trustee Almonte thanked the Superintendent for providing a PowerPoint presentation to the Lion's Club recently, updating them on the needs of the District. Trustee Sullivan recalled asking if the District had a policy with regards to sports-related injuries such as concussions. On that same line, Trustee Prola asked about baseball bat regulations. Staff will research this. Trustee Mack-Rose reported that a few incidents at Washington Elementary School occurred after school was closed for the summer; however, some of the kids involved were caught, bringing to mind the importance of being vigilant. The SLED 100 fundraising event will be tomorrow night at Councilmember Gregory's home. She asked for consensus to explore placing "Additional Board Comments" earlier on the agenda so that the public in attendance can hear those comments; however she decided that she would further discuss her suggestion with the Superintendent.
