5.1 Measure B Savings Projects and the Program Master Schedule
- Minutes
- Goal #5: Ensure Safe and Well Maintained Facilities Assistant Superintendent of Business and Operations, Song Chin-Bendib, presented the Board with an update on the Measure B Savings Projects and the Program Master Schedule. Measure B is the $109 million school facilities bond approved by San Leandro voters in 2006. As of June 30, 2011, the District realized $27 million in Measure B offsets, due to State Matching Funds, Qualified School Construction Bonds (QSCB), and Redevelopment Agency Funds (RDA). The updated Measure B Savings list, which was handed out at the meeting, reflects where the adjustments to the budgets were made. Depending upon the scope of these specific projects, it is expected that these projects will be completed by the end of 2014. Highlights of the presentation included: Priority as outlined in the District Wide Master Plan (1997; updated in 2003) Guiding Principals used in making project recommendations Eligibility for State Matching Funds Maximize Hard Costs; Minimize Soft Costs Architectural Efficiencies Least Disruption to students/educational program No interim housing A summary of Board action regarding Measure B Savings Projects list Project scope additions and reductions List of projects to be done by the District Priority parking lot repairs Priority natural grass and irrigation repairs for elementary and middle schools School Based Health Center Project Middle School security cameras Cafeteria Table repairs The presentation was followed by a conference item to discuss and consider approval of the Measure B Savings projects.

- Board Committee
- Facilities and Technology Committee meetings: February 16, 2011; March 9, 2011; May 11, 2011; May 25, 2011; June 8, 2011; June 22, 2011; August 2, 2012
- Background Information
- In July 2006, the Board identified a list of bond projects in the amount of $109 million. That list of bond projects became the list of Board approved bond projects to be funded from Measure B, which was passed by voters in November 2006. With the exception of the Open Space Project, all bond projects listed on the original list are scheduled to be completed by 2012. As of June 30, 2011, the Measure B bond program has realized savings from projects completed under budget, State Matching Funds, Qualified School Construction Bonds (QSCB), Redevelopment Agency (RDA) funds, and interest in the amount of approximately $27 million. The amount may go higher after all projects have been completed. However, even with $109+ million worth of projects funded through Measure B, the San Leandro Unified School District?s unfunded modernization needs equal approximately $250 million. Since the remaining unfunded needs far exceed funding available, the Facilities and Technology Committee provided direction to staff to generate priorities and recommendations for the Board to use in deciding which new projects and scopes could be addressed using the $27 million in savings. In order to identify new projects priorities, staff utilized the SLUSD Board Approved District Wide Master Plan (1997/2003) filtering criteria: Priority 1 ? Health, Safety and Legal Priority 2 ? Building Shell Integrity Priority 3 _ Infrastructure and Utilities Priority 4 ? Classroom /Interior Renovations Priority 5 ? Renovation/New Construction for Education Programs Priority 6 ? Support Spaces for Educational Programs Priority 7 ? Outdoor Spaces Priority 8 ? Athletic Programs Support Facilities Priority 9 ? Renovation/New Construction for Social Services Staff also considered projects/scopes that would reduce the District?s ongoing general fund and operational costs. Three additional factors to be considered at all times in evaluating and ranking the project list are: 1) Energy costs; 2) Maintenance costs; and 3) Operating costs. The proposed list of projects was compiled based on input from the following sources: District Wide Master Plan District Maintenance Department School Site and District Office Administrators Bond Director Program Manager The timeline for this detailed process was February 2011 through July 2011, and included review by the Facilities and Technology Committee at several meetings. Additionally, a sampling of proposed projects was discussed. On July 19, 2011, the Board approved the first 13 items totaling $16,978,500 in the priority order listed. The Board then individually ranked the remaining 12 items and gave staff direction to tally the results. Items #24 and #25, security cameras at the middle schools, were combined as a single item as reflected on the ranked list. On August 2, 2011, the Board approved the prioritized list of proposed additional projects to be funded from Measure B savings. On July 17, 2012, the Board approved reallocating $2,690,789 of Measure B savings to the Measure M San Leandro High School Swim Center and Fields project. $1,000,000 from the District-wide Priority Natural Grass and Irrigation Repair Measure B saving project $1,690,789 from the SLHS Window Modernization Measure B savings project The updated Measure B Savings list reflects where the adjustments to the budgets were made. Depending upon the scope of the specific projects, it is expected that these projects will be completed by the end of 2014. Note: the Measure B Savings project list will be handed out during the Board meeting.

12.2 Resolution #12-53 in Support of School & Local Public Protection Act (Proposition 30) and Our Children Our Future: Local Schools and Early Education Investment Act (Proposition 38) 📎 1
- Fiscal Impact
- The impact to school district if the initiative does not pass is unknown at this time
- To
- Board of Education
- Minutes
- Trustee James requested that Proposition 30 and Proposition 38 be considered separately, as he felt that while both measures focus on protecting education, they go about it in different ways, referring to the tax structure. On a motion made by Trustee James and seconded by Trustee Prola, the Board bifurcated the Resolution in order to vote on each proposition separately by a 7-0 vote. Following a brief discussion on the pros and cons of each proposition, the Board took the following action: On a motion made by Trustee James and seconded by Trustee Almonte, the Board voted 7-0 to adopt Resolution #12-53, amended, to support Proposition 30. On a motion made by Trustee Prola and seconded by Trustee James, the Board voted not to support Proposition 38 and that all references to the Proposition be stricken from Resolution #12-53 by a 7-0 vote.
- Quick Summary / Staff Recommendation
- Adopt Resolution #12-53 to Support Schools & Local Public Protection Act (Proposition 30) and Our Children Our Future: Local Schools and Early Education Investment Act (Proposition 38).
- Background Information
- The crisis on school funding is at historic proportions, with many districts statewide in jeopardy of not meeting their financial obligations in the next two years. California School Board Association (CSBA) encourages local school districts to adopt resolutions in support of the passage of both the initiatives - Schools and Local Public Safety Protection Act, and Our Children, Our Future: Local Schools and Early Education Investment Act - because each provides revenue to public schools.

- Quick Summary / Staff Recommendation
- Approve the Memorandum of Understanding Between the San Leandro Unified School District and The Regents of the University of California for the 2012-2013 School Year at San Leandro High School
- Background Information
- The Memorandum of Understanding with the Regents of the University of California/EAOP was included in the 2008 GEAR UP Grant approved application. Early Academic Outreach Program (EAOP) has been a vital part of increasing the number of students who are eligible to attend the CSU and UC systems at SLHS for over six years now, and since GEAR UP has partnered with EAOP, we have increased the number of students and families who have access to college planning and advising. We have also created/sustained programs to support students, staff, and families such as: College Night, Open House sessions focused on college topics, Pathways to College Workshop, a College Fair, PSAT Academy, college field trips, summer programming, and professional development for staff on the A-G requirements and college preparation, etc. We want to continue these programs for the 2012-2013 school year as well as expand our services to increase student leadership around college preparation and information. The MOU supports a college coordinator, several intern coordinators, and various programs for over 300 students as outlined in Exhibit A of the MOU.

14.2 Memorandum of Understanding Between San Leandro Unified School District and TeachBar Tutoring Services for GEAR UP Cohort at San Leandro High School for the 2012-2013 School Year 📎 1

- Quick Summary / Staff Recommendation
- Memorandum of Understanding Between San Leandro Unified School District and TeachBar Tutoring Services for GEAR UP Cohort at San Leandro High School for the 2012-2013 School Year
- Background Information
- GEAR UP has implemented several programs to support our GEAR UP cohort at SLHS. Many of our students have areas where they are lacking academic skills or struggle with some of the courses that they enroll in. Thus, for the past two years, we have been partnering with TeachBar Tutoring Services to address the needs of the students. We seek to continue this support through our cohort?s 11 th grade year. Since beginning this partnership, we have continued to see students who are enrolled in the program increase their grades and comprehension at a much faster rate than those who are not a part of our program. Following the success of the configuration of our program for the 2011-2012 school year, we plan to continue the same model for the 2012-2013 school year. TeachBar will implement a 4-day-a-week, 3-hour-a-day tutoring and homework help program. They will provide six tutors Monday-Thursday from 3pm-5:45pm. During that time the tutors will: conduct assessments, provide one-to-one and small group tutoring, and teach mini-lessons. Students will be grouped with tutors by subject and classroom teacher at a 8:1 ratio. With this configuration, we are able to serve 95-150 students per semester. Students will have an opportunity to get tutoring in two subjects per day. All 11 th grade students who received a grade of "C" or lower during the spring semester 2012 will be given priority. In order to continue to carefully monitor our program, keep parents aware of their student's progress, and make connections to the student?s school day, this year we are adding a TeachBar Program Coordinator to the program. This Program Coordinator will monitor the daily tutorials, meet with school day classroom teachers, track student attendance and progress, and communicate regularly with parents and GEAR UP staff. Students in this program are those that need additional time, space, and structure necessary to improve their academic achievement. Those who sign-up for the program must agree to attend all tutoring sessions two-days a week. Attendance is monitored and parents are given attendance and progress reports twice per semester. The hourly tutorial and Program Coordinator rates are $27.85.

14.4 Memorandum of Understanding (MOU)Between the San Leandro Unified School District and Bay Area Community Resources (BACR) for the 2012-2013 School Year at Lincoln High School 📎 1
- Fiscal Impact
- No cost to the General Fund; $94,954 from the ASSETS grant.
- To
- Cindy M. Cathey, Superintendent
- Quick Summary / Staff Recommendation
- Approve the Memorandum of Understanding (MOU) between the San Leandro Unified School District and Bay Area Community Resources for the 2012-2013 school Year at Lincoln High School.
- Policy / Code
- Board Policy 5123 Promotion/Acceleration/Intervention/Retention
- Background Information
- The District is in its fourth year of a five year award for the 21st Century After School Education and Safety for Teens (ASSETS)grant. As part of the grant application, SLUSD indicated that it would "include partners with proven success at maintaining a high level of student engagement." The need to expand the partnership with a large non-profit with proven success in running 21st Century Continuation School sites has now become paramount to the continued success of sustaining the grant through years four and five and hopefully beyond. BACR has proven it's ability to accomplish such a partnership throughout the Bay Area in the field of after school programs. After a successful pilot partnership at Lincoln last spring, it will be beneficial for Lincoln to partner with BACR for comprehensive oversite of the after school programs for the 2012-2013 school year. At Lincoln, the attendance target is 65 students per day, a very high percentage of the total student body. BACR will hire a Site Supervisor at 35 hours/week to oversee the daily operation of the program. In addition, BACR intends to hire three core staff of the ASSETS Program at Lincoln to maintain consistency in program elements, relationships with students and staff and overall smooth running of a program that must maintain significant student buy-in in order to achieve grant attendance targets and deeper program success. BACR continues to bring to the table its expertise as a $27.5 million dollar agency, employing over 900 people. Their access to the best pool of staff, volunteers, and best practices in the field of after school programs offers tremendous potential for the continued success of the grant for Lincoln. An agency that has been in the business of providing after school programs for over thirty years, brings not only their expertise, but increased leverage for the long range view of sustainability in a climate of moving targets of categorical funding. Large non-profits also leverage outside funding not available to school districts. BACR offers much as we continue to look to a more full service community schools model for SLUSD. The MOU for 2012-2013 is for $94,954 funded from the ASSETS fund. Consistent with the District's MOUs with lead after school partners like the Boys & Girls Club, "BACR will recruit, screen, employ and administratively support all instructional staff for the program with the exception of SLUSD employees." The proposed MOU is between the District and the agency (BACR) and, as such, BACR will determine all hourly rates for their employees. In addition to a Site Supervisor and Program Staff, BACR will include oversite from a Program Manager who will be able to provide site observations, professional development, grant target monitoring, and coaching that the district does not have the capacity to provide. As one of the largest providers for after school in the Bay Area, they come with a large network of after school expertise that will continue to benefit not only the Lincoln site but the district as a whole in the after school arena.

14.5 Memorandum of Understanding (MOU)Between the San Leandro Unified School District and Girls Incorporated of Alameda County (Girls Inc.) HEART and ACT Programs for the 2012-2013 School Year at San Leandro High School. 📎 1

- No cost to the General Fund; $15,000 from the ASSETS grant.

- Quick Summary / Staff Recommendation
- Approve the Memorandum of Understanding (MOU) Between the San Leandro Unified School District and Girls Incorporated of Alameda County (Girls Inc.) HEART and ACT Programs for the 2012-2013 School Year at San Leandro High School.
- Policy / Code
- Board Policy 5123 Promotion/Acceleration/Intervention/Retention
- Background Information
- As part of the grant application for 21st Century ASSETs funding, SLUSD indicated that it would ?include partners with proven success at maintaining a high level of student engagement.? Girls Inc. was part of our original Grant Application for ASSETS. They continue to be a primary partner in offering their HEART and ACT programs in the fourth year of a five year grant award. Helping Everyone Achieve Respect Together (HEART) and Advocating Change Together (ACT) after-school programs provide health education and advocacy to girls enrolled in the ASSETs program. The ACT program consists of one two-hour meeting per week, immediately following school. HEART provides increasing leadership opportunities for girls the longer they are in the program with up to three years of participation possible. First year Peer Educators have one two-hour meeting a week. Second year Mentors meet 6 times/month for two hours; they also mentor the Peer Educators and provide them with additional trainings. The third year Interns work directly with program staff in leadership and career development roles for five hours/week. Girls in both the HEART and ACT programs receive stipends in line with best practices in youth development. Twenty students will participate each week across the two programs. Girls Inc. has been a long standing partner with SLUSD. They have provided numerous programs over many years that serve girls who attend SLUSD schools. In order to submit our grant application for 21st Century ASSETs funds we needed to show evidence of a collaborative of agencies. Girls Inc. has remained true to this collaborative process; on-going partnership with them continues to be in keeping with the intentions of the original grant application as approved by the California Department of Education. The proposed MOU for 2012-2013 with Girls Inc is for $15,000 as in years past. Girls Inc. will continue to serve the students of SLHS in their steadfast role with the ASSETS program providing signicant leadership and mentoring opportunities for historically underrepresented female students. Furthermore, as a multi-million dollar agency serving Alameda County, they remain key players in the after school sustainability plan for SLUSD. They continue to leverage outside resources for the district and have served not only as after school and community partner, but as the lead agency when applying for government funding to serve students in SLUSD. In addition to their program staff, they place a high value on bringing their most skilled managers, and agency directors to the table to envision the highest possible educational values for the students and families of San Leandro Unified.

15.7 Renewal of Mandated Cost Contract with Axiom for 2012-2013 Action recorded 📎 1
- Fiscal Impact
- The cost of the contract is not-to-exceed $9,635 which has not increased since 2007-08.
- To
- Cindy M. Cathey, Superintendent
- Minutes
- Responding to Trustee Prola's question regarding the fiscal impact of the contract "not-to-exceed $9,635," Assistant Superintendent Song Chin-Bendib explained that the contract with Axiom includes The 5 mandates not covered in the Block Grant Any new mandate filings for 2012-13 Collection of data for the 40 Block Grant mandates for audit purposes (Aximon is NOT filing the claims but will collect information/data only) The cost is not-to-exceed $9,635 of which $3,300 is for audit defense for the 12 school sites and 10% of claimed amount.

- Motion - Motion made by Diana Prola and a seconded by Mike Katz-Lacabe. | Vote: Yes Hermy Almonte .; Yes Carmen Sullivan .; Yes Lance James .; Yes Ron Carey .; Yes Diana Prola .; Yes Mike Katz-Lacabe .; Yes Morgan Mack-Rose .
- Quick Summary / Staff Recommendation
- Approve the renewal of Mandated Cost Contract with Axiom for 2012-2013.
- Background Information
- Mandated cost reimbursements from the State are a major revenue enhancement source for the San Leandro USD subject to the State maintaining its constitutional responsibility. Since 2006-07, San Leandro USD has been filing mandated claims via a contract with Axiom. The District would receive funding from the State whenever the State has set aside actual apportionment for mandated cost reimbursements. However, the funding has been very sporadic and unpredictable even though it is in the State Constitution to reimburse school districts for mandated claims. For the 2012-13 State Budget Act, the Governor has provided an option for school districts to receive mandated activities through participation in a voluntary Mandate Block Grant. If K-12 school districts choose to participate in this Block Grant program, the amount would be $28 per ADA, and for San Leandro USD, the Block Grant amount would be approximately $237,000. This is only a one-time guarantee by the State Constitution. School districts have until September 30, 2012, to notify the California Department of Education (CDE) of their decision on whether or not to accept the block grant funding for 2012-13. There are 40 mandated claims that will be covered by the Block Grant and 5 mandates NOT in the Block Grant. For the 2010-11 fiscal year, the District had filed a total of $329,000 mandated claims through the tradition filing method. If the same mandated activities were to occur in 2012-13, it can be assumed that there would be about $329,000 to be paid by the State in the future. However, staff is recommending that the District participates in the Mandate Block Grant. The key reason is that the $237,000 Block Grant is a guarantee, and the District would receive the funding this fiscal year. Given the dismal deferral of revenue limit apportionment by the State, the District just like a lot of other districts, need to borrow cash to pay bills. The cash from the Block Grant would help somewhat in mitigating the District?s fiscal challenges, and providing support to the children?s education today. If the District decides to continue the traditional filing method, the estimated $329,000 would be a debt of the State, and will be paid, someday. The attached contract with Axiom includes: The 5 mandates not covered in the Block Grant Any new mandate filings for 2012-13 Collection of data for the 40 Block Grant mandates for audit purposes (Axiom is NOT filing the claims but will collect information/data only). The cost is not-to-exceed $9,635 of which $3,300 is for audit defense for the 12 school sites and 10% of claimed amount.

16.1 Amendment #1 to the Architectural Services Agreement with Jeffery Wong Architects for the Lincoln High School Renovation and Upgrade project 📎 1
- Fiscal Impact
- Architectural services and construction costs are paid through the local Measure ?B? General Obligation (GO) Bond, Measure B savings/State matching funds, and Measure M GO Funds.
- To
- Cindy M. Cathey, Superintendent
- Quick Summary / Staff Recommendation
- Approve Amendment #1, in the amount of $11,000, to the Architectural Services Agreement with Jeffery Wong Architects for the Lincoln High School Renovation and Upgrade project.
- Board Committee
- Facilities & Technology Committee: August 8, 2012
- Background Information
- On March 1, 2011, the Board of Education approved Jeffery Wong Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure M Bond. The Board of Education has also previously approved Jeffery Wong Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond. The original agreement was approved by the board on December 6, 2011, which included the following scope: Measure M Repaving of existing parking lot and basketball court areas Installation of new basketball standards and hoops Installation of a new shade structure Installation of a par course Measure B Renovation of existing buildings to include siding, roofing, and painting Renovation or replacement of existing restroom building Addition of office entry door canopy for weather protection Expansion of existing storm water drainage system Installation of new potable water line from existing EBMUD meter Installation of new parking lot lighting Installation of new security gating Measure B Savings Installation of a double wide ?large classroom? building Installation of new landscaping During the past year, the Division of the State Architect (DSA) changed their field review procedures for fire life safety, structural, and accessibility compliance. In some cases, DSA is now requiring entire site to be upgraded to newly adopted codes and ordinances. Their former practice was to allow Districts to waive certain requirements for upgrades at facilities constructed under prior codes through an approach described as ?Grandfathering.? Unfortunately, DSA does not allow grandfathering for the alarm system and is requiring that the fire alarm system in the existing buildings on the Lincoln High School Campus be upgraded. Jeffery Wong?s consulting electrical engineer provided a conceptual cost estimate of $35,000 for the installation of the fire alarm system. However, the actual cost will be determined when the District get a price quote from a contractor, which could be higher or lower than the $35,000. This amendment #1, in the amount of $11,000, provides the electrical engineering and architectural design services to provide for the fire alarm system upgrades. The majority of the fee is direct electrical engineering costs with a small portion for architectural administration associated with DSA approval and additional construction. Using a relative price comparison between construction costs and design costs is not appropriate in this instance. The design cost is directly related to the number of hours and level of effort required by the electrical engineer producing the drawings and specifications. Contract Summary: Item Fee Running fee total % Increase Original Contract $188,000 $188,000 0.0% Amendment #1 $11,000 $199,000 5.8%

- Quick Summary / Staff Recommendation
- Approve invoices #C7534 and #C7535 for use of the Chabot College Athletics Fields during the displacement of the San Leandro High School football teams during the Replacement of existing Swim Center, Track & Fields.
- Background Information
- In November 2010, San Leandro voters passed Measure M, a $50.1 million school facilities bond that is addressing aging and deteriorating health and safety issues through modernization and new construction throughout the District, including the San Leandro Unified School District Pacific Sports Complex and Burrell Field, the renovation of a new track and field at John Muir Middle School, projects at all school sites throughout the District, and the replacement of the existing obsolete swim center, track and fields located on the San Leandro High School campus with new facilities that meet current standards and program needs. Replacement of the existing swim center, track and fields displaces our sports teams and requires staff to find alternative athletic fields and facilities to allow our teams to both practice and complete. Attached are the Request(s) for Use of College Facilities submitted by the District to Chabot College, and two invoices for use of Chabot Athletic Field(s) for the following dates: Varsity and Junior Varsity Football Games August 31, 2012 October 12, 2012 November 1, 2012 Freshman Football Games August 23, 2012 September 6, 2012 September 15, 2012 September 20, 2012 October 6, 2012 Freshman Rehearsals October 18, 2012 October 25, 2012 The amount due for Invoice #C7534 (varsity and junior varsity) is $12,610.00; and the amount due for #C7535 (freshman) is $2,110.00, for a total of $14,720.00.

23 ADDITIONAL SUGGESTIONS AND COMMENTS FROM BOARD MEMBERS-8:45 p.m.
- Minutes
- Trustee Carey commented that he is looking forward to visiting the sites as a "Trustee of the Board and community member," as he no longer has children in the District. He also thanked staff for all that they do to help our students be successful. The Board welcomed New Board member Corina Lopez, Area 1, who was in the audience and acknowledged the other two new members Vince Rosato, Area 3 and Jason Toro, At Large. Trustee Katz-Lacabe expressed his concern that, once again, the four available seats were all uncontested, reiterating the importance of the Board considering a measure reducing the number of trustees from seven to five, and reducing the number of districts from six to four and one At Large. He asked for, but did not receive, consensus to have the Policy Committee review the process. Trustee James said that this years' registration at the high school went better and there were more positive comments. He asked for and received consensus to place a resolution on the next Board meeting agenda opposing Special Exemptions Act Resolution Proposition 32. Trustee Mack-Rose added that West Contra Costa Unified had already passed a resolution and she would pass a sample resolution on to the Superintendent. Trustee Prola noticed that the date of the tentative Board meeting/work session was missing on the Board Calendar listed at the end of the agenda. She attended the Staff Development days and asked that as soon as the test results are available they be shared along with an analysis of how the companion classes performed. She asked for and received consensus to have the Policy committee consider developing a policy focused on social media, particularly "Friending" guidelines between teachers and students. Trustee Prola announced that "First Friday" fundraiser at Drakes was on September 7. Trustee Sullivan commented that she listens to Mike Nicco, a meteorologist for the weekday ABC 7 Morning News, and that he forecasts the weather for a particular day for school districts. She recently "Twitted" him asking him to forecast the weather for San Leandro Unified on the first day of school. She also said that she would be forwarding the two emails from the Pacific Educational Group to the Superintendent announcing two upcoming events: "Summit 2012: Announcing the Return of "Brown Space", a structured, facilitate placed for Latinos to safely come together; and Creating Equitable Bay Area Schools (CEBAS) Cohorts to the Superintendent. She hoped that the District might send a representative. Trustee Mack-Rose announced that the upcoming September 5 Board meeting was cancelled. She also would like staff to arrange a "Welcome Reception" prior to a Board meeting introducing the new administrators/employees to the Board. She also asked if anyone would be interested being the Board liaison to the Parcel Tax Committee. Trustees Katz-Lacabe and James volunteered.
