    Minutes
Mike Walbridge, Director of Curriculum and Instruction, provided a presentation, "Introduction to the Common Core State Standards (CCSS) & New Assessments," describing the new standards and assessments including a timeline for implementation. Adopted in August 2012, Senate Bill 1 from the Fifth Extraordinary Session (SB X51) established an Academic Content Standards Commission to develop standards in mathematics and English language arts. Eighty-five percent of the standards were to consist of the CCSS with up to 15 percent additional material to be included at the discretion of each state. The State of California has joined the Smarter Balanced Assessment Consortium, which is comprised of 28 states across the country and has adopted common standards and assessments for English language arts and mathematics that will be implemented in the 2014-2015 school year in all schools across the state. These were developed through a state-led effort to establish consistent and clear educational standards for both content areas and are designed to prepare our K-12 students for college and career success. While adopted by individual states, the common core state standards, in essence, create national standards. It also provides a balanced assessment system and access to tailored, online reports. This will allow for sharing of information across districts and states and will link teachers to a digital clearinghouse of formative assessment materials. The Board thanked staff for the presentation and raised clarifying questions which were addressed by the staff.
    Quick Summary / Staff Recommendation

These were developed through a state-led effort to establish consistent and clear educational standards for both content areas and designed to prepare our K-12 students for college and career success. California also added additional supporting standards to complete the "Common Core" for California students. Mike Walbridge, Director of Curriculum and Instruction, will provide an introductory presentation describing the new standards and assessments and will include a timeline for implementation.
  20. 8 PRESENTATION - 8:05-8:45 p.m.
  21. 8.1 Energy Education Inc.
    Minutes
The Board received a presentation from Assistant Superintendent Song Chin-Bendib on the final proposal from Energy Education Inc. (EEI). Energy Education In., a company that is based in Dallas Texas, has saved organizations across the country more than $2 billion for education. The savings came from implementing people-oriented "Transformational Energy Management" processes and thus spending less on utility and water bills. The proposal from Energy Education provides a guarantee to the energy savings. The company has provided several presentations to the Facilities & Technology Committee over the past two years. There was also a preliminary presentation to the Board on December 7, 2010. The proposal from Energy Education provides a guarantee to the energy savings. Assistant Superintendent Chin said that staff has done extensive and exhaustive research and reference checks on this company, who provided positive comments including: "(EEI) they have saved us a ton of money; they are very, very good, they are there all the time..."; "EEI saved us $2.0M over 3 years..."; and "EEI is very, very good, we had them for 4 years and even after the contract expires, EEI still provides the data to the energy specialist. They delivered what they promised". The proposal from Energy Education has a savings guarantee. Section 8 of the contract states that "EEI shall reimburse the District for the difference if the District's Costs (as defined in the contract) exceed its Total Savings, computed from the Start Date at the end of any Performance Year securing the Term ("savings guarantee"). In addition to doing reference checks on EEI, the Assistant Superintendent also consulted legal counsel, however, the District's legal counsel had some reservations about this contract based on some concerns. Some of the concerns of legal counsel are: "There is no early termination option for the District unless the District pays a significant penalty". "Savings guarantee" is merely the contractual promise and that the District's sole remedy appears to be the filing of a lawsuit against an out of state company" (assuming there is a problem with the company later) PUBLIC COMMENT Carol Delton, SLTA, supported energy savings; however, was concerned about the baseline calculations, urging the Board to consider solar initiatives where the District does not have to pay into it to receive the benefit, urging the Board to be extremely cautious in making this very large investment with no recourse to terminate early.
    Quick Summary / Staff Recommendation
Goal #2: Ensure the Financial Stability and Efficiency of the District Goal #5: Ensure Safe and Well Maintained Facilities Energy Education Inc., a company that is based in Dallas Texas, has saved organizations across the country more than $2 billion for education. Minutes
The Board discussed and reviewed the contract with Energy Education, Inc. Several issued were raised regarding the necessity of solar, district/companies expectations of the consultant, and cancellation process. Comments during the discussion focused on energy calculations such as solar, noting that while the use of solar will reduce our cost in the end it does not reduce the amount of energy consumption; how construction will impact our baseline; and how will the District sustain the program. Following the vote, the Board took a break at 9:12 p.m. and reconvened at 9:15 p.m.

    Board Committee
    Facilities & Technology Committee meetings: October 8, 2010; March 7, 2012; March 21, 2012; Board of Education meeting: December 3, 2010
    Background Information
In the summer of 2010, Assistant Superintendent of Business & Operations was approached by a marketing representative from Energy Education, Inc. (EEI). Since then the Assistant Superintendent of Business & Operations has been: Researching and analyzing the data provided by EEI; Presenting EEI contract to Facilities & Technology and Board meetings; Negotiating extensively with EEI and consulting with legal counsel on the final draft of the contract; Conducting numerous reference checks on EEI. EEI?s goal and purpose is to provide school districts with a customized, comprehensive people-driven energy conservation program that will focus on changing human behavior to help districts reduce their consumption of energy and water without any equipment upgrades. Implementation of these programs is guided by a team of EEI?s energy consultants. It is appropriate to note that the San Leandro USD (SLUSD) has consistently applied and continues to apply numerous strategies to conserve and save energy costs. These strategies include but are not limited to reviewing and analyzing energy bills; upgrading infrastructures such as water flow amenities; improving insulation from roofing projects; standardizing and improving lighting fixtures in classrooms and offices. All of these measures have saved SLUSD thousands of dollars throughout the years. However, there is still the human behavior element in energy consumption that has not been explored or improved upon. There are many occasions where lights are left on during the weekends and/or holidays. It is this strategy to improve human behavior in energy consumption that has saved many other districts hundreds of thousands or millions over the years based on testimonials of staff members from the various school districts contacted by the Assistant Superintendent. Some of the districts contacted by the Assistant Superintendent are: Castro Valley USD San Lorenzo USD (the CBO was formerly at Fremont USD, and Fremont had EEI as well) Dublin USD Las Virgenes USD Clovis USD Downey USD Some of these Chief Business Officials (CBOs) have worked in other school districts previously which by extension we have learned of the other districts? experiences with EEI. All of the districts contacted by the Assistant Superintendent provided positive comments about EEI and that EEI has delivered results to their bottom line via savings of energy costs. Some of the comments are: ? (EEI) they have saved us a ton of money; they are very, very good, they are there all the time??; ?EEI saved us $2.0 M over 3 years?.?; ?EEI is very, very good, we had them for 4 years and even after the contract expired, EEI still provides the data to the energy specialist. They delivered what they promised?. The proposed agreement by EEI has a savings guarantee. Section 8 of the contract states that ?EEI shall reimburse the District for the difference if the District?s Costs (as defined in the contract ) exceed its Total Savings, computed from the Start Date at the end of any Performance Year during the Term (?savings guarantee?). The contract is attached in this Board item. In addition to doing reference checks on EEI, the Assistant Superintendent has also consulted legal counsel from School & College Legal Services of California on the EEI contract. However, the District?s legal counsel has reservations about this contract based on some concerns. Some of the concerns of legal counsel are: ?There is no early termination option for the District unless the District pays a significant penalty?. ?savings guarantee? is merely a contractual promise and that the District?s sole remedy appears to be the filing of a lawsuit against an out of state company? (assuming there is a problem with the company later) The Assistant Superintendent has done the due diligence required of this type of contract and exhausted her investigation and research on the subject. It is presented to the Board for review, questions and potential approval. During the past two years, staff and/or EEI have presented the EEI contract and/or related materials to the Facilities & Technology committee numerous times, and a full presentation to the Board of Education. It is recommended that the Board discuss and review this contract, and whether or not to approve the contract.

    To
    Board of Education
    Quick Summary / Staff Recommendation
Adopt Resolution No. 12-34 Proclaiming May as Asian American and Pacific Islander Heritage Month
    Background Information
Every year, the month of May is proclaimed Asian American and Pacific Islander Heritage Month to raise awareness and honor contributions and accomplishments that Asian Americans and Pacific Islanders have made to our history and culture. The year's theme, "Breaking the Mold: Visibility Through Expression" focuses on the various forms of expression that Asian Americans and Pacific Islanders use to break stereotypes about racial and cultural identities. The advancement of media outlets and social platforms continues to serve as vehicles of change to represent their voice on contemporary Asian American and Pacific Islander topics. These forms of creativity introduced an era of self-production, self-realization, and self-fulfillment to give rise to an innovative Asian American and Pacific Islander identity. The District recognizes the contributions of Asian Americans and Pacific Islanders and promotes celebration of this month to provide an opportunity for all schools to learn more about the past and to better understand the Asian American and Pacific Islander?s experiences that have shaped the Nation, and recognizes that ethnic and racial diversity of the United States enriches and strengthens the Nation.

    Quick Summary / Staff Recommendation
Approve the proposed agreement for the Developer Fee Justification Study with Total School Solutions.
    Policy / Code
    Education Code Section 17620
    Background Information
California requires a Developer Fee Justification Study in order to validate an increase/decrease in our developer fee rates. Currently, the District receives $2.97 per square foot for residential and $.47 per square foot for commercial. These rates are from the study that was Board approved on February 28, 2008. In early 2009, the District determined that it qualified for Level 2 Developers Fee which would generate a higher collection of developer fees. Therefore, on January 21, 2009, the Board approved the agreement with SchoolWorks Inc. to complete a School Facilities Needs Analysis Report. Once this report was completed, Resolution 09-47 for the recommended Fee Structure for Level 2 Developers Fee of $3.52 per square foot for new residential within the boundaries of the San Leandro USD, was presented and approved by the Board on September 15, 2009. Level 2 fees are only effective for one year, starting on the day the Board approves the new rates. Once the year is up, Level I fees once again become effective until the State Allocation Board (SAB) approves new rates. SAB approves new rates on even calendar years only. On January 25, 2012, the SAB approved a bi-annual adjustment to Level I Developer Fees. Therefore, a new Developer Fee Justification Study needs to be conducted in order to ratify the new rates. Staff put out a request-for-proposals (RFP) for a Developer Fee Justification Study, Level I on February 27, 2012. Two proposals were received by the due date of March 9, 2012, and Total School Solutions was selected based on review and reference checks. The cost of this proposed Level I Developer Fee Justification Study is $6,956 which includes all hourly charges and out of pocket expenses for the work as outlined in the proposal, as well as one presentation to the Board of Education.

    Quick Summary / Staff Recommendation
Approve Amendment #2, in the amount of $118,890, to the Architectural Services Agreement with AEDIS Architecture & Planning for the San Leandro Unified School District Sports Complex and Burrell Field.
    Board Committee
Facilities and Technology Committee: April 18, 2012
    Background Information
On March 1, 2011, the Board of Education approved AEDIS Architecture & Planning (AEDIS), through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through Measure M, the $50.1 million school facilities bond passed by San Leandro voters on November 2, 2010. On March 15, 2011, the Board approved AEDIS to provide architectural design services, in the amount of $1,075,125, for the replacement of the athletic facilities at the Pacific Sports Complex and Burrell Field. The Measure M Project List identifies $6.8 million for sustainability/solar projects with Burrell Field listed as a possible location. Staff has considered a strategy that maximizes efficiency by incorporating the deployment of solar photovoltaic panels into the design of the Pacific Sports Complex and Burrell Field project. To that effect, AEDIS was tasked with developing options for the inclusion of solar in their design. At the December 21, 2011, Facilities and Technology Committee, AEDIS presented various options for solar at Pacific Sports Complex and Burrell Field. During the meeting, F & T Committee members requested more information on the cost benefit analysis of the solar project (including the estimated return on investment), more in-depth education about the impacts of the four options presented, and other project-related issues. Staff gathered the necessary information and data and presented it to the full Board on January 17, 2012. Due to the time constraints of having the design included in the construction document phase for a bid process in early spring, it was critical that a decision be made on which solar option will be deployed at the Pacific Sports Complex and Burrell Field. The Board directed staff to move forward with a scaled down design to provide solar photovoltaic shade structures in the northeast parking lot as reflected in Option Number One for $663,600. Because of the specialty solar consultants and the involvement of structural engineers for the design of support structures, the design fee of anticipated construction is slightly higher than normal for buildings. However, it is still within expectations for this particular application. Depending on the cost received for the construction, the fee as a percentage will range from around 18% to 23%. The design will be bid with two additive alternates allowing the Board the flexibility to decide whether or not to proceed with the construction at bid time. Subsequently, the Board approved amendment #1 on January 24, 2012, to provide for the design of a children?s play area and renovations to the irrigation water well. This amendment #2 adds the design of a solar photovoltaic system to the Pacific Sports Complex and Burrell Field project. Board Committee
Facilities and Technology Committee: April 18, 2012
    Background Information
Trip hazard risk management and school site safety are an ongoing priority of the District. To that effect correcting several specific conditions were identified as priority projects on the Measure B savings list along with strategic asphalt repairs. One of the conditions exists adjacent to the main front entry walkway at James Monroe Elementary School where tree roots have upheaved parking lot asphalt creating a substantial trip hazard in the pedestrian path of travel. Staff enlisted the advice of an arborist who believes the proposed work which includes root removal would reduce the stability of the tree and increase the risk of it falling from wind loads. On April 18, 2012, the Facilities and Technology Committee discussed the removal of the tree causing the trip hazard and replacement of a portion of the asphalt, and the committee questioned whether or not it would be prudent to remove a second tree in the same planter area. The second tree is also a Liquid Amber with roots that grow predominantly horizontal, rather than down. This second tree very likely will cause similar trip hazard in the future. The Committee advised removing both trees and replacing it with a type of tree where root system would reduce the potential of a future trip hazard.

Senior Director II John Thompson gave a brief background stating that earlier this year the state is requiring that all teachers with mild/moderate credentials obtain a special certification if they are teaching students with autism. Due to the high number of special education students who have been identified with autism, the District is assisting these teachers with obtaining this special certification. One step in this process is for the Board to authorize these teachers to teach students with autism while they are completing this special certification through next year.

    Minutes
Senior Director II John Thompson explained that on March 6, 2012, the Board took action to adopt resolutions authorizing and directing staff to initiate procedures to not reemploy the full-time equivalent of 42.678 certificated employees in order to ensure that the SLUSD can meet its budgetary requirements for the upcoming school years. The proper procedures were followed and the affected employees were given preliminary notice of this action. Unfortunately, the Board must now take action to complete this process. Resolution #12-33 authorizes staff to give final notice to the affected employees, adding that while this is a necessary step, the Board of Education and district staff remain committed to rescinding these notices when possible and to continue to explore alternatives that will reduce the affect of the state budget cuts on the San Leandro Unified School District.

    Background Information
Due to actual and proposed reductions in funding for the San Leandro Unified School District (SLUSD) from the State, the SLUSD has had to make very difficult decisions to reduce programs and services for our students. To the degree possible, the Board of Education has attempted to keep these reductions from affecting our students and staff members, but this is becomming increasingly difficult to do. In order to ensure that the SLUSD can meet its budgetary requirements for the upcoming school years, the Board of Education took action on March 6, 2012, to adopt resolutions authorizing and directing staff to initiate procedures to not reemploy the full-time equivalent of 42.678 certificated employees. The proper procedures were followed and the affected employees were given preliminary notice of this action. Unfortuantely, the Board of Education must now take action to complete this process.
