Commissioner Gonzalez also invited City Council member Ursula Reed to join her in speaking about last year's Martin Luther King, Jr. Day Celebration. The attached contracts outline the role and responsibility of both the District and the Providers. Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2013-2014.
    Background Information
Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Associate Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?.? Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012. Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. One of the major projects identified in the Measure M language is the John Muir Middle School Athletic Fields, which will include a synthetic track similar to the one at Bancroft Middle School, as well as athletic exterior improvements throughout the District. For Bancroft Middle School, which received a new synthetic track and field in 2006, Measure M funding is providing a par course. Spencer and Associates was retained to design and prepare all of the design and construction documents. Plans and specifications were approved by the Division of the State Architect (DSA) and the project was subsequently bid per State of California Public Contract Code requirements. On April 9, 2013, the District conducted a formal sealed bid opening process, per the State of California Public Contract Code requirements, for the John Muir Middle School Athletic Fields and the Bancroft Middle School Par Course project. Seven (7) bids were received for the project. On April 16, 2013, the Board awarded the contract to Hellas Construction, with their amount for Muir Middle School at $1,630,000. Due to the large number of bidders and competitive pricing within the construction market the project was able to realize a substantial savings and generate an additional available contingency of $494,000. On June 25, 2013, the Board approved Change Order No. 1, in the amount of $23,800, to the Hellas Construction Contract to furnish and install a gopher barrier and to provide temporary water to Wilson Elementary School during construction, and the recommendation by District staff, the Muir MS Athletic Department and the project team to demolish the old pool area and reuse for physical education activities. Facilities and Technology Committee:
    Background Information
One of the major marquee projects identified in the Measure M language is the SLUSD Pacific Sports Complex and Burrell Field. AEDIS Architecture & Planning was retained to design and prepare all of the design and construction documents. Plans and specifications were approved by the Division of the State Architect (DSA) and the project was bid through the requirements of Public Contract Code. The Board approved the construction contract with Zolman Construction and Development Inc. on May 15, 2012, in the amount of $13,500,000. Change Order No. 1, a deductive change order, in the amount of <$646,387>, was approved by the Board of Education on July 17, 2012. (Prior to awarding the contract, the Board authorized the transfer of $1,627,000 from the Measure M financial reserve to fund additional scope and escalation costs. To minimize the need to expend all of the transferred funds staff conducted a value engineering process with AEDIS Architects and the contractor Zolman. The contractor?s value for the items was negotiated and included in the above-mentioned deductive change order.) The $646,387 savings due to value engineering was transferred out of the project budget and into Measure M Financial Reserve budget. Change Order No. 2, in the amount of $23,549, was approved by the Board of Education on November 6, 2012, to address unforeseen conditions (i.e. demolition of additional concrete curb footage, additional sanitary sewer line, removal and disposal of asbestos, and removal of two concrete pads not shown on plans). Change Order No. 3, approved by the Board of Education on December 4, 2012, in the amount of $92,324.30, for the removal and disposal of additional asphalt paving containing asbestos ;and for the drilling of an additional 180 feet in depth for the irrigation well per the Geo Consultant. Change Order No. 4, approved by the Board of Education on April 9, 2013, in the amount of $59,755, addressed field conditions, and provided value, flexibility and functionality, including the installation of underground conduit to accommodate future solar panel installations. Change Order No. 5, in the amount of $80,894, addressed field conditions, and provided value, flexibility and functionality. It included a credit in the amount of <$3,761>. Change Order No. 6, in the amount of $54,749, added for the provision of security cameras for the Burrell football field, buildings, bleachers and associated structures. Change Order No. 7, approved by the Board of Education on August 13, 2013, in the $165,800, addressed field conditions, provided value, flexibility and functionality. Items included the replanting of a sliver of land along I880 property line; realignment of the existing storm drain and installation of storm drain structures; slurry coating; and trucking offsite extra soil from the 880 swale, among other things. Change Order No. 8, approved by the Board of Education on August 20, 2013, in the amount of $313,684, included approximately $15k for work associated with PG&E requests & additional requirements for new electrical service, approximately $129k to satisfy City of San Leandro?s request to both connect to and use the District?s new irrigation well and for City?s request for additional improvements along Teagarden in the public right-of-way, approximately $37k for some of the overtime that was expended in order to be able to hold the high school graduation ceremony in the facility prior to project completion, approximately $3k in hazardous materials removals, and the remainder of the items addressed various field conditions, coordination and additional scope. This Change Order No. 9, in the amount of $86,758, is to address field conditions, add value, flexibility and functionality, including new fencing at the playground west boundary, provide new backflow preventer for main water line, provide and install two wireless remote control for existing baseball field scoreboards, install handicap ramps, per City of San Leandro requirements, etc. This Change Order No. 10, in the amount of $241,203, is to address City of San Leandro requests and requirements, grinding & paving along 530? of Teagarden Street, modifications were made to underground electrical conduit for future use; well water lines; tennis court lighting; gates; and sidewalk curb & gutter. Electrical boxes were raised at switch gear for access to meters per PG&E requirements. Additionally, there are premium time costs for the general contractor, the paving subcontractor for paving/grading and for subcontractor to accelerate the bleachers; and to prep the football field, fire lane, and parking lots to mitigate earlier delays and complete portions of the work prior to graduation. Added value, flexibility and functionality include adjusted grading and drainage at playground areas; realigning AT&T conduit; relocation of MDF from Press Box to fit in Team Room; equipment cages to protect HVAC units and MDF equipment; and scoreboard modifications. Staff anticipates the project will complete with one final change order to be submitted to the Board in November. To
    Mike McLaughlin, Ed.D., Superintendent
    Staff Recommendation
Approve the SPURR Renewal Agreement for Natural Gas Services, as presented to the district by SPURR.
    Background Information
The School Project for Utility Rate Reduction (SPURR) is a Joint Powers Authority (JPAs) formed under state law in 1989 by California public K-12 school districts, community college districts, and county offices of education. JPAs are frequently formed for the purpose of aggregating purchasing power and expertise among public agencies. That is the purpose of SPURR, in the area of utilities services, such as natural gas, electricity, telecommunications and water. SPURR is governed by a Board of Directors, consisting of administrators from member districts. The current President of the SPURR Board is from Clovis USD and the Vice President is from Ceres USD. The SPURR Treasurer is the Associate Superintendent for Business at the Alameda County Office of Education. Our district has participated for at least a decade in the SPURR natural gas procurement program. This program serves over 200 agencies, including SPURR members and UC and CSU campuses, municipalities, and other California public agencies. SPURR buys natural gas at the wholesale level from multiple suppliers, including Shell Energy, ConocoPhillips, BP, United Energy Trading, Constellation Energy, and others. SPURR provides us with the best available pricing, through its relationship with multiple suppliers. SPURR provides rate plan options, such as fixed rate pricing for a portion of our needs, to provide budgetary security. SPURR also sends us understandable natural gas market updates, reports on other utility issues, and toll-free access to their customer service center. SPURR is the only representative our schools have in energy-related proceedings before the Public Utilities Commission and in the Legislature. Staff recommends that the Board authorize execution of the SPURR Renewal Agreement for Natural Gas Services, as presented to the district by SPURR. This contract is from July 1, 2014 to June 30, 2019. By approving this contract well in advance of the next fiscal year, will allow SPURR to fulfill their procurement responsibilities in concert with the other participants.

    Policy Committee - May 15, 2013
    Background Information
At the May 7, 2013, regular Board meeting, Trustee Rosato received consensus for District staff to research funding options to conduct a complete policy audit to bring all of our Board policies into compliance with current laws and conditions as recommended by the California School Board Association (CSBA). On May 15, 2013, the Policy Committee discussed an CSBA audit. It was decided to move forward with a three-day service contract with CSBA sometime in October 2013. Per CSBA, with a Policy Development Workshop, a CSBA policy consultant will visit our district for 3 days. The consultants will facilitate the review and customization of the CSBA template policies by our district's policy review team, usually the Superintendent, Cabinet, and Board representative(s). The draft policy manual generated at this meeting is then word-processed by CSBA and shipped to the District for board consideration and adoption. Once the manual is adopted, CSBA will provide the District with a final copy of the new policy manual. The cost of this service is based on a district's ADA. As a GAMUT Online subscriber, the cost is $5,747.50, which represents a 50% off the $11,495 regular price. In addition, the District agrees to pay the CSBA consultant travel expenses (transportation, lodging food) and a $7.00 per page typing fee for inclusion of local material, in excess of 50 pages. Any additional services performed by a CSBA consultant after the workshop will be charged separately at the rate of $75 per hour. Once the District's policy manual is complete and adopted, the District is eligible to subscribe to an CSBA ongoing Policy Service which combines two services, GAMUT Online and Manual Maintenance. The annual fee for GAMUT Online Services is $2,750 and the annual fee for Manual Maintenance is $3,100, for a total combined yearly cost of $5,850. Staff is recommending that the Board approve the CSBA Transition Agreement (attached) to begin the process of reviewing and updating all District Board policies and producing a policy manual for the San Leandro Unified School District.

    Background Information
One of the major marquee projects identified in the Measure M language is the San Leandro High School Swim Center and Fields project. The District retained WLC Architects, Inc. to design and prepare all the design and construction documents. Construction for the San Leandro High School (SLHS) Swim Center started in the summer of 2012 and is scheduled to be completed in September 2013. Prior to the modernization of the swim center, the SLHS pools (competition and wading pools) were primarily used by the SLHS swim teams and when the pools were not in use, by the San Leandro Swim Team, a.k.a. ?Drowning Darryls?. The District charged a fee to the San Leandro Swim Team (for the use of the High School pools. In 2010-12, the fee charged was $5,873. Prior to the modernization of the pools, in order to pass the Alameda County Health inspection certification, the District has had to maintain the old swimming pools with restricted resources. For years as part of the maintenance and upkeep of the pools, the San Leandro Swim Team has contributed financially to the District to partially support the repair of the pools (and were very active in working on Bond Measure M). In preparing for the scheduled opening of the new and modernized pools, staff has researched and gathered cost data to provide for the maintenance of the new pools. Obviously, due to the size of the pools and new code requirements, a severalfold increase is estimated to maintain the cost of the pools. Staff has also researched and gathered data from surrounding school districts and agencies on what they charge for the use of their swimming pools. Attached is a summary of the ?Swimming Pool Fees Comparison?. For information purposes, staff has also attached an estimated cost of running the new pools. Staff has met a few times with the San Leandro Swim Team (Drowning Darryls) and an initial start-up fee of approximately $7,200. SL Swim Team requested a 20% increase over their prior year?s rate. The District will assess the actual costs of the pool after a year?s of operation and then perhaps the SL Swim Team will incrementally increase their share of the cost over time. Some other items that were discussed and agreed upon are as follows: No charge for attendants Daily use of up to 3 hours Saturdays are for meets only and about 7 hours per meet No swimming time on Sundays Swim season is from April through end of July each year No access to keys These rates will be reviewed and analyzed next year after a year of actual usage and operation.

This legislation requires that districts offer services for two consecutive years following grade twelve to students who did not pass the CAHSEE by the end of their 12th grade. Additionally, the legislation requires that students and families have the opportunity to file a complaint against the District for not fulfilling this requirement. Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required. For the period July-September 2013, the District did not have any complaints.
