6 PRESENTATIONS
-
6.1 2012-2013 Independent Audit Report
- Minutes
- Terri Montgomery, of Vavrinck, Trine, Day and Co., LLP, the District's independent auditor, presented the 2012-2013 Independent Audit Report. The audit report includes the District financial statements, supplemental information, auditor's opinions on the financial statements, federal compliance, and state compliance for the year ended June 30, 2013 (2012-2013). Key points of the presentation included: The two most important words on the audit report can be found at the top of page 3: "present fairly," which means that you have a "clean" or what's now called an "unmodified" report. There were no proposed audit adjustments this year, adding that the main purpose of the 84-page audit is to determine whether or not numbers that the management has provided are materially accurate; the auditors felt they were and so they did not propose any adjustments. Secondary purpose of the audit is to go through a number of compliance areas and bring forward any recommendations. Beginning on page 81 there were two recommendations related to Student Body and Site Cash Internal Controls. There were no Federal or State Awards recommendations or findings. After the presentation, Trustee Katz-Lacabe commended staff for lack of findings, particularly with regards to the "stubborn issue of student groups and the handling of money," which he noted is a common problem for all districts. Associate Superintendent Song Chin-Bendib thanked Trustee Katz-Lacabe for his comment, saying that "we have high standards; and the auditors have even higher standards." Associate Superintendent and Ms. Montgomery also noted that implementing an in-service training for new staff and students on how to handle student funds was very effective.

Ms. Waldren mentioned that she has been receiving some complaints about the Durham Bus Company, in particular, late pickups, late drop offs and issues with some students on the buses. Superintendent McLaughlin updated the Board on the Instructional Innovators Initiative, reporting that the application deadline was Friday, January 10. They hoped to get 25-40; however, he was excited to report that Assistant Superintendent Dr. Rosanna Mucetti received 110 applicants, adding that they may increase the number of teachers from 60 to 70. He also noted that they want to do something special with the teachers who were not chosen for the pilot because "we do not want to lose the momentum." The Superintendent concluded his remarks stating that California Flags have been purchased and will soon be replacing the old ones. In addition, with regards to the concerns expressed by Ms. Waldron around the District's contract for Special Education transportation, he said that he has been in conversations regarding alternate vendors with neighboring districts, and the Mid-Alameda County Special Education Local Area Plan Consortium.

- Michael McLaughlin, Ed.D., Superintendent
- Minutes
- Trustee Prola realized that she had pulled Item #11d by mistake, as her concern was regarding Item #11c - Resolution $#14-01 to Declare Certain Equipment Surplus and/or Obsolete, where she was surprised that the Fred T. Koramatsu campus was already declaring some computer equipment surplus and/or obsolete. It was explained that sometimes new equipment is not always given to new sites, as in this case, and it would not be cost effective to repair the equipment. With that, the Board approved Consent Item #11d - Change Order #8 to the Construction Contract with F&H Construction for the San Leandro High School Swim Center and Fields Project, as 11b - Resolution #14-01 to Declare Certain Equipment Surplus and/or Obsolete had already been included in the Consent Calendar approval.

10.7 Fire & Security Alarms Proposal for the San Leandro High School School-Based Health Center Modernization Project, funded through Measure B Savings 📎 1
- Fiscal Impact
- The cost of the fire and security alarms is funded through Measure B Savings.
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Approve the purchase order for Fire & Security Alarms for the San Leandro High School School-Based Health Center Modernization Project.
- Board Committee
- Facilities and Technology Committee: January 8, 2014
- Background Information
- For the past several years, the Board has identified specific goals to address the priorities of the District. Among the six overarching goals are: Goal # 1 Educate the whole student: Ensure the academic, physical, social and emotional well-being of every student Goal # 2 Ensure the Financial Stability and Efficiency of the District Supervisor Wilma Chan?s office and Alameda County Health Care Services Agency have provided extensive support and resources in the area of behavior and mental health services to help address Goal #1, which included two full time behavioral health consultants who conducted a needs assessment across the district to identify services that are being provided to our students and to identify gaps in such services. While implementing recommendations based on the needs assessment, the need for a school-based health center became apparent. An opportunity presented itself when the District became aware that the Girls Inc. building across the street from San Leandro High School was for sale. Thanks to the generosity of Supervisor Chan, the District applied for a federal school-based health center grant in the amount of $500,000. In order to meet the required matching funds, the Board approved $500,000 in Measure B Savings to be used for the school based health center and the District entered into negotiations with the Girls Inc. realtor to determine if purchase of the building was a viable option. In December 2012, the District was notified by Supervisor Chan?s Office that SLUSD would receive the grant. One critical partner in making the school-based health center a reality has been the City of San Leandro. On February 4, 2013, the City Council unanimously approved a Resolution and loan agreement, in the amount of $1,250,000, between the City and SLUSD to assist with the purchase of the property. On February 26, 2013, the Board of Education approved the loan agreement; and on March 13, 2013, as part of the purchase and sale agreement, Girls Inc. and SLUSD agreed that the District would lease certain office space to Girls Inc. after the close of escrow in order for Girls Inc. to continue providing under-served girls in the community with programs and counseling services. On August 6, 2013, the Board of Education approved the Joint-Use Agreement by and between San Leandro Unified School District and Girls Incorporated of Alameda County. Purchase Order No. M14-00110, in the amount of $28,512.57, is to pay for fire and security alarms at the School Based Health Center.

- Staff Recommendation
- Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2013-2014.
- Background Information
- Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Associate Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?.? Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012. Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. 10.17 Landscape Architectural Services Agreement with Keller Mitchell & Co. for the Woodrow Wilson Elementary School Field Improvements 📎 1
- Fiscal Impact
- The cost of architectural services will be funded through Measure B Savings.
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Approve the Architectural Services Agreement, in the amount of $23,000, with Keller Mitchell & Co., Landscape Architecture, to provide athletic oriented site improvements at Wilson Elementary School.
- Board Committee
- Facilities and Technology Committee: January 8, 2014
- Background Information
- In November 2006, San Leandro voters passed Measure B, a $109 million school facilities bond to address aging and deteriorating health and safety issues through modernization and new construction throughout the District. By leveraging state matching funds, seeking out grants, and building strong partnerships, as well as a positive bid climate and the careful management of resources resulting in Measure B savings, the District has greatly enhanced the original scope of work and continues to identify new projects to fund through Measure B. In November 2010, San Leandro voters passed Measure M, a $50.1 million school facilities bond that is addressing aging and deteriorating health and safety issues through modernization and new construction throughout the District, including the renovation of a new track and field at John Muir Middle School and the athletic exteriors at all elementary Schools, including Woodrow Wilson Elementary School. On December 6, 2011, the Board of Education approved the Architectural Services Agreement with SIM Architects, in the amount of $84,000 for athletic oriented site improvements at Wilson Elementary School; and the Architectural Services Agreement with Spencer Associates, Inc., in the amount of $235,000, to cover athletic oriented site improvements at John Muir and Bancroft Middle Schools, all funded through Measure M. At the November 19, 2013, Board Meeting, the Board of Education, due to the existing condition of the fields, reprioritized savings projects and approved $400,000 for improvements to the irrigation system and athletic fields behind Wilson Elementary School. In a series of Facilities and Technology Committee meetings, staff and committee members discussed the field conditions with staff, including the M&O department, and guidance was given to staff to make a recommendation for additional field improvements at Woodrow Wilson Elementary School. Attached is a proposal from Keller Mitchell & Co., landscape architects for John Muir Middle School, in the amount of $23,000. The design scope would cover the baseball field, infield, associated wing fencing along the first and third base lines, irrigation and lawn planting. Architectural fees are related to the size and complexity of the project and level of service that the architectural firm can provide for a client, in addition to the specialty consultants necessary for the specific project. Industry standards for architect?s fees for the schematic design phase through DSA closeout phase range from 8% of the construction costs for large modernization projects to 12% for small projects. The design fee of $23,000 represents 10% of the estimated $230,000 cost of construction. During design process, as the drawings become available, the designer will update their cost opinion for the construction costs.

10.18 New Copier Contract with Caltronics for San Leandro District Sites 📎 1
- Fiscal Impact
- By upgrading these machines, the sites will have faster and more efficient equipment, less cost in maintenance and lease agreements. With the proposed vendor bid, the savings will be $16,479 per year or 16% to the Unrestricted General Fund.
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Approve a new copier contract with Caltronics for the term of 60 months for various San Leandro USD sites.
- Policy / Code
- Board Policy 3300; Administrative Regulations #3311; Public Contract Code 20111(a)
- Background Information
- San Leandro Unified School District currently has (6) Copier Lease Contracts located throughout the district. One of the contracts that went into effect January 2009 will expire January 20, 2014. The contract consists of (10) copiers located at various District sites. The equipment is (5) years old, requiring maintenance and repairs as compared to new equipment. In order for us to better serve the school sites, we have a plan in place to upgrade these copiers as existing contracts expire. Public Contract Code Section 20111(a) requires school district governing boards to competitively bid and award any contracts involving an expenditure of more than $84,100 (adjusted bid threshold for inflation as of 2014) to the lowest responsible bidder. Contracts subject to competitive bidding include: Purchase of equipment, materials, or supplies to be furnished, sold, or leased to the school district. Services that are not construction services. Repairs, including maintenance as defined in Section 20115, that are not public projects as defined in Section 22002 (c). However, Public Contract Code Section 20118 in short allows for a piggy back of existing contracts. Notwithstanding Sections 20111 and 20112, the governing board of any school district, without advertising for bid, if the board has determined it to be in the best interest of the District, may alternatively, authorize a lease, or purchase from an existing contract between a public corporation or agency and a vendor for the lease or purchase of the personal property directly from the vendor by contract, lease, requisition, or purchase order and make payment to the vendor under the same terms that are available to the public corporation or agency under the contract. The Purchasing Department solicited two vendors that service copier contracts. These companies are Caltronics and Pacific Office Automation. The pricing and terms from Caltronics are the lowest and we have also established a successful and dependable business relationship with them; all of which are extremely important to servicing our district sites. Therefore, staff recommends awarding the new Lease & Maintenance contract to Caltronics; and piggy back to the existing Contra Costa County (CCC) Contract. Caltronics provides our district with award winning equipment with superior maintenance service on our current active contracts. Since the savings is greater with the longer term contract and the life efficiency of copier machines is about 5 years or 60 months, it is the recommendation of staff to select the 60-month lease term. The proposed 60 month lease will cover 11 copiers throughout the district with a monthly lease of $1,813.71 per month or an annual lease of $21,764.52. Additionally, there is an estimated $1,480.81 monthly maintenance agreement to provide for parts, service calls, and all supplies (except paper) for an annual estimated cost of $17,769.72. This translates into an annual contract of $39,534. The Maintenance Agreement is based on actual usage of copies, and our historical average use is about 319,752 copies per year. The current lease contract that expires on January 20 th costs $19,242.36 annually. The new lease will replace existing and upgrade to a higher page per minute copier Bizhub 754 and also include (1) additional copier for the High School. The increase of (1) copier from existing contract of 10 to 11 new lease contract is recommended for the following sites. - Background Information
- On December 12, 2013, the District and the California School Employees' Association approved and signed off on a tentative agreement (TA). The TA contains components that address changes to collectively bargained language related to salaries and benefits, transfers and promotions, and reclassification. In addition, the TA adds a three (3) percent increase to the California School Employees' Association salary schedule, funded in part from savings in the CSEA unit through frozen and eliminated positions. The Business Services Department has prepared the Public Disclosure Statement, Certification of the District?s ability to Meet the Costs of Collective Bargaining Agreement, in accordance with AB 1200, verifying that the District can afford to fund the TA. The Alameda County Office of Education (ACOE) has reviewed these documents and determined that the district can afford this agreement in the current and subsequent years. The specific language and provisions in the TA can be found in the document attached to this agenda item.

- Background Information
- Superintendent McLaughlin provided a presentation on the proposed Strategic Action Plan for 2013-2016 where he outlined the process which began with a Board Special Strategic Planning session on September 7 to develop new areas of focus, expectation and priorities for the District in the future. The Superintendent then took the initial draft plan to Cabinet to narrow/fine tune expectations, and assign yearly goals/targets. After vetting the Plan with the Board, the Board directed the Superintendent to meet with various stakeholders: certificated and classified staff, community based organizations, business, and service clubs to get their feedback. Tonight, the Superintendent is bringing back the final Strategic Action Plan for Board consideration and final approval with implementation in January 2014.

- Background Information
- The regulations of the Williams lawsuit settlement require school districts to complete ?Quarterly Complaint? reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and misassignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). This legislation requires that districts offer services for two consecutive years following grade twelve to students who did not pass the CAHSEE by the end of their 12th grade. Additionally, the legislation requires that students and families have the opportunity to file a complaint against the District for not fulfilling this requirement. Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required. For the period October-December 2013, the District did not have any complaints.
