5 PUBLIC TESTIMONY ON NON-AGENDA ITEMS
- Minutes
- Adan Alonzo, a parent of a John Muir Middle School eighth grader, addressed the Board regarding his concern that the use of Burrell Field would not be an option for the promotion ceremonies for the two middle schools, as the District believes that the newly renovated field should be reserved for the senior graduations. While he acknowledged the Superintendent for taking time to meet with the Muir parents to explain the District's reasoning and offer other options available, he also urged the Board to be open to discussion about the concerns, communicate to the parents, and "if the field is to be reserved for the senior class, so be it; however, be realistic that these facilities are here for us to use and we need to use them."

6.2 Informational Presentation on Lease-Leaseback (LLB) Construction Project Delivery Method Available per Education Code Section 17406
- Minutes
- Philip J. Henderson, Attorney at Law, Orbach Huff Suarez & Henderson LLP, gave a presentation on the Lease-Leaseback (LLB) Delivery Method available to, and utilized by, California school districts per Education Code Section 17406(a). The District is planning to use this method to deliver some of the bond construction projects in 2014. Mr. Henderson explained that generally, California school districts use a public bidding process, adding that there are some exceptions to public bidding, including LLB. The basic structure of the LLB is as follows: District leases real property to a builder for $1 (site lease) Builder constructs facility, then leases the facility back to the District - this is the "leaseback" component (facility lease) District payments for constructions costs: Tenant improvement payments during construction Lease payments after construction The construction terms and conditions are part of an exhibit to the facility lease Title to the new facility vests in the District as lease payments are made District makes lease payments for a period of time and then has the option to make a balloon payment to builder to buy out the facilities lease One of the benefits of using a LLB delivery method is that if a district has had trouble with a contractor or even a subcontractor, this method allows more control for who is selected Mr. Henderson's presentation also touched on new Pre-Qualification law that recently became effective on January 1, 2014. Although the new law will arguably not apply to LLB contacts, Mr. Henderson stated that the safest option would be to include a prequalification form with RFQ/RFP, adding that he is not recommending to any of his clients to skip this step. Mr. Henderson also stated that LLP contracts are still school district public work contracts and the builder must pay prevailing wages, a payment bond is required, as well as DSA approval and Field Act Compliance, concluding that "there is no conflict of interest with the existing Project Stabilization Agreement (PSA) if the District goes through a safe and transparent procurement process." At the conclusion of the presentation, the Board posed clarifying questions, which were addressed by the presenter and staff.
- Quick Summary / Staff Recommendation
- Philip J. Henderson, Attorney at Law, Orbach Huff Suarez & Henderson LLP, will explain the LLB delivery method available to, and utilized by, California school districts. The District is planning to use this method to delivery some of the bond construction projects in 2014. 7.4 Superintendent's Report
- Minutes
- Superintendent McLaughlin provided the following report: The CSBA policy review went very well. A draft policy manual should be sent to the District sometime in April for consideration and adoption, adding that this is a great first step in keeping all Board Policies up-to-date. FCMAT (Fiscal Crisis Management Assistance) will be visiting the District from February 11-14, to conduct a comprehensive analysis of the Special Education Program, which will be a great opportunity to improve and enhance the department. The Superintendent clarified that, while he agrees that Burrell Field should be designated as the official site for our high school graduates on their special day, the District has some wonderful fields at the two middle schools, and he would like see the middle schools start a new tradition of "outdoor graduations" so that the whole family can be invited to attend the ceremony. The Superintendent appreciated the concerns raised by the Muir Middle School parent; however, felt that the issue had been solved, adding that he will be working with all three schools so that, for the first year, graduations will hopefully take place "without a hitch".

9.5 Memorandum of Understanding with Alameda County Office of Education to Increase Bandwidth Passed 📎 1
- Fiscal Impact
- $6,250 will be an increase in cost to the district and to be paid out of the Common Core budget.
- To
- Mike McLaughlin, Ed.D., Superintendent
- Minutes
- In response to Trustee Katz-Lacabe, staff explained that the proposed MOU with ACOE will allow us to increase our bandwidth to 400Mbps (currently we are set at 100Mbps) which in a sense will quadruple our current capacity. The MOU and the 400MBps will carry us through the end of the 2013-2014 school year, at which time the District will go through an E-Rate bidding process to reestablish a new contract for 2014-2015. The Board then approved the Memorandum of Understanding with Alameda County Office of Education to Increase Bandwidth. Trustee Toro was absent.
- Staff Recommendation
- Approve the Memorandum Of Understanding (MOU) with Alameda County Office of Education (ACOE) to increase the District?s bandwidth from 100Mbps to 500Mbps so that we may be able to support the SBAC testing and our new Innovator Pilot Program.

- Motion Approve the Memorandum Of Understanding (MOU) with Alameda County Office of Education (ACOE) to increase the District?s bandwidth from 100Mbps to 500Mbps so that we may be able to support the SBAC testing and our new Innovator Pilot Program. - Motion made by Mike Katz-Lacabe and a seconded by Ron Carey. | Vote: Yes Lance James .; Yes Ron Carey .; Yes Diana Prola .; Yes Mike Katz-Lacabe .; Yes Corina N. Lopez .; Yes Vince J. Rosato .
- Background Information
- San Leandro Unified receives many core services from Alameda County Office of Education (ACOE). These services include, but are not limited to, internet access, financial system, spam filtering and within the next month, firewall and content filtering. ACOE is also an E-rate eligible Internet Service Provider (ISP). The E-rate program provides discounts to assist schools and libraries to obtain affordable telecommunications and Internet access. It is funded through a Universal Service fee charged to companies that provide telecommunications services. As a result, due to our Free-and-Reduced Lunch student population, our District is only responsible for paying just 30% of our total internet service rates when using an E-rate eligible ISP. The new state requirements for student testing as dictated by the Smarter Balanced Assessment Consortium (SBAC) require all students to test online. In addition, our new Innovator Pilot Program also includes providing our staff and students with devices which they will use to connect online to access sites rich in multimedia and streaming content. Both these factors will place a heavy burden on our internet bandwidth which is currently set at 100Mbps. This Memorandum of Understanding (MOU) with ACOE will allow us to increase our bandwidth to 500Mbps, which in a sense, will quadruple our current capacity. This MOU for the 500Mbps will carry us through the end of the 2013-2014 school year. For the start of the 2014-2015 school year in July 2014, we have plans to increase our bandwidth with ACOE to 1Gpbs (gigabit per second). The proposed MOU for ACOE will be a total of $13,250 to cover for the remainder of the 2013-2014 school year. Due to the fact that this is a mid-year increase and our E-rate discounts were calculated based on pricing for 100Mbps connection, E-Rate will only discount approximately 53% (versus our normal 70%) of the $13,250 or $7,000. The remaining $6,250 will be an increase in cost to the District.

9.6 Memorandum of Understanding with Alameda County of Education for Security Services Passed 📎 1
- To
- Mike McLaughlin, Ed.D., Superintendent
- Minutes
- Trustee Katz-Lacabe expressed his pleasure that the District would be switching from Lightspeed Systems to Palo Alto Networks (PAN) for our new content filtering solutions. With that, the Board approved the Memorandum of Understanding with Alameda County Office of Education for Security Services. Trustee Toro was absent.
- Staff Recommendation
- Approve the Memorandum Of Understanding (MOU) with Alameda County Office of Education (ACOE) to utilize Palo Alto Networks for content filtering and firewall service replacing Lightspeed and the District's Cisco ASA.

- Motion Approve the Memorandum Of Understanding (MOU) with Alameda County Office of Education (ACOE) to utilize Palo Alto Networks for content filtering and firewall service replacing Lightspeed and the District's Cisco ASA. - Motion made by Mike Katz-Lacabe and a seconded by Ron Carey. | Vote: Yes Lance James .; Yes Ron Carey .; Yes Diana Prola .; Yes Mike Katz-Lacabe .; Yes Corina N. Lopez .; Yes Vince J. Rosato .
- Background Information
- Currently, San Leandro Unified utilizes Lightspeed Systems for our internet content filtering device. Over the years Lightspeed has not improved the intelligence or quality of their product in comparison to their competitors. The improvements they have made to their product have only made the management of the content filtering more convoluted and difficult to configure. As a result, it is increasingly difficult for the District to continue accurately filtering content that is either appropriate or inappropriate for our students and staff. In addition, the current technology used by the Lightspeed device has been known to cause latency and slow down our internet access which translates to a slower internet experience for our staff and students. Thus, we are switching over to Palo Alto Networks (PAN) for our new content filtering solution. It is a service currently provided by Alameda County of Education (ACOE) and is being utilized by several other school districts in Alameda County including Newark, Hayward, New Haven and Alameda with positive results and feedback. This solution will also provide a few other benefits. First, we no longer need to maintain a server on our facility for content filtering. This also means we no longer need to worry about its failure and having to also purchase and maintain a backup device. Moreover, the PAN is also a full featured next-generation firewall. As we increase our bandwidth to 1Gbps (gigabit per second) and beyond, our existing Cisco firewall would not be able to handle such bandwidth speeds. Thus we would be forced spend on a new firewall solution. By migrating both content filtering and firewall services to PAN, it would alleviate us from the additional expenditures of having to purchase more servers. Lastly, this total solution will prove to be even more of a cost savings to the District the PAN solution is eligible for E-rate discounts as previously Lightspeed license charges were not. Normally, there is a setup cost associated with signing on for the service. However, because we are starting this service mid-school year, we have negotiated with ACOE to postpone the startup costs until the 2014-2015 school year in July of 2014. That way, the service charge, along with the setup costs can be discounted through E-rate.

9.7 Contract with AT&T to Connect San Leandro Unified School District to Alameda County Office of Education Passed 📎 1
- Fiscal Impact
- The monthly rate for the 500Mbps connection is $1603.58. This is an increase of $604.23 per month over our existing contract. However, after E-rate and California Teleconnect Fund discounts, the difference in cost to the District is only an additional $90.64 per month. So the total cost to the District will now approximately be $240.54 per month for this new contract.

- Responding to Trustee Katz-Lacabe, IT Administrator Ling King, clarified that the District has two contracts - one with the Alameda County Office of Education, and the other with AT&T. He explained that ACOE provides the bandwidth to the Internet. and AT&T provides the conduit, or the physical connection (using fiber cable), from the District Office to ACOE for us to access the ACOE Internet. Staff also noted that, in response to Trustee Prola, the District is currently in discussion with the City regarding linking all the schools to the Lit San Leandro link, noting that the final date of completion will occur somewhere around the third quarter of 2015. With that, the Board approved the Contract with AT&T to Connect San Leandro Unified School District to Alameda County Office of Education. Trustee Toro was absent.

AT&T is allowing San Leandro Unified to sign a new month to month contract until July 2014 which will provide us with a 500Mbps connection to ACOE. This new contract will supersede the existing portion of the contract relating to the District ? ACOE connection. When this month to month contract terminates in July, we will replace it with another contract either with AT&T or another vendor to upgrade to a 1Gbps (gigabit per second) connection to ACOE for the start the 2014-2015 school year. 9.8 Resolution No. 14-03 Proclaiming the Month of March as Art IS Education, 2014 Theme "Tell Your Story" 📎 1
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Adopt Resolution No. 14-03 Proclaiming the Month of March as Art IS Education, 2014 theme "Tell Your Story"
- Background Information
- March 2014, marks the 14th Year Anniversary of Art IS Education, a month-long celebration of student achievement through the arts and arts integrated curriculum. The District has had a long-standing relationship with the Art IS Education Program with Alameda County Office of Education (ACOE). For the last 7 years it has taken the form of our Teacher Action Research Initiative (TARI) work at all of our elementary schools and the last 2 years in our middle schools. Through TARI, our classrooms have been developing and using culturally responsive arts integration to support and enhance student learning. Imaginative student art work integrated with their writing abounds classrooms and hallways at every school site. 9.14 Resolution No. 14-02 of the Board of Education of the San Leandro Unified School District Authorizing the filing of an Application for Qualified Zone Academy Bond (QZAB) Allocation with the California Department of Education, and Approving Related Matters and Official Actions 📎 1
- Fiscal Impact
- Potential funding of $5 million interest-free through the QZAB program
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Approve Resolution No. 14-02 of the Board of Education of the San Leandro Unified School District authorizing the filing of an application for Qualified Zone Academy Bond (QZAB) allocation with the California Department of Education, and approving related matters and official actions.
- Board Committee
- Facilities and Technology Committee: January 29, 2014
- Background Information
- The Qualified Zone Academy Bond (QZAB) program permits public schools serving large concentrations of low-income families to benefit from interest-free financing to pay for building repair; invest in equipment and technology, develop challenging curricula, and train quality teachers. The federal government provided this tool under the ?Taxpayer Relief Act of 1997? to help encourage formation of partnerships between public schools and local businesses. The QZAB program allows school districts to issue taxable bonds that provide financial institutions holding the bonds with a federal income tax credit in lieu of interest payments. Participating schools must meet at least one eligibility criteria before they can participate in the program. One criteria is that at least 35% of the school?s students must be eligible for free or reduced-price lunch under the National School Lunch Act. The San Leandro Unified School District is in need of funding for technology projects which qualify for the QZAB program at San Leandro High School (the "Academy"), and in order to lower the borrowing costs associated with funding its technology projects, desires at this time to authorize the filing of an application with the Department of Education in order that it may issue obligations which are QZABs.

- Staff Recommendation
- Approve bond contracts on the attached spreadsheet which are for amounts $15,000 or less for fiscal year 2013-2014.
- Background Information
- Approval of bond contracts for small amounts comes up each fiscal year as a discussion item. Associate Superintendent of Business and Operations has researched with three separate legal counsels regarding the process to approve professional consultant contracts in general, and especially in relation to the size of the contract. Each of these legal counsels has advised that the District formally present any contract for professional services to the Board for approval regardless of the amount. A contract is in place when it has an ?offer?, ?term(s)?, and ?acceptance?.? Using the programmer of Accountability (construction software), staff developed an appropriate format for construction related service contracts under $15,000, which is the standard threshold for construction related services. This was approved by the Board of Education on October 16, 2012. Attached is the ?Summary Spreadsheet for Bond Contracts $15,000 or Less.? The spreadsheet will be provided to the Board at every board meeting, if there are any contracts falling under this category. Detailed contract information or cover pages will not be part of subsequent Board Packets, but will be available for questions or inspection upon request.?

9.22 Leasing Agreement between San Leandro Unified School District and DELL for Chromebooks, Management Software and Accessories Purchase Passed 📎 1
- Fiscal Impact
- 3 year lease for $302,654.86 of Common Core State Standards Budget
- To
- Mike McLaughlin, Ed.D., Superintendent
- Minutes
- Trustee L?pez expressed concern and asked that the item be pulled and brought back to the Facilities and Technology Committee for further discussion regarding the $302,654.86 expenditure and to establish a process on how we go about ramping up our technology infrastructure. Trustee L?pez added that it was important to her as a Trustee to go through this process much more methodically and informally at the committee level. Assistant Superintendent Mucetti appreciated the feedback around being more methodical; however, with regards to this purchase and the Apple Instructional Innovator purchase, she explained that the District is moving quickly with this initial wave because of the need to meet the demands of both the Common Core State Standards implementation and the Smarter Balance Assessment Consortium (SBAC) online testing that is expected from the state, and it is imperative that the District gets a minimal baseline of devices in the hands of our students to implement the pilot. Trustee Katz-Lacabe noted that while he appreciates the time constraints, the number of questions that were raised tonight reflects the need for items such as this to be vetted by committee before hand, so that when it comes to the Board for consideration, not only is staff fully prepared, but members of the committee can help explain some of these issues to other Board members. With that, the Board approved the Leasing Agreement between San Leandro Unified School District and Dell for Chromebooks, Management Software and Accessories Purchase. Trustee Toro was absent.

9.26 New Course Description for AP Physics 1 📎 1
- Fiscal Impact
- None anticipated; current book will be used.
- To
- Mike McLaughlin, Ed.D., Superintendent
- Staff Recommendation
- Approve the attached course description for the AP Physics 1 class
- Board Committee
- Discussed and recommended to the Board by the Board Curriculum Committee (BCC) on January 29, 2014
- Policy / Code
- BP 6141--Curriculum Development and Review
- Background Information
- AP courses and materials are regulated by the College Board. As part of an ongoing effort to update and align these requirements with Common Core, every year 2-3 courses are designated by the College Board to be revised. Currently we offer AP Physics B, a one year course, at SLHS. The COllege Board has made a major change in AP Physics that goes into effect in 2014-15. In the College Board revision for this course it will be divided into two one year courses called "AP Physics 1" and "AP Physics 2". There will be two separate annual AP tests and two opportunities for students to take AP Physics (1 and 2). The department developed the attached course description based on the new College Board requirements for next yaer's AP Physics 1 Course. There will be another description for AP Physics 2 but that will not be offered until 2015-16 since AP Physics 1 is a prerequesite. The current textbook is still recommended for the class with it now being used over a two year period. Thus, there are no anticated new costs other than the standard requirement of buying more books when more students sign up for a given course.

- Background Information
- There are new and different demands being placed on districts across the country and in California in particular due in part to the adoption of Common Core Standards, the implementation of the Smarter Balanced assessment system, and the increased implementation of California's new school funding system (Local Control Funding Formula). The departments in school districts most affected by these changes are the educational services departments. These departments are charged with implementing the new standards and the new assessment system. This requires a tremendous amount of planning, training, and technology integration. In addition, the new funding formula requires student performance and achievement to be part of the local funding plan. The burden for making this happen falls primarily on educational services departments. Accordingly, this restructuring plan is proposed to meet these new demands. The first phase in this plan will be to restructure the roles and responsibilities of the director positions in this department. Currently there are three director positions in the educational services department: Student Services, Special Services, and Curriculum & Instruction. This restructuring proposal would eliminate these positions effective July 1, 2014, and create three new director positions: 1) Director, Teaching, Learning and Educational Equity 2) Director, Instructional Technology, Assessment, Research and Evaluation 3) Director, Student Services, Community Wellness and Special Education effective March 1, 2014. The overlapping period between March and June will allow for a smooth transition to the new educational services structure. The new structure will allow for the three departments to be more integrated and aligned in order to support career and college readiness for all students in SLUSD. The duties of the new positions will be aligned with the new demands placed on Educational Services. Approval of this agenda item will approve the positions, set the duties of these positions, and approve the job descriptions.
