B PUBLIC TESTIMONY - CLOSED SESSION ITEMS
- Minutes
- Jon Sherr, San Leandro Teacher Association President (SLTA), shared SLTAs perspectives on bargaining and why they're profoundly disappointed with the school district's current economic offer. He admitted there has been some progress in our school district and gave credit to our Board and our district administrators. He also stated that SLTA agreed to cuts over the years. But instead of those cuts returning to the classroom in smaller class size and smaller counselor/teacher ratios, those costs were rolled onto the salary schedule. SLTA knew this would impact teachers, counselors and the quality of education. They were balancing this decision with the crisis of a low salary schedule, which SLTA believed was the best move to make at that time. Now, Mr. Sherr regrets that decision. He specified statistical information to the Board over the past few years, comparing our district with neighboring districts and the pay raise percentages. The current year's percentages reflect our school district is getting less than Hayward Unified School District. He explained that we need more than average gains and referred to a handout from California Teachers Association (CTA), which was given to board members upon his completion of his public testimony. Mr. Sherr explained it will be difficult to find teachers to fill positions if the salaries fall far behind neighboring school districts. Mr. Sherr expressed disappointment because after the early progress of making teacher salaries more competitive we'll give up most of those gains in one cycle. What he found most disappointing was that the school district appears to be playing by the old playbook of programs versus compensation.

F PUBLIC TESTIMONY ON NON-AGENDA ITEMS
- Minutes
- Louise Shaw, a teacher at Wilson Elementary school, expressed her concern of the problems her classroom has faced with the Chromebooks. She noted that students are required to take state mandated tests but only have access to old carts with failing chromebooks. There are several chromebooks which have parts that don't work, which makes it distracting and counterproductive to her classroom. Ms. Shaw suggested that the district and board ask grade level leadership reps at each school for input on changes that impact students directly.

H.1 General Overview of the McKinney Vento Services within SLUSD
Recommended motion
None
- Speaker
- Victoria Forrester & Consuelo Zuluaga
- Rationale
- The McKinney-Vento Education of Homeless Children and Youth Assistance Act is a federal law that ensures immediate enrollment and educational stability for homeless children and youth. Each year our district serves over 200 homeless students who generally need support with basic needs. SLUSD has been eliminating barriers that contribute to exclusion from school or enrollment delay. Identified homeless children in SLUSD are enrolled in school immediately and an array of services and resources are provided to our families during our intensive intake process. This presentation will highlight the services and resources provided.
- Minutes
- Victoria Forrester, Director of Special Services, Student Services and Community Wellness, and Consuelo Zuluago, the Coordinator for McKinney-Vento, presented an overview of the McKinney-Vento (MV) program in our school district. The presentation included how many MV students we currently have in our school district and how local community organizations provide support needed to MV families.

L.2.a Adopt Resolution No. 16-37 Gann Limit Passed 📎 2
Recommended motion
Adopt Resolution 16-37 Gann Limit.
- Rationale
- In November of 1979, the California electorate adopted Proposition 4, commonly called the Gann Amendment, which added Article XIII-B to the California Constitution. The set of provisions of that article established maximum tax appropriation limitations, commonly called “Gann Limits,” for public agencies, including school districts. The District must establish a revised Gann Limit report each fiscal year in accordance with the provisions of this article and applicable statutory law. Attached is the Gann Limit for the San Leandro Unified School District.

L.2.b Adopt Resolution No. 16-38 for Temporary Borrowing Between Funds or State Deferral Anticipation Note (SDAN) Passed 📎 1
Recommended motion
Adopt Resolution No. 16-38 for Temporary Borrowing Between Funds or State Deferral Anticipation Note (SDAN).
- Rationale
- Education Code Section 42603 permits the Governing Board of any school district to direct that monies held in any fund or account may be temporarily transferred to another fund or account of the district for payment of obligations. The transfer shall be accounted for as temporary borrowing between funds and shall not be available for appropriation or be considered income to the borrowing fund. The State of California changed the way public schools are funded with the implementation of the Local Control Funding Formula (LCFF), effective July 1, 2013. As with the prior Revenue Limit Funding Model, districts receive monthly apportionment distributions that vary in amounts which may cause temporary cash flow shortages. As a precautionary step, and in order to meet all financial obligations on a timely basis, the Business Services Department recommends that the Board adopt a resolution allowing temporary inter-fund cash borrowings up to $5,000,000 for the 2015-16 Fiscal Year, in case temporary cash shortfall occurs. The General Fund will repay the current interest as designated by the County Treasurer. Staff will continue to assess and monitor the District's cash flow. In case cash from other funds is not adequate, staff will come back to the Board for a recommendation to issue a SDAN (State Deferral Anticipation Note) for 2015-16.
- Financial Impact
- Interest incurred during the period of inter-fund borrowing.

L.2.c Adopt Resolution No. 16-39 for Temporary Borrowing from the Alameda County Treasurer Passed 📎 1
Recommended motion
Adopt Resolution No. 16-39 for Temporary Borrowing from the Alameda County Treasurer.
- Rationale
- Article XVI, Section 6, of the California Constitution and Education Code Section 42620 allows for borrowing from the County Treasury, when there is not sufficient cash available to pay its obligations for current operating requirements lawfully incurred in the 2016-17 fiscal year. The following restrictions apply to this authorization: 1. Maximum amount of authorized borrowing: $5,000,000 2. For Fiscal Year: 2016-2017 3. Shall not exceed 85 percent of the anticipated revenues accruing to the district. 4. Shall not be made prior to the first day of the fiscal year nor after the last Monday in April of the current fiscal year. 5. Shall be replaced from revenues accruing to the district before any other obligation of the district is met from such revenue.
- Financial Impact
- Funds borrowed from the county treasury would incur the county's standard interest rate. The most recent published rate was 0.33% as of June 2016. Any borrowed funds in the district account would accrue interest at the same rate until spent, bringing the net cost of borrowing for any unused funds to zero.

L.4.b Annual License Renewal with Imagine Learning for the 2016-17 School Year Passed 📎 1
Recommended motion
Staff recommends approving the Annual License Renewal with Imagine Learning for the 2016-17 school year.
- Rationale
- Imagine Learning provides strategic first-language support in 15 languages and English Language Development to facilitate and enhance English Learner language acquisition as a means to increasing both language proficiency and academic achievement. This instructional software program will support our English Learners as a supplemental program within our blended learning suite as students practice vocabulary, syntax, reading, speaking, and fluency. As students become more proficient in English, this language support gradually fades, preparing students for English-only academic environments and overall improved success in school.

M.1.a Adopt Resolution 16-40 in Support of Proposition 55 - The Children's Education and Health Care Protection Act of 2016 Passed 📎 1
Recommended motion
Approve Resolution 16-40 in support of Proposition 55.
- Rationale
- California students, schools and colleges can’t afford to go back to the days of massive teacher and staff layoffs, larger class sizes, and cutting everything from art and music to student transportation and school lunch programs. Proposition 55 does not raise taxes on anyone; it simply maintains the current income tax rates on the wealthiest Californians. Prop. 55 prevents nearly $4 billion in funding cuts to public education and protects other vital services, like children’s health care. Money goes to local schools and the Legislature can’t touch it. Proposition 55 contains strict accountability to ensure funds designated for education go to local schools and community colleges, with tough audit requirements and criminal prosecution to discourage any potential for waste or fraud.

M.1.b Adopt Resolution 16-41 In Support of Proposition 58, The California Education for a Global Economy (EdGE) Initiative Passed 📎 1
Recommended motion
Adopt Resolution 16-41 in Support of Proposition 58, The California Education for a Global Economy (EdGE) Initiative.
- Rationale
- Since Proposition 227 was passed in 1998, California has taken a new direction in both multilingual education for all students, as well as instruction for students who are not native English speakers. English language development (ELD) standards are now aligned with the California’s State Standards, and Proposition 227 is no longer reflective of California’s approach. A result of bipartisan action of the California Legislature, the EdGE initiative amends and repeals the portions of Proposition 227 that require all classes to be taught in English and for English Learners to be taught in sheltered immersion courses. The EdGE initiative also provides greater flexibility for students who are native English speakers to participate in programs to learn other languages. This initiative is an important step to allowing English Learners to have a voice in their educational pursuits and to providing the opportunity for these students to excel. Similarly, this measures provides all students with greater access to multilingual and multicultural education, which develops skills vital to today’s global workplace.

M.2.a 2015-2016 Unaudited Actuals SACS Report Passed 📎 1
Recommended motion
Approve Unaudited Actuals for 2015-16.
- Rationale
- Introduction Each year, the district presents financial data to the Board of Education, the Alameda County Office of Education, and the California Department of Education that reflects the final results of the school district’s year end closing process. This financial information is the Unaudited Actuals of the district. Unaudited Actuals must be presented to the Board of Education by September 15 each year for consideration. The following is a summary of the highlights of the General Fund. Revenues Overall, the district ended the 2015-16 Fiscal Year with total General Fund combined revenue of $92,895,120, which was an increase of more than $15 Million from 2014-15. The increase was mostly comprised of a $9 Million increase in LCFF funding (ongoing) and $4 Million in outstanding mandate claims (one time funding). Expenditures Overall, the district incurred total General Fund combined expenditures of $91,068,805. This represented an increase of about $13 Million from 2014-15. Approximately 80% of General Fund expenditures were for salaries and benefits. The district transferred a little under $1 million out of the General Fund (net) for items such as Adult Education contribution, QZAB payments, ROP pass-through, and transfers to Fund 67 (insurance). Fund Balance The District's Ending Fund Balance increased by $1,005,747 in 2015-16, with a final balance of $5,879,520. The total Ending Fund Balance is comprised of an Unrestricted balance of $4,209,324 and a Restricted balance of $1,670,196. The district has about $1.4 Million in "excess" reserves, which are defined as any Ending Fund Balance above the 3% minimum. The District's current multi-year projection assumes about $1.6 Million in cuts for 2017-18 and $4.8 Million in cuts for 2018-19 in order to maintain the 3% reserve.

M.2.b Bond Refunding Passed 📎 2
Recommended motion
Authorize district staff to proceed with preparation of bond refunding resolution and documentation which would be presented to the Board of Education at the October 11, 2016 meeting for final consideration.
- Rationale
- Authorize district staff to proceed with preparation of bond refunding. This bond refunding option would save district taxpayers approximately two million dollars over the term of the refunding bonds. The refunding would demonstrate the district's ongoing commitment to minimizing the total cost of our bond program for taxpayers. California Financial Services, which serves as the district's Financial Advisor, has prepared the attached presentation as an additional reference for the Board of Education.

M.2.c Approve the agreement between SFSPac and San Leandro Unified School District Passed 📎 1
Recommended motion
Staff recommends approval of a one year contract with SFSPac Food Safety and Sanitation System.
- Rationale
- SFSPac is a complete system of food safety and sanitation. The system, includes monthly educational training, delivery of cleaning and sanitizing solutions that are biodegradable, butyl free, acid free and carcinogen free, and a complete HACCP Plan for one year beginning Oct 1, 2016. Beginning July 1, 2016, The Professional Standards as part of the Healthy, Hunger Free Kids Act of 2010 was implemented. The final rule established minimum professional standards for school nutrition personnel who manage and operate the National School Lunch and School Breakfast Programs. The final rule requires all personnel in the school nutrition programs to complete annual continuing education/training. These regulations are expected to result in consistent, national professional standards that strengthen the ability of school nutrition professionals and staff to perform their duties effectively and efficiently. With more onsite cooking, the need for additional training and monitoring is critical to ensure that the foods served to our students are prepared in a safe and sanitary environment. Onsite instruction as well as online videos will be provided. SFSPac will also provide ServSafe Training when needed.

M.3.a Recommendations from the SLUSD & Teamster/Trades Joint Taskforce Passed
Recommended motion
Approve the recommendations from the SLUSD & Teamster/Trades Task Force to add a carpenter position to the Trades bargaining unit.
- Rationale
- During reopener negotiations for the 2015-16 school year, the Teamsters Union Local No. 856 and Alameda Building Trades Council reached a side letter of agreement with the district to form a joint task force to review workloads across the district including tasks and money spent on contracted services for work that could reasonably fall within the Teamster/Trades bargaining unit. In this side letter, the district agreed to add two positions to this bargaining unit and make recommendations to the Board of Education prior to July 1 about these positions. In June 2016 the Board of Eduction took action to add a position to the Teamsters bargaining unit. The task force committed to continue meeting to make a recommendation to add a position to the Trades bargaining unit in September 2016. M.4.d MOU between San Leandro Unified School District and Community Youth Court Passed 📎 1
Recommended motion
Staff recommends approval of this Memorandum of Understanding between the San Leandro Unified School District and Community Youth Courts.
- Rationale
- Community Youth Courts offers a disciplinary option (diversion program) to at-risk SLUSD students. We offer youth a second chance via restorative justice, positive peer support and interaction, and person growth opportunities. Services to include but not limited to: referring students to targeted community service projects; case management and counseling. The plan will improve our district’s capacity for servicing students at risk for future disciplinary conduct. Community Youth Courts will conduct regular youth court sessions to address the early stages of juvenile delinquency by bringing students before a jury of their peers. “Sentencing” includes restorative sanctions such as community service, jury duty, Life Choices class, apologies and/or restitution using restorative justice principles. Emphasis is placed on engaging students in character building experiences and maintaining respectful treatment of offenders and victims. Participating youth learn about making responsible choices and accepting the consequences for their actions.
