  14. D RECONVENE TO OPEN SESSION - 7:00 P.M.
    Minutes
The Board reconvened to open session at 7:00pm. President Oshinski read a statement as follows: Before we get started tonight, I would like to provide the community with some timely information regarding the district's preparation for resuming in-person instruction, specifically as it relates to the waiver process for elementary schools that has recently been made available. Last week, the Alameda County Office of Education requested all school districts to submit a questionnaire indicating their interest in applying for a waiver to reopen elementary schools. San Leandro Unified officials submitted the questionnaire indicating an interest in reopening our elementary schools to small, cohorted groups of students under the guidance of our county educational and public health agencies. By submitting this questionnaire, district leaders were able to access the detailed requirements necessary to obtain an elementary school waiver from the Alameda County Public Health Department. Although the district is positioned to address many of the prerequisites on this waiver, we are currently unable to demonstrate our capacity to perform frequent and rapid employee testing, as are most public school districts in the area. This requirement means that each school district would have to contract with a private testing provider and bear the associated costs. We are exploring partnerships with local agencies to provide this service, but we are logistically and financially far from being able to meet this requirement. With a deadline of Friday, October 2, to submit the waiver application to the Alameda County Public Health Department, and a full understanding of our current inability to meet this key requirement, the district will not be applying for an elementary waiver at this time. However, we continue to plan accordingly for all reopening requirements, including this significant challenge of staff testing, to be positioned to welcome back students when it is safe to do so. We are actively working with our labor unions to reach full partnership on the best way to resume in-person instruction, knowing that a significant burden is being placed on our families and our entire community. Thank you for your ongoing support and we will continue to update you frequently on our progress.

  22. H HIGH SCHOOL REPORT
    Speaker
Dr. Reginald Richardson & Dr. Ronald Richardson
    Minutes
Dr. Reginald Richardson and Dr. Ronald Richardson provided a school report as follows: High school is off to a great start with virtual learning. The principals provided an update on students’ incomplete status. They described the process for students and families to recover grades from incomplete status. In the no harm grading recovery student support plan, high school administration utilized Dr. Patel's suggestions and collaborated with their teachers. Staff communicated to students who had outstanding assignments to determine the best means of support to complete assignments. Students and families were notified of their status that was on their transcript and informed them of the Sep 25 deadline and offered supports to recover their grade to a passing grade. Over the summer administrative staff collaborated with teachers virtually to discuss criteria. There were two data points discussed which provided statistical information: 1. At the end of the spring semester there were 225 students with incompletes but this sub group of students had a D- or better. With staff collaboration 207 students received a passing grade for the semester. Staff is working with the 18 students currently with incompletes to get their assignments in. 2. There were overall 1,395 students with incompletes. There are several factors that could contribute to this status. The administrators goal was to engage and support the students to obtain passing status. They reviewed and analyze data for the possible causes of the INCs. Staff and admin addressed those students and they now have a PASS on their transcript. The principals stated that the school had a successful community engagement forum in August. Admin and staff provided families and community with a better understanding and rationale for the 3x3 block schedule with the quarter system. There was a panel of students and families who discussed their distance learning experience last semester. The staff heard the good feedback and items that need to be improved upon regarding this process. Staff has received great feedback for the start of this school year. The next high school community engagement meeting will be Friday, October 2. COST (Coordination of Service Team) is up and running and supporting students. Counseling support includes ensuring students are informed around FAFSA, college education, admissions and scholarships. The counseling staff is also monitoring student status for seniors. They were proud to announce a 2016 high school alumni is returning to the high school as an EAOP and college advisor. Counselors will begin their one to one meetings with senior students through their English classes to review their transcripts and discuss post-graduation plans. Admin staff is providing guidance for families and students currently enrolled in AP courses. During asynchronous time, students not taking AP courses, College Board is offering classes for free. The principals discussed the importance of family discussion about the importance of enrolling in AP courses. They are also supporting the EL learners and students with IEPs and 504. Admin and staff hope to reclassify a majority of their students that obtaining the necessary score from their 2019 LPAC. An assessment update was included. Admin is working with their teachers to have their ILT and climate committee review how students are being assessed around grading for equity to give staff understanding on how they are improving on their practices. Cal Mentors Math Tutoring Program will be working with their students. The principals announced “The Principal’s Connection” via zoom every other Thursday. This enables the Admin team to work with the community and communicate effectively to families.

    Speaker
    Dr. Sonal Patel
    Rationale
Dr. Sonal Patel, Assistant Superintendent of Educational Services, will provide a brief introduction of the San Leandro Education Foundation's (SLED) new executive director.
    Minutes
Dr. Sonal Patel, Assistant Superintendent of Educational Services, introduced the new executive director of the San Leandro Education Foundation (SLED), Terra Cole-Brown. Terra will provide brief background information and inform the audience about SLED's direction for the year. Terra has lived in the bay area for a year. She described her background in urban regional planning (MBA) and extensive background in public policy and policy analysis. Terra has worked for non-profits, higher education, state education, school districts, and is excited to be working for students on behalf of school district families in San Leandro. Terra stated that she wants to ensure that SLED has a stable foundation between them and the school district. Her goal for SLED this year is streamlined and cohesive management to their administrative structure. She is trying to operationalize the organization in such a way that SLED is more of an asset and able to respond quickly to both the needs of the district and community. One of the challenges she has for the SLED board is to take a deep dive into the mission and vision statements to ensure that what SLED is doing is still what they need to be doing, and is it what the community wants. She is looking to the school district to provide SLED with that information to help them lead that direction. Terra stated that SLED is looking for board members, which can include a student advisory board eventually. SLED wants to diversify by age, race, gender and ethnicity to be reflective of the community. Terra wants to steer the conversation from giving donations one time a year at an event to giving year round. She wants to emphasize giving to SLED is giving to the district.

LCFF Revenue comes in two parts: $89,591,237 - this reflects 36% coming from property tax and 64% coming from state aid. General Fund Expenditures were $110,852,981. Salaries and benefits make up 84% of the district budget. A display was shown reflecting Ending Fund Balance Comparisons from 2016-16 to 2019-20. For the 2019-20 school year, General Fund Combined Revenues total - $115,004639 General Fund Combines Expenditures $110,852,681 General Fund Unrestricted Ending Fund Balance $9.741,151 Excess Reserves (Above 3%) 5.7% Dr. Collins stated that reserves increased in the 2019-20 due to decreased expenditures during the three month "shelter in place". As the school district shut down, the district was not able to spend dollars as intended last school year. Other Funds Fund 11 - Adult Ed Ending Fund Balance increased by $140,052 to $1,895,452. A portion of the Adult Ed reserves are being used for the installation of 5 portables. Fund 13 - Cafeteria Ending Fund Balance increased by $474,747 to $2,370,153. Majority needs to be spent by 12/30/2020 (pending state legislation update) * Unduplicated count will be major focus for district to ensure this is no major loss of funding It is very important for all students to complete the free and reduced lunch applications for the school district. Each additional application above a threshhold we receive from students who qualify for free and reduced lunch is approximately $6,000 for the district. These form are important for us for our revenue to provide the programs needed district wide. Cash Deferrals * As part of 2020-21 budget deal, the state has implemented a system of cash deferrals. With no federal assistance, this is looking very likely. *Cash owed to the district in 2020-21 will actually be received in 2021-22. Our deferrals will start this year in February with the final payments coming back in November. *To address district's cash needs, staff is recommending participation in the CSBA Tax Revenue Anticipation Note (TRAN) program *Resolution 20-44 on this agenda would authorize a cross-year TRAN of up to $15 Million, with repayment in 2021-22 Proposition 15 - Split Roll Initiative *Prop 15 will e on November ballot; its the split roll initiative where businesses could be reset in terms of their property tax base and go up more than 2% per year *LAO estimates between $2.6 Billion and $4.6 Billion for K-14 *Full implementation in 2025 *Estimated revenue for SLUSD ranges from $3.3 Million to $5.8 Million *School Services of California reports that recent poll from "Probolsky Research" found: 41% of like voters support 48.8% oppose, and 10.3% undecided Next Steps * Our auditors will be on site at the end of September to review 2019-20 financials * The First Interim ends October 31, with presentation to the Board of Education on December 15

  27. J.3 2020-2021 Learning Continuity and Attendance Plan
    Speaker
    Dr. Sonal Patel
    Rationale
Dr. Sonal Patel, Assistant Superintendent of Educational Services, will provide a presentation of the Learning Continuity and Attendance Plan (LCP).
    Minutes
Dr. Sonal Patel, Assistant Superintendent of Educational Services, provided an overview of the Learning Continuity and Attendance Plan. She began by stating this year there has been a huge shift in the way the school district shares our plans for how we'll engage students in academic achievements and social progress. In response to the COVID-19 pandemic, CDE has eliminated the LCAP, the Local Control Accountability Plan. Instead we have the LCP, the Learning Continuity and Attendance Plan for 2020-2021. What is the LCP? • The Learning Continuity and Attendance Plan (LCP) has 4 parts for the school district to address • The purpose is to tell how we ensure learning and services during the 2020-2021 school year and manage impacts related to the COVID-19 pandemic The four parts of the plan are: 1. Continuity of Learning The state would like for us to explain how we will ensure that students since the March 13 shuttering of schools has maintained continuity into the summer and into the new school year whether the instruction is happening online or in person 2. Pupil and Family Engagement & Outreach The school district needs to describe how we will ensure attendance Ensure kids are connecting and attending regularly and the specific supports for specialized groups, such as SPED, FY, EL, McKinney- Vento, and SES (socio-economically disadvantaged students) 3. Mental Health and Socioemotional Well-Being What support systems will we build into the classroom online or in person. What supports will also be available to students should their learning be at home. 4. School Nutrition Access to breakfast, lunch, and supper that we serve students. The district's goal in the LCP throughout this work is to ensure caring, responsive teaching, learning and support systems during the pandemic. The district's vision is to engage families, staff and students as partners and resource them with the best tools. Dr. Patel provided an overview of the LCP components. 1. Continuity of Learning Ensuring our students are connected to class, have needed supports, and are ready to learn! a slide was displayed showing a student receiving all of her materials from her school site in preparation for the first day of school. Continuity in the school district means ensuring access to: • Chromebooks - 6500 devices have been issued • Hotspots - 1000 hotspots issued to students • Supplies - Preschool -12 art, lab, basic supplies have been distributed • Textbooks, instruments and novels have been distributed • Services: tele therapy, EL support, related services are online • Training - Family Ed (fED) webinars every Wednesday at 5pm 2. Pupil and Family Outreach & Engagement Ensuring our students are attending classes and ready to learn • As a school district:95% of students attending school traditionally during the 2019-2020 school year • 100% of our schools have a tiered intervention plan for engagement and attendance • 99.3% of parents are contactable in ParentSquare via email and text 3. Mental health & socioemotional well-being We are ensuring our students are feeling confident, well and are ready to learn. A photo was displayed showing high school students wearing their Pirate gear on pride day. • The district wants to ensure the socioemotional Learning (SEL) • We're providing SEL curriculum for distance learning, the SEL committee is set to expand the program and partners with wellnesstogether.org • We're providing training and support spaces to build SEL practices into home learning spaces • The district website provides information on virtual parent support every Wednesday • Mental Health Services o 100% of our families, students (and employees) can access CareSolace 24/7 for support connecting to mental health services o All of our school sites have COST (Coordination of Service Team) teams and coordinators to ensure our increased mental and behavioral health services are used and accessible 4. Nutrition Ensuring that our students are healthy, well fed and ready to learn during this pandemic. A display reflected meal distribution. Every Monday, Wednesday and Friday at seven locations meals are being distributed. Expanded services includes meals for the weekends. Meals are being provided for all children 18 and under. No barcode or proof of residency is needed. Students can get a meal from any of the seven locations. The community requested meal pickups in the mornings in addition to the afternoon; therefore, Monroe Elementary, John Muir Middle School and the high school provide morning and afternoon pickup. To date, our district has served over 30,000 meals a week. The district has also serviced over 10,000 snacks a week to students. Dr. Patel explained the engagement process she and her department embarked on to aid in developing this plan. The process included a review of over 2100 family surveys. On August 12 she and her team reached out to parents participating in the District English Learner Advisory Committee (DELAC) for feedback. On September 1 they reached out to the LCP Parent Advisory Committee (LCP PAC) for parent additional feedback. Next steps include • Feedback from the public hearing until September 23; process it, analyze it and make revisions based on this feedback • Revision based on feedback September 23 - September 25 • Board approval at the September 29 Board meeting • Send to California Department of Education for review Dr. Patel welcomed ideas from the public by using your students chromebook and access the website to view the Draft LCP in multiple languages and complete a feedback form by September 23. The LCP draft can also be accessed on your phone. Staff has enjoyed the community feedback received to date. Dr. Patel ended her presentation with a quote by Margaret J. Wheatley "There is no power for change greater than a community discovering what it cares about."
  28. K PUBLIC HEARING
  29. K.1 Public Hearing for the Sufficiency of Instructional Materials for 2020-2021 Passed 📎 1
    Rationale
Education Code Sections 60119 [as revised by Chapter 900, Statutes of 2004 and CCR, Title 5, Section 9531 (c)], requires the Board of Education to annually certify through a resolution as to whether each pupil in each school in the district has, or will have prior to the end of that fiscal year, sufficient textbooks or instructional materials, or both, in each subject, including English learners, in mathematics, science, laboratory science equipment for science laboratory classes in grades 9-12, foreign language, health classes, history-social science, and English/language arts, including the English language development component of an adopted program, consistent with the content and cycles or the curriculum frameworks adopted by the state board. If the Board of Education determines that there are insufficient textbooks or instructional materials, or both, the Board of Education shall provide information to classroom teachers and to the public, setting forth the reasons that each pupil does not have sufficient textbooks or instructional materials and take action to ensure that each pupil has sufficient textbooks or instructional materials, or both, within two months of the beginning of the school year in which the determination is made. This required public hearing informs parents and community about the compliance and statement of assurance for the pupil textbook and instructional materials sufficiency or insufficiency of instructional materials for the 2020-2021 school year and offers them the opportunity to address the Board regarding this matter.
    Minutes
Speakers: Rigo stated that staff did a great job in distributing materials. He thinks that the content of the textbooks needs to be adjusted. He is advocating for more ethnic studies material. Ethnic studies is real history which should be included in their studies in the future. Everyone should be represented in our textbooks. He feels that the textbooks currently being used don't tell everyone's story and we can do a better job in representing all of our students.

  30. K.2 Public Hearing for Learning Continuity and Attendance Plan Passed 📎 2
    Minutes
Public testimony: Eduardo Munoz: President of DELAC stated that he appreciated the effort that was put into this plan and the presentation from Dr. Patel. He wanted to argue for more substantial participation from the community. He's noticed a pattern at meetings about presenting information and it is unclear what type of information is being collected. He feels the need for the district to double down in this endeavor since English Learners are being affected by this situation (distance learning) and barriers are rising between them and their knowledge. The DELAC recently received a report which listed statistical information and how this impacts English learners. He suggested that the district increase the money for para educators and increase participation in all schools. He was also willing to provide suggestions on how to use the learning loss mitigation funds before the December deadline. Rigo: the LCP on the high school level has done a great job. Students are inter acting and feel good about learning. He stated that in this environment a lot of high students have jobs and hopes that this is being considered since it significantly impacts families. He stated concern about the impact of distance learning for special needs students and how they're being supported.

State Superintendent of Public Instruction Tom Torlakson, in recognition of September as Attendance Awareness Month, said school districts, public agencies, community groups, students, and their families must work together to combat chronic absenteeism. San Leandro Unified School District hereby commits to focusing on reducing chronic absenteeism to give all children an equitable opportunity to learn, grow and thrive academically, emotionally and socially.

  50. N.2.a Amendment of ALC Contract Passed 📎 2

    Recommended motion

Approve the contract amendment with ALC.

    Rationale
Our district has contracts with two companies to provide transportation services for our special education students. First Student operates small yellow busses for students who live in and attend school within our district. American Logistics Company (ALC) to provide car based transportation to non-public schools and other educational settings outside of San Leandro where sending a bus would not be efficient or economical. ALC's initial contract model involved the use of independent contractor drivers. With the passage of AB 5, this is no longer allowed under state law. ALC has updated its model to work with service providers which in turn employ drivers. We asked ALC to provide an updated contract amendment that clearly lists the updated driver model and provides additional indemnification for the district in the area of employee wages and benefits. The attached amendment describes those updates, with all other existing contract language, including drive background checks and requirements, remaining unchanged and is attached to this agenda item for reference.

Because of the problems associated with finding a transportation provider during spring 2016, as well as uncertainty around COVID-19, staff requesting that we extend the current First Student contract for two additional years. The San Lorenzo Unified School District also is under contract with First Student with the same rates and terms, and busses operating out of Madison Elementary. The attached extension provides for a 2% rate increase in 2021-22 and again in 2022-23, with the contract terminating as of July 31, 2023 (to allow for Extended School Year). The extension also notes that our facility use agreement with First Student to use the office, break room, and parking lot at Madison as well as vehicle repair facilities at maintenance will continue. Also as part of the agreement, SLUSD will receive a $2,000 credit and SLZUSD a $2,000 charge to account for the facility use beginning 7/1/2021. Previously, this charge was handled via a monthly invoice between the two districts. Recommended motion

Approve Resolution 20-43 regarding the district's Education Protection account funding for 2019-20 (estimated actuals) and 2020-21 (budget).

    Rationale
School districts receive Education Protection Account (EPA) funding as part of their Local Control Funding Formula revenue each year. The EPA was approved by California voters in 2012 (Proposition 30) and extended in 2016 (Proposition 55). Districts are required to adopt an annual resolution regarding how EPA funds are used and post an accounting of that usage on the district website. Due to the economic impacts of COVID-19, the state cut district EPA allocations by half for 2019-20. Resolution 20-35 was approved in June using an estimated revenue total of $7,331,785. Resolution 20-43 updates EPA revenue to the actual amount of $7,470,521. EPA revenue is part of the district's LCFF total, so any increase or decrease in EPA revenue is offset by state aid.

  113. O.2.b Resolution 20-44 Authorizing Short Term Borrowing of up to $15,000,000 with a Tax Revenue Anticipation Note (TRAN) Passed 📎 2

    Recommended motion

    Approve Resolution 20-44

    Rationale
The State of California authorized significant cash deferrals to school districts as part of the 2020-21 budget deal. The deferrals will be implemented unless additional federal relief funds are received. Based on current information, the district is projecting a negative cash balance at the end of the year. A negative cash balance would impact our ability to make payroll and to pay vendors. Staff has worked with our financial advisor Dale Scott to allow participation in the California School Cash Reserve Program. Resolution 20-44 would authorize the issuance of up to $15,000,000 in TRAN borrowing. The loan would be repaid in 2021-22 with the cash that is deferred into the next school year. The actual amount of the loan will be calculated when more information is known about the exact timing and scope of cash deferrals. The proceeds of the loan will be deposited into the Alameda County Treasury and will accrue interest. The interest received will offset the cost of the loan. The final cost of the loan will depend on the amount borrowed, the interest rate of the loan, the cost of issuance from the program, the interest rate earned in the county treasury, when the proceeds are received, and when the loan is paid back. With so many variables, it is not possible to to accurately calculate the cost of the loan. However, our financial advisor has estimated that the final cost to the district will be in the "low tens of thousands of dollars." In addition to Resolution 20-44, staff is attaching a program description for the California School Cash Reserve program.
