  43. N.2.a Form J-13A / Request for Allowance of Attendance Due to Emergency Conditions Passed 📎 1

    Recommended motion

Staff recommends approval of Form J-13A / Request for Allowance of Attendance Due to Emergency Conditions.

    Rationale
The attached Form J-13A represents the school district's application to the California Department of Education to exclude October 9, 2019 attendance for all district schools from our annual calculation of Average Daily Attendance. All district schools that day were closed due to an announced Public Safety Power Shutoff (PSPS) by PG&E due to high winds and fire danger. The cause of the shutdown is described in Form J-13A as: All schools in the San Leandro Unified School District were closed on Wednesday, October 9, 2019 due to PG&E's announcement of a Public Safety Power Shutoff that would affect majority of San Leandro. In collaboration with city and county, the district made the decision to close all schools to avoid putting students and staff at risk (no power at intersections or train crossings, no ability to provide meal service, limited phones access and fire alarm systems, dark restrooms and inner corridors, and avoid potential overtaxing of emergency services). The CDE submission includes PG&E blackout maps showing San Leandro and a news article acknowledging the school closure. Form J-13A does not technically need to be approved at a board meeting, however it must be signed by a majority of trustees before being forwarded to the County Office of Education and then on to the state. For reasons of transparency and record keeping, staff is recommending approval of the attached Form J-13A.
    Financial Impact
By completing and approving Form J-13A, the district avoids losing approximately $675,000 in LCFF revenue for the current year.

  44. N.2.b Adopt Resolution No. 19-51 Accounting of Development Fees for 2018-19 Fiscal Year in the following fund or account: Fund 25 Passed 📎 1

    Recommended motion

Adopt Resolution No. 19-51 Accounting of Development Fees for 2018-19 Fiscal Year in the following fund or account: Fund 25.

    Rationale
Government Code sections 66001 and 66006 imposed detailed requirements on public agencies that levy development fees. These sections require school districts collecting statutory school facilities fees to make an annual accounting of those fees available to the public at the end of the fiscal year. The attached report provides additional detailed information of the developers’ fees which was already made public as part of the Unaudited Actuals report on September 10, 2019. In addition, Section 66001 requires each district collecting development fees to make additional findings every five years about any fund in which those fees remained un-expended at the end of a fiscal year. The District has expended the fees that are collected annually. The District's governing board will review this annual accounting and adopt the board resolution for the annual accounting of school facilities fees for the Fiscal Year 2018-19.. Attached are the following: Resolution regarding accounting of development fees for 2018-2019 Fiscal Year Exhibit A Exhibit B San Leandro USD Fund 25 Capital Facilities Five Year Accounting of Revenues and Expenditures By disclosing these reports, the District will have met the requirements of Government Code sections 66001 and 66006.
    Financial Impact

    Recommended motion

Nominate school board members for the 2020 CSBA Delegate Assembly.

    Rationale
Each year, member boards elect representatives to the California School Boards Association's (CSBA) Delegate Assembly. CSBA's Delegate Assembly is a vital link in the Association's governance and sets the general policy directions. Working with member boards, the Board of Directors, and Executive Committee, delegates ensure that the association promotes the interests of California's school districts and county offices of education. Delegates serve a two-year term beginning April 1, 2020 through March 31, 2022. There are two required Delegate Assembly meetings each year. In 2020, the dates are May16-17 in Sacramento and December 2-3 in Anaheim. Nomination and Candidate Biographical Sketch forms for CSBA's Delegate Assembly are now being accepted until Tuesday, January 7, 2020. Nomination instructions are listed below: Any CSBA member board is eligible to nominate board members within their own geographical region or subregion. For example, a board in Subregion A, cannot nominate a board member from Subregion B; both must be from same subregion. Member Boards eligible to appoint a member of their board to the Delegate Assembly may also nominate board members to run for election to the Delegate Assembly. Boards eligible to appoint must do so by January 7, 2020. A separate communication from CSBA regarding these appointments will be sent to boards by November 1. Nominating boards must submit a separate form for each person nominated. All nominees must serve on a CSBA member board and must give their approval prior to being nominated. All nominees must submit a one-page, single-sided biographical sketch form. An optional one-page, one-sided résumé may be submitted.
