O.2.c Approve Amendment to Agreement with American Digital Outdoor Regarding Term of Lease Passed 📎 1
Recommended motion
Approve the First Amendment to Joint Occupancy Agreement between the San Leandro Unified School District and American Digital Outdoor.
- Rationale
- The district signed a ten year lease agreement with American Digital Outdoor in 2013 to install an electronic billboard at Burrell Field. There were several subsequent lengthy delays with receiving approval to install the sign. The district and American Digital Outdoor agreed that lease revenue may be spread out over 25 years rather than 10 years due to potential limitations on sign operation. The sign finally began operation on August 1, 2016 without operational limitations. The district and American Digital Outdoor are requesting approval of the attached amendment which would confirm the lease has a ten year term and runs from August 1, 2016 through July 31, 2026. All other terms of the original lease, including content restrictions, remain unchanged.
- Financial Impact
- There are no direct financial impacts in approving the lease amendment.

P.1.a Eden Area Regional Occupational Program (ROP) Joint Powers Agreement Passed 📎 1
Recommended motion
Review and approve the Joint Powers Agreement.
- Rationale
- The Regional Occupational Joint Powers Agency is a separate legal entity, created by the four member districts for the purpose of providing a regional occupational program which extends, supports, and enhances the fours districts’ current career and technical training programs. This agreement became effective by all parties on July 1, 1997 and is continued until rescinded or terminated. At least every two years the Agreement is reviewed by members of the Coordinating Council. If the Coordinating Council deems it necessary to make changes to this Agreement, the changes will be presented to the respective district boards for approval. The current JPA Agreement expires in June of 2017. The proposed JPA has been reviewed by all four school districts’ superintendents, the Director of the ROP and an attorney. This document is being presented to all four school districts for approval. Upon approval it will be presented to the Governing Council of the ROP which includes one representative from each of the four school districts. P.1.b Adopt CSBA Board Policy Updates for Independent Study (BP 6158 and AR 6158) and Delete Board Policy Distance Learning (BP 6157) Passed 📎 4
Recommended motion
Staff recommends approval of Adopt CSBA Board Policy Updates for Independent Study (BP 6158 and AR 6158) and Delete Board Policy Distance Learning (BP 6157).
- Rationale
- A service provided by the California School Boards Association (CSBA) is to provide school districts with recommended updates to school board policies. Board Policy 6158 - Independent Study and Administrative Regulation 6158 - Independent Study has been updated to reflect NEW LAW (AB 130, 2021) which requires all districts, for the 2021-22 school year, to offer independent study to meet the educational needs of students unless a waiver is obtained and to adopt policy with specified components in order to generate apportionment for independent study. NEW LAW (AB 130, 2021) updates includes, adding definitions for "live interaction," "student-parent-educator conference" and "synchronous instruction," the requirement for all districts for the 2021-22 school year to offer independent study to meet the educational needs of students unless the district has obtained a waiver, that independent study may be offered to students whose health would be put at risk by in-person instruction as determined by the parent/guardian, the assurance of access to Internet connectivity and devices adequate to participate in the educational program and complete assigned work, and the documentation of each student’s participation in live interaction and synchronous instruction pursuant to Education Code 51747 on each school day, as applicable. Board Policy 6157 - Distance Learning has been deleted due to expiration of emergency legislation that temporarily waived apportionment requirements to permit distance learning for the 2020-2021 school year. The board policy listed for adoption are provided below and a summary of the policies is provided as an attachment item. P.3.a MOU for Inter-district Attendance between School Districts and Alameda County for 2021-22 through 2026-2027 School Years Passed 📎 1
Recommended motion
Staff recommends to approve MOU for Interdistrict Attendance between the school districts in Alameda County for the 2021-2022 through 2026-2027 school year.
- Rationale
- Per Education code 46600, the governing boards of two or more school districts may enter into an agreement for a term not to exceed five school years, for the interdistrict attendance of students who are residents of the districts. The agreement may provide for the admission to a district other than the district of residence of a student who requests a permit to attend a school district that is a party to the agreement. It provides that the governing boards of two school districts may enter into an agreement that stipulates the terms and conditions under which interdistrict attendance may be permitted or denied, which may include standards for reapplication and revocation of interdistrict transfer permits. In other words, this agreement allows students who meet our attendance and behavior criteria to be enrolled in our district depending on space availability. It will permit our students to enroll in their district if they meet the said criteria. The permits are approved on an annual basis. It also allows for revocation anytime during the school year if programs are impacted or falsification is determined.

Recommended motion
Staff recommends to approve the new daily rates for substitute employees.

It also increases the rate for long-term assignments and "high impact" days. Staff affirms that the new rate will attract more and better qualified candidates during a time, post pandemic, which will secure a certificated sub in our schools to prevent any unfilled substitute assignments.

P.4.f Approval of Single Plan for Student Achievement (SPSA) 2021-2022 Passed 📎 10
Recommended motion
Staff recommends approval of Single Plan for Student Achievement (SPSA) 2020-2021 for Garfield, ,Madison, McKinley, Monroe, Washington, Wilson, Roosevelt, Bancroft, San Leandro High School and Lincoln High School.
- Rationale
- The Single Plan for Student Achievement (SPSA) is a document that represents a school's cycle of continuous improvement of student achievement. The annual process of developing, reviewing, and updating the SPSA includes a comprehensive review of data and the development of actions necessary to achieve school goals. EC Section 64001 specifies that schools and districts that receive state and federal or other applicable funding through the district’s Consolidated Application (ConApp) process prepare a SPSA for any recipient school. SPSA specifics are also included in the Federal Program Monitoring process. The SPSA is used to meet planning requirements for Title I School wide Programs (SWP), Comprehensive Support and Improvement (CSI), Targeted Support and Improvement (TSI), and Additional Targeted Support and Improvement (ATSI). California Education Code (EC) Section 64001 requires that a School Site Council (SSC) develop the SPSA. The SSC’s responsibilities include approving the plan, recommending it to the local governing board for approval, monitoring its implementation, and evaluating the effectiveness of the planned activities at least annually. The SPSA is a one-year plan that is intended to be developed and approved before or during the school year for which the plan is being implemented. Attached are San Leandro Unified School District’s Title I Schools: Garfield, Madison, McKinley, Monroe, Washington, Wilson, and Bancroft; and Non Title I Schools: Roosevelt Elementary, San Leandro High and Lincoln High School SPSA’s for the 2021-2022 school year. School site principals have conducted work with their School Site Councils in order to create expenditure plans for the school year that are aligned to the goals, initiatives, and tactics in the district's strategic action plan and Local Control Accountability Plan (LCAP). Jefferson Elementary and Lincoln High School are identified as ATSI (Additional Targeted Support and Improvement).

- Rationale
- The regulations of the Williams lawsuit settlement require school districts to complete “Quarterly Complaint” reports that document the number of complaints for textbooks and instructional materials, teacher vacancies and mis-assignments, and facilities conditions. Additionally, effective January 2008, as a result of settlement with the California State Department of Education, districts are required to implement the Valenzuela Settlement Legislation (Assembly Bill 347). Notification regarding the complaint process is integrated into the Williams Complaint form which is posted in every secondary classroom as required.
