  19. 6.1 Overview of Kindergarten Readiness Act of 2010(SB 1381) and Planning for Transitional Kindergarten
    Minutes
Debbie Wong, Assistant Superintendent of Educational Services, provided an overview of the Kindergarten Readiness Act of 2012 (SB 1381) which amended Education Code Sections 46300, 48000, and 48010, and changes the required kindergarten entrance date, phased in over three years, subsequently requiring districts to develop transition kindergarten programs. Transitional Kindergarten (TK) is a two-year kindergarten experience for children. The law requires that it be offered in the 2012-2013 school year, and rather than phase it over a three-year period, the District is considering offering it to all children born within September and December at every site. Children who enroll in TK have one year in TK and one year in kindergarten. Parents are not required to sign a continuance form and after their year in a transitional kindergarten, these children move on to first grade. The Board thanked Assistant Superintendent Wong for the presentation and posed clarifying questions which were addressed by staff.
    Quick Summary / Staff Recommendation

    Quick Summary / Staff Recommendation
Approve Resolution #50-11 in Support of Senate Constitution Amendment 5: School District Parcel Tax
    Board Committee
Advocacy Committee meeting: December 2, 2011
    Background Information
Senator S. Joseph Simitian has sponsored Senate Constitutional Amendment 5 (SCA5): School District Parcel Taxes. SCA 5 allows local school districts, community college districts and county offices of education to approve a local parcel tax with a 55 percent majority rather than the two-thirds majority currently required, provided that certain accountability restrictions are met. By lowering the threshold, SCA 5 provides for local choice and control, and conforms the vote required for a parcel tax to the 55 percent majority required for local school bonds. The California Constitution currently requires a two-thirds majority of a school district, community college district, or county office of education voters to approve a local parcel tax (a flat tax usually assessed per lot of land, regardless of market value). SCA 5 lowers that requirement to 55 percent provided that all of the following conditions are met: 1. The proposition is approved by a two-thirds vote of the membership of the governing board of the school district, community college district, or county office of education. 2. The proposition contains all of the following accountability requirements: (a) A list of the specific purposes and programs to be funded. (b) A requirement that the proceeds be used only for the purposes and programs specified in the proposition, and not for any other purpose. (c) A requirement that the governing board of the district proposing the tax conduct an annual independent financial audit of the amount of parcel tax proceeds collected and expended, and the specified purposes and programs funded. (d) A requirement that the governing board of the district establish a citizens? oversight committee to review all expenditures of proceeds and financial audits, and report its findings to the governing board and to the public. 3. The proposition allows for an exemption from the tax for those persons sixty-five years and older, or, without regard to age, a person or persons receiving Supplemental Security Income for a disability. 4. The total amount of parcel tax impositions, increases, or extensions submitted to the voters shall not exceed two hundred fifty dollars ($250) per parcel per year. (A district could propose a parcel tax at a rate higher than $250, but it would require a two-thirds voter approval for passage.) 5. Proceeds of any tax approved shall not be used to pay salaries of any administrators of any school district, community college district, or county office of education. Given the state?s on-going financial crisis, school districts like San Leandro are now facing severe cutbacks in funding. Worse still, it is unlikely that the state will be able to provide adequate funds in the foreseeable future. Now more than ever, school districts need to find ways to help them maintain quality programs. SCA 5 provides school districts with much-needed flexibility in raising local educational funds. In addition to helping school districts raise revenues, SCA 5 will also give local districts more power to fund programs that are important to them. Much of state funding is earmarked for particular programs. When it comes to raising money that school districts can control, there?s not much choice. A parcel tax is one of the very few ways local school districts can raise discretionary revenue. SCA 5 will increase local choice for local education needs, while ensuring that every dollar generated goes to the school district for locally identified purposes. In the past, school districts have used parcel tax money to enhance instructional programs, hire additional teachers, and support libraries, music, and arts programs? all reflecting local priorities in their local districts. California still lags behind most states in per pupil spending. Although the current financial crisis will lead to reduced state spending on education, schools do not have to languish as a result. Voters can take local action to keep education strong, as they did when they approved a similar proposition on local school construction bonds, lowering the approval threshold from two-thirds to 55 percent. SCA 5 conforms the threshold required for parcel taxes to the voter-approved threshold for school bonds. The Board of Education for the San Leandro School District will consider adopting Resolution #50-11 is in support of SCA5, School District Parcel Tax.

Trustee Sullivan asked for clarification regarding the payment schedule, noting that payment for services needs to be received before the February 2012 completion date. Superintendent Cathey explained that this is how he structures his contract. Trustee Prola also asked if would be possible for him to phrase the question "if people would be most likely vote for a parcel in November as opposed to a mail-in election" on the survey. Superintendent Cathey noted that the Advocacy Committee would be reviewing the questions on Thursday; however she did note that the Board could direct her to try and negotiate a better contract; however if action is not taken on the contract being brought forward tonight, it could delay the timeline.

Approve the Contracted Services Agreement between San Leandro Unified School District and L & M Consultants at San Leandro High School for the 2011-2012 School Year
    Background Information
In 2010-2011, the District contracted services with Dr. Mary Hopewell of L & M Consultants for building and strengthening the administrator and teacher leadership focus on instructional improvement at San Leandro High School. In assessing the foundational needs to support SLHS, the District is seeking to integrate both contracts with L & M Consultants in order to continue deepening and implementing a leadership strategic initiative where the goal is to advance leadership and learning to benefit the whole school community using a professional learning (PLC) approach. In addition to this scope of work, the new contract will support the implementation of PLCs which was launched at all secondary schools this past October. Dr. Hopewell will also provide administrative ?coaching for results? to strengthen leadership effectiveness including administrators and teacher leaders. Mary Hopewell has 25 years high school experience, 10 of those years as a high school principal. Her motto is ?Assisting organizations to achieve their highest potential?. In addition to the planning, travelling, and following up time, the contracted services also include 29 full days for training and facilitation support for the design and development of the Leadership Stategic Planning Initiative, Professional Learning Communities (PLCs) coaching support, and Principal and Administrative Team coaching for results. As the agreement states, because it's a project, all of the peripheral overhead is subsumed versus billed separately, again to make the agreement more cost effective and providing the school unlimited phone consultations, emails, etc. This expenditure has been approved by the School Site Council.

    Background Information
On March 25, 2011, District staff offered a Request for Qualifications (RFQ) for Professional Survey Services for Measure M projects. Marketing efforts included calls to several firms and a posting on the District website. The District received six (6) Statements of Qualifications (SOQs) prior to the submission deadline of April 5, 2011 at 4:00pm. A review of the submitted SOQs was performed by Harris & Associates and District staff. The qualification review was based in part on whether the firm contained professional staff that has a Bachelor of Science in Engineering, a Registered Professional Engineer credential, and a certified Professional Land Surveyor. The amount of K-12 specific experience and local SLUSD K-12 experience was also considered in the selection process. The firm selected that best met all the qualifications and experience criteria for the projects under SLUSD?s Measure M Bond program was Underwood & Rosenblum, Inc. Civil Engineers and Surveyors . On April 19, 2011, the Board approved the contract with Underwood & Rosenblum Inc. in the amount of $33,600 for services associated with the Pacific Sports Complex & Burrell Field. Subsequently, the Board approved Amendment #1 in the amount of $25,500 on April 19, 2011, to include the San Leandro High School Sports Field Renovation Project. Approve the Architectural Services Agreement with Jeffery Wong Architects to provide design and construction administration for Measure M and other projects at Lincoln High School.
    Board Committee
Facilities and Technology Committee: November 22, 2011
    Background Information
On March 1, 2011, the Board of Education approved Jeffery Wong Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure M Bond. The Board of Education has also previously approved Jeffery Wong Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond. This agreement in the amount of $188,000 covers Measure M athletic improvements, Measure B renovations and upgrades, and Measure B savings projects at Lincoln High School. Scope includes: Measure M Repaving of existing parking lot and basketball court areas Installation of new basketball standards and hoops Installation of a new shade structure Installation of a par course Measure B Renovation of existing buildings to include siding, roofing, and painting Renovation or replacement of existing restroom building Addition of office entry door canopy for weather protection Expansion of existing storm water drainage system Installation of new potable water line from existing EBMUD meter Installation of new parking lot lighting Installation of new security gating Measure B Savings Installation of a double wide portable multipurpose building Installation of new landscaping The agreement has been reviewed by the District?s former legal counsel and the template has been used as the District standard through Measure B. The design fee of $188,000 represents 16.9% of the $1,110,000 construction budget. Architectural fees are related to the size and complexity of the project and level of service that the architectural firm can provide for a client, in addition to the fees for specialty consultants necessary for the specific project. Industry standards for architect?s fees for the schematic design phase through DSA closeout phase range from 8% of the construction costs for large modernization projects to 12% for small projects. Fees for extensive or greater than typical community/stakeholder input, master planning, programming, preliminary roofing studies, and preliminary structural investigations of dry rot would be additional. Additional service fees increase the total fee percentage in relation to the construction budget. The fee for this project is above the standard range because the District has requested that the Architect include the following items: 1. Roofing consultant?s evaluation of roofs 2. Structural consultant evaluation of possible dry rot 3. Multiple cost estimates during design 4. Additional pre-design meetings with Measure B and site staff to meet the aggressive project schedule 5. Additional meetings and coordination with the Prefab building manufacturer and with DSA, to meet the aggressive project schedule 6. Analysis to develop and provide recommendations for improvements to existing site utilities The District has elected, for good reason, to use fixed fee contracts, in lieu of paying the architectural fee based upon final construction costs, which are not known at the time of the agreement. The industry standard for this type of contract is a little bit higher. But, the advantage of this form of agreement is that it aligns the District?s goals with the architect?s contract, so that there is no incentive to increase the construction costs by the architect. Each individual architect firm is unique in its proposal and final negotiated cost. Fee Summary Site Construction $ Fee % Lincoln High $1,110,000 $188,000 16.9%

    Background Information
In anticipation of new facility projects to be completed from the project list generated by the passage of the November 2010 General Obligation Bond, District staff drafted, with legal counsel assistance, a Request for Qualifications (RFQ) in January of 2011, with the goal of selecting a pool of qualified construction managers. On January 24, 2011, the District released a Request for Qualifications (RFQ) for submissions of a Statement of Qualifications (SOQ) for construction management services from firms interested in providing professional services to the District. The District required that firms interested in submitting an SOQ be licensed, insured, and maintain a full-service construction management office within one hundred miles of the District. The SOQ deadline was Friday, February 4, 2011, by 5 p.m. On February 4, 2011, the District received sixteen (16) Statement of Qualifications (SOQ) packages by the deadline. During the qualifications based submittal and selection process, the District reviewed and considered the following information: The number and relevance of K-12 school related new construction and modernization projects managed by the firm in the past five years. The firm?s experience with value engineering, life cycle cost analysis and bid alternates, the firm?s DSA experience and qualifications of the proposed staff for each of the firms. Experience in urban development and the public process of communicating effectively with a diverse community of stake holders during the course of the project. The firm?s ability to meet project budgets and schedules; percent of change orders for construction projects; if there was any litigation on the firm?s projects, experience with sustainable design and construction (CHPS, HPI & LEED) projects; and experience working with and getting input from community groups. From the sixteen (16) proposals received, staff did a screening to invite a shortlist of eight (8) qualified construction management firms to interview. These firms were interviewed on March 17 and 18, 2011, and a secondary screening and reference check was completed to determine a final list of qualified construction management firms to complete the voter approved Measure ?M? projects. On April 5, 2011, the Board approved the CM pool and the selection of Van Pelt Construction Services (VPCS), The Alley Group (TAG) and Harris & Associates (H&A). The Board authorized District staff to make project assignments and negotiate agreements with the firms in the pool. On May 5, 2011, District staff finalized the project assignments for the CM firms, as follows: School Site Construction Management Firm Project assignments Garfield ES Van Pelt Construction Services, Inc. Facilities and Technology Committee: November 22, 2011
    Background Information
On March 1, 2011, the Board of Education approved DLM Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure M Bond. This agreement in the amount of $446,500 covers athletic oriented site improvements at Garfield, Jefferson, Madison, McKinley, Monroe, Roosevelt, and Washington Elementary Schools. Scope includes: Asphalt repair and restriping of playgrounds for all sites except Madison and Jefferson Elementary Schools Asphalt slurry sealing and restriping of playgrounds for Madison and Jefferson Elementary Schools Repair and ADA upgrade of existing play structures Provide new play structure fall-zone material within exiting play boxes Provide an outdoor classroom overhead metal shade structures Provide new site ?furniture?, play court equipment (basketball, volleyball, etc.) or improvements as needed Provide par courses at the seven sites including associated pathways Planting and irrigation repair where disturbed by site improvements The agreement has been reviewed by the District?s former legal counsel and the template has been used as the District standard through Measure B. The design fee of $446,500 represents 9.5% of the $4,700,000 construction budget. Architectural fees are related to the size and complexity of the project and level of service that the architectural firm can provide for a client, in addition to the specialty consultants necessary for the specific project. Industry standards for architect?s fees range from 8% to 12% of the construction costs, for the schematic design phase through DSA closeout phase. Normally, extended community input and programming development are in addition to that fee amount. The District has elected, for good reasons, to use fixed fee contracts, in lieu of paying the architectural fee based upon final construction costs, which are not known at the time of the agreement. BP 6141(a) CURRICULUM DEVELOPMENT, IMPLEMENTATION AND EVALUATION Curriculum Development and Review
    Background Information
Many districts are using online programs as an additional curriculum resource and option for credit recovery. We wanted to systematically evaluate which online program would be the best one to use in addition to or in lieu of the the Board-approved text for students who have taken and not passed a high school course. While we still have work to do to address implementation issues, we wanted to determine which online program would be most appropriate. After an initial survey of online programs that are used in other districts, we convened a teacher/administrator task force on November 7 to hear presentations from 4 of the most promising vendors. The Task Force was comprised of 3 teachers, including an SLTA representative, and 3 administrators. We brainstormed the criteria for evaluation together and then heard 45 minute presentations from Plato Learning, Aventa, CyberHigh and Odysseyware. Attached is a summary of the Strengths and Weaknesses of each program. Plato Learning was eliminated due to costs and similarity to lower priced programs. Aventa was eliminated due to uncertainty about costs and other issues. CyberHigh was considered closely but in the end was eliminated due to not being graded by the district teacher and limited ability to adapt content. Odysseyware was recommended for a variety of reasons including: it is designed for at-risk students, it is more interactive than the other programs; the teacher can adapt the content and grading criteria; the pricing structure would allow for multiple users on one license.

  78. 21 ADDITIONAL SUGGESTIONS AND COMMENTS FROM BOARD MEMBERS- 9:35 P.M
    Minutes
Trustee Prola further commented on the CSBA conference that she attended, noting that a group of Alameda County lawyers, in partnership with Boalt Hall School of Law in Berkeley, has donated $50,000 to create mock trials programs at the high schools. The program includes participation in state-wide mock trials and field trips to Boalt and other local courts. They will be contacting the Superintendent to see if the District is interested. She also shared a quote she heard from one of the speakers at the CSBA conference: "Our success must occur at the retail level, that is, gaining student trust by one on one shows trustworthiness. In the end we will not be judged by how much we spent or saved, but by knowing how many of our students succeed." Trustee Katz-Lacabe commented on how the District can go beyond the simplicity of standardized test results. He would love to see the District contact local colleges to see if our students were adequately prepared. He asked for and received consensus to have the Board Communication develop a communication survey to parents who have decided to remove their students from our public schools to send them to private schools and what would it take to bring them back. He hoped to attend the Winter Concert this Thursday. He also noted that he took his children out of school recently to visit the state capitol where they received a VIP tour, and met with an Assemblyperson. His daughter then gave her class a PowerPoint presentation on her visit. Trustee James attended the Drake's fundraiser. He urged everyone to come together to pass a Parcel Tax and to "Just Do it". Trustee Sullivan, piggybacking on Trustee Prola's comment on the mock trials, stated that her daughter participated in that program in high school and it's a wonderful program that gives the students an opportunity to experience the judicial system at work. She also commented that Jefferson will be hosting a Book, Blanket, and PJ Night on December 14, 5:30 p.m. She thanked the Board for the nomination and votes for Clerk of the Board. Trustee Almonte asked for consensus; however, it was noted that consensus was not necessary, rather Board President Mack-Rose asked if it would be possible for Student Board member Martin to lead a voter registration campaign at the high school for those students who will be turning 18 years of age prior to the possible May 2012 parcel tax election. Mr. Martin said that he would be happy to take this back to the Associate Study Body for their input and assistance. Trustee Almonte also announced that applications for one, two, or three bedroom apartments were available at the Eden House Apartments. Trustee Mack-Rose announced that there would be a Special Board meeting on December 13 at the District Administrative Office. She also attended the Holidays with Lenny Williams concert and commended the Keep the Music Rockin Foundation for bringing Learning from the Masters Series of musicians into our schools. She shared a comment regarding last week's benchmark assessments at the primary level. A teacher stated that they were not given any time for bubbling (last year a staff meeting was dedicated to bubbling). Assistant Superintendent Wong will look into this.
