  18. 5.3 Update on Measure B Savings
    Minutes
Assistant Superintendent Song Chin-Bendib, Business & Operations, presented a list of projects approved by the Board on July 19, 2011, to be paid by the Measure B savings funds. She also presented a priority list ranked by the Board if additional savings were realized, which was approved by the Board on August 2, 2011. The savings is a result of State matching funds and projects completed under budget. The list of projects has a projected cost of approximately $27M. The $27M includes $5.8M of the Qualified School Construction Bond (QSCB) Fund. As the priorities of projects to be funded from Measure B savings could change over time, it is critical for the District and the Board to evaluate and confirm the priority list if the QSCB funds are to be spent on the project list or other supplemental needs such as solar projects. The Board thanked Assistant Superintendent Chin-Bendib for her diligence in making sure they were informed on the various funding sources and giving them an opportunity to revisit the project list.

    Quick Summary / Staff Recommendation
Discuss, review and accept the most current Measure B Savings and amount.
    Board Committee
Facilities and Technology Committee: October 7, 2011
    Background Information
On August 2, 2011, the Board approved a list of unfunded projects to be paid out of potential Measure B savings. The list has an estimated amount of $27M. The project list is a compilation of unfunded modernization items from Measure B, site requests of priority facility items, and unfunded priority items from Deferred Maintenance. It is noted that Deferred Maintenance fund was swept to balance the General Fund books for the next two fiscal years. Thus, only the carryover funds from two years ago are left to pay for deferred maintenance projects. Included in the August 2 nd board cover page was an explanation of the most up-to-date realized savings. It stated, ? As of June 2011, the Measure B bond program has realized savings from offsets due to State Matching Funds in the amount of approximately $17 million. This is an estimate as of June 30, 2011. The amount may go higher after all the projects have been completed.? Additionally, it goes on to say , ??.Staff has also provided another $5 million in recommended projects and scopes to be considered by the Board, in the event that additional savings are realized so that the District may be able to create, program, design and construct these additional projects within a timely manner.? As of August 2nd, the best estimate of the savings was approximately $17M because the District was still in the midst of completing summer projects and the actual savings was undetermined at that time. As the District receives information from the Office of Public School Construction (OPSC), the total amount of project savings is updated. Staff continuously works with our professional experts (School Facilities Consultant and Harris & Associates) to identify any construction projects that qualify for additional state matching funds. The effort to maximize projects savings is on-going and will continue until all of the construction projects are completed. The $17M estimate includes only State matching funds received as of June 30, 2011, and does not include other funding sources such as Qualified School Construction Bond (QSCB) fund; Redevelopment funds from the City for the Fred T. Korematsu campus, Measure B interest earned to date, or Measure A state matching funds. Per instructions from the Board, staff has now consolidated all the above funding sources into a one document. Detailed information is attached. The highlights of the savings are as follows: 1. Realized savings from State matching funds received and completed projects: $ 16,410,000 2. State matching funds submitted but NOT funded yet: $ 1,330,000 3. State matching funds for Measure A: $ 135,000 4. Redevelopment funds from the City for FTK: ($855k has been received) $ 2,170,000 5. Measure B interest earned as of to date: $ 2,200,000 6. Qualified School Construction Bond (QSCB): $ 5,800,000 Total: $28,045,000 The purpose of this conference item is for staff to clarify the funding sources. In addition, the Board will be asked to discuss the purpose of the additional funding sources and whether these funds are to be spent on ?chart #3? of the priority project list approved by the Board on August 2, 2011, or to be considered for another purpose. Minimally, at this meeting the Board will have the most up-to-date funding sources.

    Board Committee
Facilities and Technology Committee: October 5, 2011
    Background Information
The Board of Education previously approved SIM Architects, through a Request for Qualifications (RFQ) process, to be placed in an Architectural Pool for use on selected projects as identified through the local Measure B Bond. After the architectural pool selection process, the District assigned SIM Architects the Wilson Elementary School and Madison Elementary School sites for all modernization and upgrade projects undertaken under Measure B Bond Measure. Their original contract was approved by the Board on March 6, 2007, to provide renovation and upgrade design services for Madison Elementary School. A separate original contract for the design work at Wilson was approved by the Board on February 29, 2008. In 2011, as Measure B entered the fifth year of construction of the original six year program for the projects identified in the original 2006 plan, the receipt of additional state funding allowed for the creation of additional projects and scopes from the Measure B Savings. On July 19, 2011, the Board identified and approved the creation of new projects from these offsets and savings. In order to protect the District?s DSA approved permanent classroom buildings for future enrollment growth, reduce its on-going energy consumption and utility bills, and to mitigate and minimize risk management issues, the District identified the following scopes at the Madison Elementary School Campus: Remove and replace roofing systems over classroom wing, currently occupied by the District administration functions. The existing old and deteriorated roof has been leaking for many years causing damage to interior finishes in most areas such as ceiling tiles. Remove, replace and rezone heating, air-conditioning, and ventilation (HVAC) units and controls over same classroom wing. Replace heating units, if needed, in materials center. Remove and replace roofing over materials center. Remove and replace ramp and loading dock structure that is currently failing and collapsing. Furnish and install new emergency generator that will provide power during power outages to the District?s voice over internet protocol (VOIP) phones throughout the District. Convert existing classroom into a new restroom for severe special day class students with special needs. This amendment #1 provides for the design these additional improvements at Madison ES: Contract Summary # Description Amendment Amount Contract Running Total Amend. # 0 Original contract: Renovations & Upgrades to Madison ES $9,500 1 Amend. #1 for Materials Center and District Office $206,400 $215,900

Facilities and Technology Committee: October 7, 2011
    Background Information
The Board of Education previously approved Harris & Associates (H&A), through a Request for Qualifications (RFQ) process, to provide Program, Project and Construction Management on selected projects as identified through the local Measure B Bond. The original Master Agreement was entered into on November 8, 2006, between Harris & Associates and San Leandro Unified School District to provide Program and Project Management Consulting Services for the Measure B Bond Program. On April 18, 2007, the Board approved amendment #1 which defined the scope of services for the specific projects within the original Measure B program. H&A Original Scope Summary Initial Projects from Local Measure B Funds (H&A Original Service Contract) Site(s) Funds PM CM % Fee $ High School (i.e. CTE - $3.6m, SLAM - $0, Business Academy - $750k) $73,000,000 Yes Yes 9% $6,570,000 Elem Schools & Middle Schools $36,000,000 Yes By Others 3.4% $1,216,385 Total $109,000,000 7.1% $7,786,385 Career Technical Education Facilities Program (CTEFP) H&A Scope Summary In March 2009, CDE and DSA granted final plan approval for the five (5) new projects in response to the successful grants for Career Technical Education Facilities Program (CTEFP). On July 23, 2009, the District created the CTEFP projects, and because these projects did not exist in the original Bond scope, the District did not include it in H&A?s original November 2006 contract and April 2007 scope of services. New Scope due to Additional State Funds (Proposed H&A Amendments #2-#6) Site Funds PM CM % $ High School (Example of projects: CTE - $8M additional state matching funds; * $2M from the additional 100 seats at the AEC) $10,000,000 Yes Yes 8.2% $822,615 Total $10,000,000 8.2% $822,615 * The cost for the additional 100 seats at the Arts Education Center (AEC) is approximately $5M. Due to concurrent activities, the impact to the amendment of the H&A?s contract is $2M. New Projects created from Measure B Savings ? H&A Scope Summary The District requested created several fast track projects with very short planning, budgeting, design, construction and opening durations. To execute these projects and meet the District?s educational program needs and requirements, the District utilized Harris & Associates to manage design and construction of these projects. Staff determined that the most time efficient and cost beneficial method was to have someone who was familiar with the project files, and search for the requested documents. Since Harris employees generated and filed the documents, it is natural that they were chosen for the task. Amendment #7 Fee breakdown Lincoln High School Portables = $12,000. Renovation of the CTE Center, Shop Building, was identified in the Measure B language. AEDIS Architects was retained to prepare the design and construction documents for the renovation. Plans and specifications were approved by the Division of the State Architect (DSA) and the project was bid through the requirements of Public Contract Code. The project is scheduled to be completed during the next two years. Work began during the 2010 summer break when no students were present. The renovation will include structural improvements, restrooms, new shop equipment, lighting, roofing, and painting. The Board previously approved the construction contract with D.L. Falk Construction Inc. on April 14, 2010. Subsequently the Board approved: Change Order (CO) #1 on December 7, 2010, in the amount of $57,695. CO #2 on January 11, 2011, in the amount of $20,424. This CO #11 in the amount of $25,098 is a 0.5% increase to the prior construction contract amount of $4,726,915. The project remains substantially below the construction budget of $6,501,349. Based upon the amount of hidden and unknown conditions experienced in the renovation of the existing sixty year old shop building, and both the acknowledged and disputed impacts upon the existing contractor and their original contract scope, the District and their professional design and construction team members, construction manager and architect, are planning to remove scope that has not been started and/or is not absolutely necessary for this current year?s school curriculum or operations from the District?s existing construction contract with D L Falk Construction, Inc. District staff, with the program manager and the construction manager and architect, will create a SLHS CTEC Phase II project to execute the remaining required build out and renovation of the shop building to satisfy the requirements and commitments of the three (3) Career Technical Education Facility Program (CTEFP) grant provisions. The plan for the Phase II project is to first identify and refine necessary scope, get proposals and execute amendments to authorize the architect, construction manager and inspector to start on a Phase II project, prepare drawings & specifications, submit to DSA, bid, award and construct with another general contractor next summer, 2012. The current project budget is $10, 442,767. There is sufficient project budget to fund and execute a Phase II project of $2,100,000 to $2,500,000. Currently, the District has committed approximately $6,900,000 and expended approximately $6,300,000, on the SLHS CTEC project, which houses the three CTE programs covered by the grants. The required qualifying expenditures to satisfy the terms of the grants is a total of $9,000,000. Senior Director II John Thompson. Ed.D. explained that recent events involving student and staff safety at San Leandro High School have caused site and district administration to review the current safety structures and systems that are in place at the high school. The school received input and recommendations and as a result, the high school administration has recommended that the vacant campus supervisor position be filled immediately which will allow for additional coverage both during the school day and during the after school program. This position will be funded with onetime Jobs Bill money and will be eliminated at the end of the 2011-12 school year unless other funds become available to fund this position. Trustee Mack-Rose voiced some confusion on whether or not this position was "new" or "vacant" and funding resource. Superintendent Cathey reminded that the Board that they restored two campus supervisor positions; however, only one position was filled. In addition it was noted that there was a short-term position at the high school that was funded through the Jobs Bill and had expired, so this position was already built into the budget and that the school was not increasing the number of campus supervisors, but rather returning to the eight positions that were in place before budget cuts.

    Background Information
Recent events involving student and staff safety at the San Leandro High School campus have caused site and district administration to review current safety structures and systems that are in place at the high school. The school has received input and recommendations from students, parents, staff and the administration regarding steps to be taken to increase campus safety and security. In addition to specific facility improvements that are currently being analyzed, staffing needs were evaluated. As a result of that evaluation, the high school administration has recommended that the vacant campus supervisor position be filled immediately. This position will allow for additional coverage both during the school day and during the after school program. In addition, this position will provide for increased supervision during lunch and as students are leaving school for the day. Staff is recommending that the Board of Education authorize the filling of the vacant campus supervisor position at the San Leandro High School. Approval of this item will allow staff to advertise for and fill this position.
