Parents and grandparent advocates, April Key, Jennifer Thatcher, Rosalie Street and Melissa Lopez addressed the Board about the summer closure of the John Muir Special Day Class, for deaf and hearing impaired children located in Berkeley. Due to the closure, one parent wrote of the difficulty of putting her five-year-old on a bus to go to a special day class in Vallejo. Parents of children in the special day class have formed a group, Partnership for Childrens' Success, to advocate for the re-opening of this program that provides the educational strategies needed for children who have not had language in the first couple of years of their life. The group explained that they are visiting neighboring School Boards to raise awareness and recruit potential deaf and hearing impaired students who could be released from their own school districts through the SELPA (Special Education Local Plan) in order to boost enrollment and reinstate the program. Trustee James, who serves as the Board representative on the MACSELPA, will present the issue at the next MACSELPA meeting.

    Minutes
The Board received a presentation from Sheila Lawrence, Director of Student Support Services; Robert Crose, Director, Student Programs Administration, ACOE; and Mary Fischer, Principal of Hayward Community School. San Leandro Unified refers students expelled to Hayward Community School, which provides a variety of support structures to help students get back on track, including tutoring, on-site counseling, parenting classes and health services. Small class sizes and the successful redirection of inappropriate behaviors have helped students focus on their learning and raise their GPAs. Upon completion of all requirements, each student is given a success plan to assist with the transition back to a District school. Director Sheila Lawrence said that since coming to the District in 2008, she has recommended 69 expulsions and of those, only one has been brought forward for another expulsion. The Board thanked the presenters for the information and commended them for their wonderful service and work they provide to the students. Trustee Mack-Rose raised a concern with regards to discrepancies in the enrollment numbers and asked that an explanation be placed in the Confidentially Speaking updating the status of the three students exiting Hayward Community School.
    Quick Summary / Staff Recommendation

The presentation included a brief overview of how 5,060 lunches are prepared daily and delivered to the various sites from one of the four packing kitchens located at San Leandro High School, Fred T. Korematsu Campus, and Bancroft and John Muir Middle Schools. Additionally, the presentation highlighted four options, for the Board to consider, to have cooking kitchens that would allow the District the ability to provide fresh cooked meals. Those options included: Option Description Est. Capital Cost Est. Staff Option A Continue with current operations but make capital improvements to bring elementary kitchens up to code $1.4 Million No change from current operation Option B Continue packaging entrees for elementary schools but upgrade the secondary kitchens to have the capacity to cook meals for all the elementary school sites $3 Million $450,000 per year Option C Make all elementary school kitchens full cooking facilities $6.1 Million $680,000 per year Option D Continue packaging entrees for elementary schools but provide a central kitchen to fully cook entrees for all sites (upgrading an existing facility) $1.75 Million $250,000 per yea r Mr. Soliz also shared the survey results on an Elementary Student Pasta Taste Test conducted at the eight elementary schools during lunch the week of September 5, adding that the top vote getter was the Pasta Alfredo at 98%. Although the budget does not allow for this currently, the Board directed staff to conduct a more thorough analysis to bring all facilities up to code and to identify potential locations and needed facility upgrades for a centralized kitchen to serve elementary schools in the event that additional new monies become available. However, given that there is no money currently identified or available, it was noted that the analysis does not need immediate staff attention.

    Quick Summary / Staff Recommendation
Approve the Title I School Wide Plan for Monroe Elementary School.
    Background Information
Title I School-wide Programs (SWPs) are a cornerstone of the vision for school reform as defined in Title I of the federal No Child Left Behind (NCLB) Act of 2001. Research shows that in order for the lowest achieving students in the highest poverty schools to meet high standards of performance, the school?s entire instructional program, not just a separate Title I program, must be substantially improved. Since no separate student eligibility process is required for participation in an SWP, the advantage to a school?s becoming an SWP is that the SWP educational program provides better flexibility to serve ALL students, including Title I students. Fiscally, NCLB allows schools to consolidate or blend funds. SWP schools may then use their consolidated federal, state, and local funds to reform their entire educational program. Monroe's School Site Council approved the school wide plan on April 27, 2011. Title I schools often choose to change their status from targeted assistance to SWP status in order to better meet the needs of their students. To be eligible, schools must have a concentration of students living in poverty of at least 40% in the initial year of their SWPs. There are nine required components incorporating a comprehensive needs assessment, involving all stakeholders in the process, and annually evaluating the plan and its effectiveness in meeting its goals and objectives. The requirements of the Title I School-wide Plan includes elaboration in the following areas: ? School-wide Reform Strategies ? Instruction by Highly Qualified Teachers ? High Quality and Ongoing Professional Development ? Strategies to Attract Highly-Qualified Teachers ? Strategies to Increase Parental Involvement ? Successful Transition from Elementary School Students Plan ? Opportunities for Teacher Input and Decision Making ? Timely and Effective Support for Students Who Experience Difficulty Attaining Proficiency ? Coordination and Integration of Federal, State and Local Services and Programs Attached is Monroe's Strategic Program Action Steps Alignment with these nine components for the School-wide Title I Plan. Upon Board approval, the plan is submitted to the California Department of Education for approval.

Last year through our partnership with K to College we were able to distribute close to 4,000 School Supply kits through their School Supply Initiative(SSI). The goal of the initiative is to provide students with beginning of the year materials necessary to achieve in school as their other peers do. Additionally, in the 2010-2011 school year, we partnered with K to College for their Dental Kit Initiative (DKI) and were able to distribute close to 3,000 dental kits to all of our students in K-3rd grades. The proposed MOU for K to College intends to extend the partnership with the District from November 2011 - December 2016. For the 2011-2012 School year, K to College plans to deliver back packs with school supplies to all of our McKinney-Vento students. The Dental Kit Initiative will also continue, with the goal of serving students in all grade levels. In the coming year, K to College is re-tooling their School Supply Initiative with the goal of resuming their extensive and wide-spread distribution of school supplies for Free and Reduced Lunch students in the Bay Area and beyond. The five year MOU will cement our partnership and enable the District to continue to receive significant donations from both of the K to College Initiatives on behalf of our students. The District will develop a plan for distribution of these school supplies and dental kits to eligible students on an annual basis.

Trustee Mack-Rose expressed a concern with regards to schools spending site funds on an after school enrichment program. Assistant Superintendent Debbie Wong explained that in an effort to promote a service learning culture and making learning relevant, in addition to ASES or ASSETS, schools often provided other support programs funded out of site funds such as tutorial programs. The discussion continued with concerns raised that while this program was admirable and worthwhile, site funds could be spent on other programs that occur during the day, particularly when ASES and ASSETS contribute funding for after school programs.

Approve the Memorandum of Understanding between San Leandro Unified School District and Alameda County Office of Education and Boys and Girls Club of San Leandro for Cesar Chavez After School Service Learning, Curriculum and Professional Development for Bancroft and John Muir Middle Schools for the 2011-2012 School Year
    Background Information
Both Bancroft and John Muir Middle Schools are requesting to offer students in the After School Education and Safety (ASES) program a nationally recognized program from the Cesar Chavez Foundation a Cesar Chavez Service Learning Club coordinated by the Boys and Girls Club who oversees our ASES program. It will focus on educating students not only on the work of Cesar Chavez, but about civil rights heroes and their legacies. There will be guest speakers, such as Anthony Chavez, grandson of Cesar Chavez and Karen Korematsu, daughter of Fred Korematsu, as well as a service learning component. In collaboration with Alameda County Office of Education and the Boys and Girls Club of San Leandro, the schools will receive ACOE adapted Chavez Club curriculum, professional development and coaching on the use of the curriculum for our Boys and Girls Club staff. This is an excellent example of bridging during school and after school collaboration of services for students and promoting a service learning culture and making learning relevant. The Memorandum of Understanding and program components are attached for your reference.

Trustee Prola commented that she had a concern regarding hourly rate for the Destiny Arts contract. Assistant Superintendent Debbie Wong stated that Destiny Arts is a high-cost outside agency that provides a specialized service. Since the Board-approved instructor left suddenly, it has been difficult to hire a replacement, and they needed a short-term solution just through January 19 until another cost effective and viable program replacement is found. Following the explanation, on a motion made Trustee Prola and seconded by Trustee James, the Board approved to pull and not approve the contract with Destiny Arts Center by a 4-3 vote. Trustees Katz-Lacabe, Mack-Rose, and Sullivan voting in the negative. Following the vote, staff explained that the class would continue to be covered by a substitute until a permanent instructor was hired. The Board then moved ahead and approved the remaining two contracts: Girls Incorporated and Kristin Palm by the following vote:

    Background Information
This agreement is between the San Leandro Adult School and the Nor-Cal. Cosmetology/Barbering Apprenticeship Program and Cosmetology Apprenticeship Committee (NCCBAP) to provide apprentice services for the Adult School students. The agreement is from the same template that the Adult School has been using for years when entering a partnership with other apprenticeship programs or agencies. This training program consists of over 2,300 hours of study within a two year period. The theory portion of the program, the first 144 instructional hours, will be taught at the San Leandro Adult School. The remaining program hours will be on the job training (OJT) taking place in salons throughout the area. Through NCCBAP, students entering the program are guaranteed a paid, full time, apprenticeship position throughout the program once they have completed the 144 hours of theory. Apprentices? weekly scheduled hours must be between 32-42 hours per week for the two year period. Apprentices are guaranteed their weekly paid hours whether there is work for them to perform or not. Apprentices receive salary increases periodically throughout the two year training period. As for registration fees, perspective students would pay for the program through NCCBAP. No money will exchange hands between prospective students and San Leandro Adult School. Staff has been told the fees will be one-time and range from $300 to $1,300 per student. NCCBAP has not decided exactly how much yet for this program. The instructors for the theory portion are provided by NCCBAP and are credentialed. There will be no instructional costs for San Leandro Adult School. Managing all aspects of the program will be the responsibility of NCCBAP. As with all apprenticeship programs, the State of California, Department of Industrial Relations, Division of Apprenticeship Standards (DAS), will monitor this partnership, at no cost to the San Leandro Adult School. DAS Apprenticeship Consultant, Victor Rodriguez, is approving this partnership to move forward on behalf of the Sate of California, once the San Leandro Unified School District Board of Education approves this agreement. There will be no cost to the San Leandro Adult School or the District for this program. As with all of the other apprenticeship programs, the San Leandro Adult School will be the Local Education Agency (LEA) using the federal Apprenticeship funds to assist NCCBAP. The funds are restricted for apprenticeship programs only. For charging overhead costs: The District will assess the State approved indirect/overhead cost which varies every year San Leandro Adult School will retain 20% AFTER the District?s assessed amount as the Local Education Agency (LEA) San Leandro Adult School will charge another 5% after the aforementioned assessments for supplies, operating expenses and statutory expenses paid for the teachers.

    Board Committee
Facilities and Technology Committee: October 21, 2011
    Background Information
Renovating restrooms at Wilson Elementary School was identified in the Measure B language. SIM Architects was retained to prepare the design and construction documents for the restroom renovations. Plans and specifications were approved by the Division of the State Architect (DSA) and the project was bid through the requirements of Public Contract Code. The entire project was completed during the summer 2011 break when no students were present. The Board previously approved the construction contract with Zolman Construction and Development, Inc. on April 19, 2011. Over the past year, the District has received notification from the County of Alameda Department of Environmental Health (CADEH) that Wilson?s outdated kitchen was in violation of current code because of the absence of a three compartment sink and a dedicated hand wash sink and that this violation needed to be corrected. On June 21, 2011, the Board approved SIM Architects to design the required modifications. During the design review by CADEH the requirement of replacing the existing vinyl composition tile flooring with an appropriate sanitary product was added. CO #1 added the kitchen sinks and flooring modifications to the Zolman restroom renovation contract. Since these three compartment sinks and a dedicated hand wash sink are equipment used by the Food Services department, the funding to pay the cost will come from the Food Services budget. The Food Service funds allow expenditures for fixtures, furnishings, and equipment (FF&E). The exception is the flooring which is a permanent modification of the building and therefore will be funded by Measure B savings. Subsequently, the Board approved Change Order (CO) #1 for the CADEH required kitchen modifications on August 16, 201 in the amount of $72,180. During the course of performing the kitchen work additional scope was required by CADEH which included a mop sink, hot water in staff restrooms, and a water heater stand. Additionally asbestos containing materials were encountered that needed to be abated. This (CO) #2 in the amount of $30,798 is a 3.8% increase to the prior construction contract amount of $807,180. The project is within the new budget which includes the Food Service and Measure B savings funds. Board Committee
Facilities and Technology Committee: October 21, 2011.
    Background Information
The Board of Education previously approved Vista Environmental Consulting for use on selected projects as identified through the local Measure B Bond. The original contract in the amount of $61,690 was entered into on February 22, 2008, between Vista Environmental Consulting and San Leandro Unified School District to provide Hazardous Materials Assessment, Remediation Design, and Remediation Oversight services for the San Leandro High School (SLHS) Music Building, Monroe Elementary School Administration Roof, and the Restroom Renovations at Washington and McKinley Elementary School projects. Subsequently the Board approved: Amendment #1 on November 6, 2008 in the amount of $88,610. Amendment #2 on November 17, 2009 in the amount of $25,000. Amendment #3 on February 8, 2011 in the amount of $28,750. Amendment #4 on March 1, 2011 in the amount of $186,610. The practice in the District is to award subsequent projects via amendments to the original contract, rather than combining or rolling all projects into the original contract. Board Committee
Facilities and Technology Committee: October 21, 2011
    Background Information
Classroom painting & new lighting at Roosevelt Elementary School was identified in the Measure B language. AEDIS Architects was retained to prepare the design and construction documents for the painting and lighting. Plans and specifications were approved by the Division of the State Architect (DSA) and the project was bid through the requirements of Public Contract Code. The entire project was completed during the summer 2011 break when no students were present. The Board previously approved the construction contract with BRCO Constructors Inc. on May 3, 2011. This CO #1 in the deductive amount of <$42,122> is an <8.8%> decrease to the prior construction contract amount of $481,000. The construction contingency of $48,100 was not needed, and will result in project savings. Because of the lower than normal number of hidden conditions, the credit in this change order combined with the construction contingency of $48,100, results in a total savings to the project of $90,222. Staff proposes to transfer $33,892 of the $90,222 savings to the Bancroft Middle School Painting and Lighting project to cover its budget shortfall. Both projects were performed under the same contract with BRCO Construction this past summer. For transparency purposes and per directions from the Facilities and Technology Committee, $33,892 of the savings from Roosevelt Paint & Lights will be transferred through Financial Reserve and then onto Bancroft Paint & Lights. An unusually large number of hidden and therefore unforeseen conditions were discovered during demolition activities that were not reflected in the archived drawings. Senior Director II John Thompson, Ed.D. explained that two years ago the District entered into this agreement and it is up for renewal. In addition, responding to Trustee Sullivan, he stated that the approximate $10,000 from Title II funds should be sufficient enough to provide tuition for the Special Education educators who are not qualified, as defined by NCLB, and that in the event that all teachers in ESEA core academic subjects are not 100% highly qualified, the agreement will be entered into for the 2013-14 school year and any future consecutive school years until the compliance is met.

    Background Information
The Elementary and Secondary Education Act (ESEA) requires that all teachers assigned to teach core academic subjects as defined in the ESEA are highly qualified. When school districts (LEAs) do not have 100% highly qualified teachers assigned to teach these classes and when they have failed to make Adequate Yearly Progress (AYP) for three consecutive years, the California Department of Education (CDE) requires that LEAs enter into an agreement with the CDE. This agreement specifies how the LEA will work to achieve 100% compliance and commits funding from Title II funds for this purpose. The SLUSD has not made AYP in all areas for three consecutive years and does not have 100% highly qualified teachers in all classrooms. Therefore, we are required to enter into the aforementioned agreement.

Adopt Resolution #11-47 for the change of Third Party Administrator and Common Remitter from Great American Plan Administrator to MidAmerica.
    Board Committee
    Not Applicable.
    Policy / Code
Internal Revenue Code 403(b), California Education Code 44041
    Background Information
In September 2009, the San Leandro USD ?District? entered into an agreement with Great American Plan Administrators (GAPA) as the 403(b) Third Party Administrator (TPA). GAPA has not charged any fees to participants/employees. Recently, the District was informed that GAPA has been acquired by the TSA Consulting Group. The TSA Consulting Group charges employees a fee for their 403(b) services. While the District knows the current free administration arrangement cannot last forever, the District is pleased to have helped employees avoid TPA fees for as long as it was possible. Unfortunately, the period of free TPA services has come to a close and the District will be transitioning this fall to a new fee based TPA. There is no longer any free TPA in the market. The difference is that some TPAs will provide investment providers that will absorb the fees charged by the TPAs. The District has gathered and compiled appropriate information including fee structure and surrounding school districts who participate with the various Third Party Administrators. After extensive research and analysis, staff has concluded that the best reputable and qualified TPA in the market to provide investment providers to pay fees on behalf of our employees is MidAmerica. Staff therefore recommends MidAmerica to be the District?s TPA that will replace GAPA starting December 1, 2011. On October 19, 2011, staff met with all Union representatives about the transition of the District?s TPA/Common Remitter from Great American Plan Administrator to MidAmerica. There is no change of service provided by independent financial advisors because employees can still consult with the same advisors. As part of the agreement, MidAmerica will provide a current list of investment providers to employees. This list is attached. During this transition, employees have the option to remain with their existing investment providers and if the investment providers happen to be those that do not pay TPA fees on behalf of the employees, the employees will have to pay the TPA fee and it can be either pre-tax or after tax. The transition to MidAmerica should be fairly seamless and employees will not experience any disruption to their service.

  68. 20 ADDITIONAL SUGGESTIONS AND COMMENTS FROM BOARD MEMBERS-9:20 p.m.
    Minutes
Trustee James reported that he attended College Night, along with Trustee Mack-Rose. He also commented that his son attended the Homecoming Dance and found it to be a very successful event. Trustee Sullivan reported that she participated in the focus group at Lincoln, commenting that she found it very enlightening to hear about what is happening at that school. She is hopeful that the state will name Lincoln as a model continuation school. Sharing a comment made by one interviewer, "If you play good, you've got to look good - we must improve the esthetics of the interior and exterior buildings," it reminded her of her comments regarding the appearance of the Lincoln campus, adding that she mentioned that money has been set aside for that reason. She asked for consensus to recognize math teacher and math coach Anthony Del Rosario with a Certificate of Commendation for his hard work. Assistant Superintendent Debbie Wong suggested that rather than recognize an individual teacher, the Board could recognize all the coaches in general mid year. Trustee Almonte urged the Board to watch "The X Factor" where Ellona Santiago, a graduate of Garfield Elementary School and currently a sophomore at Arroyo High School, has been chosen as one of the ten most talented teenagers to compete as a group called inTENsity, now competing for the $5 million record deal with Sony. Trustee Prola asked for consensus to have the Policy Committee revisit the dress code; however it was suggested to direct staff to have sites review the code and if appropriate bring it back to the Policy Committee for amendment. She attended the Staff Development yesterday where the Superintendent of Sanger USD presented an overview of the Professional Learning Communities, stating the math scores in his district improved more than 60 points in one school year. She hoped that our staff would be able to use it for the benefit of our students. Trustee Carey commented that Eat Out for Education is tomorrow night. He attended College Night, the Saturday Night football game at Arroyo, and will be attending the Homecoming game this Friday, where his daughter has been nominated for Homecoming Queen. Trustee Katz-Lacabe commented that the Haunted House at Washington Elementary School was "awesome." Thursday night, November 3, is the PTA sponsored Math Night at Washington Elementary. Students from the high school LGBTQS will be speaking at Roosevelt Elementary tomorrow, November 2.
