  54. K ACTION/DISCUSSION ITEMS
  55. K.1 General Services
  56. K.1.a Inclusion of Adult Education Average Daily Attendance in School Board Remuneration Passed
    Rationale
California Education Code Section 35120 sets forth compensation guidelines for members of the governing board of K-12 school districts according to the average daily attendance (“ADA”) of the students within the District. The Board shall consider the inclusion of the average daily attendance of adults in the District’s adult education classes in the overall ADA numbers for the District for the purposes of Board member compensation, consistent with SLUSD Board Policy 9250, for the reasons set forth below. The California State Legislature has established the legal responsibility and burdens school districts have for maintaining adult education programs in Education Code Section 8530, which states: “Adult basic education is the responsibility of high school and unified school districts except in those instances where by mutual agreement the responsibility is assigned to a community college district." The District’s Board of Education has itself recognized this responsibility and burden in Board Policy 6200, by noting that “education is a lifelong process and that it is important for individuals to continuously develop new skills," by approving all courses to be offered in the adult education program, and by assigning the Superintendent or designee with the task of developing and overseeing the district's adult education program. The District’s Board of Education has established classes for adults and such classes have resulted in an ADA of 100 or more, thereby requiring the District to establish an adult school for the administration of the program pursuant to Education Code Section 52502. In maintaining an adult education program, the District’s Board of Education is further required to adhere to the Brown Act, create and maintain multiple additional functions, including budget controls and audits, public hearings regarding proposed budgets, certain prescribed courses and education programs, enforcement of courses of study and uses of text books, and preparation of courses for adult schools pursuant to Education Code Section 52501.3. Adult attendance in classes for adults may be included in high school district ADA for the purposes of computation of allowances and apportionments from the State School Fund pursuant to Education Code Section 41608.

  57. K.1.b SLUSD Board Policy Updates Passed 📎 2

    Recommended motion

The following policies have been revised, vetted by staff, reviewed by the SLUSD Policy Committee, and are being submitted for board approval: AR 3311 Business & Non Instructional Operations/BIDS BP 4030 Nondiscrimination in Employment AR 4112.23 Special Education Staff AR 4119.11 Sexual Harassment AR 4219.11 Sexual Harassment AR 4319.11 Sexual Harassment BP 4121 Temporary/Substitute Personnel AR 4261.1 Personal Illness/Injury Leave AR 6142.1 Sexual Health & HIV/AIDS Prevention Instruction BP 6146.1 High School Graduation Requirements BP 6152.1 Placement in Math Courses BP 6173 Education for Homeless Children BP 6142.1 Sexual Health & HIV/AIDS Prevention Instruction BP 6190 Evaluation of the Instructional Program BP 6179 Supplemental Instruction AR 5112.2 Exclusions from Instruction AR 5112.2 Exclusions from Attendance BP 5141.31 Immunizations AR 5141.31 Immunizations AR 6173 Education for Homeless Children AR 6173.1 Education for Foster Youth BP 5111.1 District Residency AR 5111.1 District Residency BP 5141 Health Care & Emergencies

  60. K.2.b Amendment No. 3 to the Harris & Associates Contract for Additional Program Management Services on 2016 Measure M Bond Projects Passed 📎 1
    Rationale
As part of the Measure M implementation processes, the District conducted a SOQ/RFQ/RFP qualification based selection process for Program Management (PM) firms. Harris & Associates received the highest overall ranking and was selected to manage the Measure M program. The Board of Education previously approved Harris & Associates (H&A), through a Request for Qualifications (RFQ) process, to provide Program, Project and Construction Management on selected projects as identified through the local Measure M Bond. The original Agreement for Program Management Services was entered into on February 1, 2011, between Harris & Associates and San Leandro Unified School District to provide Measure M Program Management Services for the Measure M Bond Program, in the amount of $2,060,000, with a program completion date of December 31, 2014. Amendment (No.1) that extended the contract completion date from 12/31/14 to 9/30/15. Amendment (No.2) that extended the contract completion date from 9/30/15 to 12/31/15. Due to DSA requested changes on the fencing structural details, the extended DSA review time, and the added ramp review times on the fencing projects, it is now necessary to extend the scheduled completion of the Measure M Bond program from December 31, 2015 to March 31, 2016, so that these important projects can be completed. This Amendment No.3 will extend the contract completion date 3/31/16 and have Harris & Associates continue to provide required Program, Project and Construction Management consulting Services and for the following Measure M Bond Program, as denoted below. Measure M Bond Five (5) Elementary School sites – Fencing project - (PGM/PM/CM) Two (2) new ADA concrete ramps at Wilson ES and Washington ES - (PGM/PM/CM) Muir MS – Air Conditioning project – (PGM/PM/CM) Fiscal year 2014/2015 Financial Closeout support thru 3/31/16 – Program wide DSA Closeout and Certification management and support thru 3/31/16 – Program wide Contract Summary Item Description Item Amount Running Contract Amount Running % Increase Agreement Measure M Program Management Services $2,060,000 $2,060,000 0 Amend. #1 Time Extension of nine (9) months due to Revised & Added Scopes $219,939 $2,279,939 10.67 Amend. #2 Time Extension of three (3) months due to Revised & Added Scopes $126,976 $2,406,915 16.84 Amend. #3 Time Extension of three (3) months due DSA delay $69,000 $2,475,915 20.19 Harris & Associates has provided skilled technical and professional services on the management of the District’s bond program.
